About this file

This justification and approval document seeks a four-month extension to an existing contract for shelf stocking, receiving, storage, custodial, and meat custodial operations at the Quantico Marine Corps Base Commissary. The performance period would be from February 1, 2020 to May 31, 2020. The incumbent contractor, LaMain Crescent Joint Venture, LLC, currently performs these services under contract HDEC08-14-C-0029 awarded on June 30, 2014. The estimated cost of the four-month extension is $524,543.97. Authority cited for the extension is 10 U.S.C. 2304(c)(2) and FAR 6.302-2 regarding unusual and compelling urgency. The justification provided is to prevent disruption of commissary operations and denial of benefits to service members, and to allow time for implementation of a new CLICK2GO e-commerce initiative at this location by the incumbent before award of a new contract.

JUSTIFICATION AND APPROVAL

FOR OTHER THAN FULL AND OPEN COMPETITION

1. Contracting Office – Defense Commissary Agency (DeCA), Store Services Support

Division (CCQT), 1300 E Avenue, Fort Lee, Virginia

2. Type of Contract Action – Four-month J&A for Contract HDEC08-14-C-0029; Firm Fixed

Price (FFP) Contract; Defense Working Capital Funds (DWCF). The period of performance will be February 1, 2020 through May 31, 2020.

3. Description of Supplies/Services – Acquisition is for Shelf Stocking, Receiving/Storage/

Holding Area (RSHA), RSHA Custodial, and Meat Custodial Operations by LaMain Crescent

Joint Venture, LLC at the Quantico MCB Commissary, located in Quantico, Virginia. The period of performance is four (4) months for approximately $524,543.97, which includes the value of the CLICK2GO service in the amount of $26,330.00 for the four-month bridge contract.

The contractor shall furnish all personnel, supervision, supplies, equipment, tools, materials, and other items and services as necessary to perform the above commissary services.

4. Authority Cited – 10 U.S.C. §2304 (c)(2) and FAR 6.302.2 – Unusual and Compelling

Urgency.

5. Reason for Authority cited: Contract HDEC08-14-C-0029 expires on January 31, 2020.

Disruption of Shelf Stocking, Receiving/Storage/Holding Area (RSHA), RSHA Custodial, and

Meat Custodial Operations will potentially result in a shutdown of the commissary. The service member will be denied their commissary benefit provided to them by statute under 10 USC

§2481 and 10 USC §2484. The commissary benefit is a cornerstone of the military quality of life and it is essential that DeCA provides a fully operational commissary. Loss of these products would negatively impact DeCA’s mission to provide for military and civilian members and their families.

A new solicitation was issued as a competitive 100% Service-Disabled Veteran-Owned (SDVO) small business set-aside. At the request of the Director, Acquisition Management Directorate, as a precautionary measure, the purpose of this J&A is to allow sufficient time for the CLICK2GO initiative to get off the ground due to the high visibility of this initiative by Senior Leadership.

The DeCA has only incorporated CLICK2GO into one other contract (Fort Belvoir - Crescent

Resources, LLC) with a Go Live date of September 30, 2019. The incumbent contractor at

Quantico (LaMain Crescent Joint Venture, LLC) has the same corporate leadership; therefore, they are familiar with the required services. LaMain Crescent Joint Venture, LLC agreed to perform the CLICK2GO requirements at the Quantico MCB Commissary in June 2019 in the event DeCA extended the current contract. Six of their employees have completed the required background checks and were issued a Common Access Card (CAC) by the base at Quantico to support the additional services.

The J&A will allow the Store Services Support Division ample time to finalize discussions, get past any potential protest periods associated with the new award, and adequate time to amend the solicitation to reflect CLIC2GO as an optional subline item and allow each offeror in the competitive range to present their pricing and any exceptions prior to contract award. The additional time will also allow DeCA time test for the CLICK2GO services at the Quantico

MCB Commissary, determine if additional language is needed in the security requirements and/or scope of work without disruption of services utilizing the incumbent contractor, and/or time to determine a different course of action, if the successor contractor chooses not to perform the additional service. The CLICK2GO initiative is still being tested; therefore, it is not contained within the Performance Work Statement currently being negotiated. It is also feasible that the test period may end prior to May 31, 2020. The DeCA Trusted Associate responsible for the contractor’s CAC has agreed to extend the CAC’s expiration through May 31, 2020.

Due to time constraints and viability, the requested four-month contract extension is determined to be in the best interest of the Government, to allow for a continuation of services without disruption. LaMain Crescent Joint Venture, LLC is already performing the services at a satisfactory level and is knowledgeable of all requirements, and they can continue operations without delays or disruption. Issuing a new solicitation for this four-month period would present unacceptable delays in fulfilling the Government’s requirement for Shelf Stocking, Receiving/Storage/Holding Area (RSHA), RSHA Custodial, and Meat Custodial Operations at the Quantico MCB Commissary. The time and costs associated with the Government to re-compete a four-month effort would not be prudent and would not result in recouped costs over the life of a typical five-year contract. As such, an extension of services for an additional four-month period will allow the contracting activity sufficient time to finalize discussions, make a subsequent award determination, and eventual award to prevent break in service to our military families and veterans. Only the incumbent contractor can provide full, uninterrupted service to the Quantico MCB Commissary, until the new award is in place.

6. Efforts to Obtain Competition – A sources sought notification was not issued for this requirement due to the fact that no contractor would be capable to provide service for a four-month period. Any new contractor for the four-month period would require approximately 30 days for start-up purposes to successfully perform and maintain operations. In addition, a new solicitation was issued as a competitive 100% SDVO small business set-aside. A sufficient number of proposals were received and evaluated, and due to the requirement for discussions, revised proposals will be received for re-evaluation.

The Justification and Approval (J&A) will be available for public inspection after the completion of the contract modification in accordance with FAR 6.305.

7. Fair and Reasonable Cost Determination – The cost for the four-month extension will be at the current contract rates, which were determined fair and reasonable at the time of the initial award in accordance with FAR 15.404-1(a)(2) and are still determined fair and reasonable.

8. Market Research – Market research was conducted which revealed that several Service-

Disabled Veteran-Owned (SDVO) small businesses were interested in a five-year effort.

9. Other Factors – As a result of technical evaluation of all (responsive) proposals submitted, it was determined that discussions were necessary, which results in re-evaluation of revised proposals for award determination that has taken longer than expected.

10. Interested Sources – The Government has not received any inquiries from any interested sources for the four-month extension.

11. Action to Increase/Foster Competition – The new award will be a 100% SDVO set-aside and the Government expects sufficient competition on future procurements.

Technical/Requirements Certification – “I certify that the supporting data under my cognizance included in this justification is accurate and complete to the best of my knowledge and belief.”
