About this file

This document provides an amendment to a solicitation for shelf stocking, receiving, storage, holding area, and custodial operations services at the Dover Air Force Base Commissary. The amendment replaces attachments to update the performance work statement, collective bargaining agreement, and cost breakdown. It also provides answers to questions from potential offerors, extends the response deadline to January 18, 2019, and lists attendees from a pre-award site visit. Services required include shelf stocking, receiving, storage and holding of merchandise, and custodial operations. The opportunity is set aside for 8(a) small businesses with a NAICS code of 561990 and $11 million size standard. The Defense Commissary Agency is the contracting agency. The incumbent is Crescent Resources, LLC.

The amendment replaces the performance work statement, collective bargaining agreement, and cost breakdown attachments with updated versions. It also answers questions about the collective bargaining agreement application, executive order 13706 requirements, cleaning responsibilities, staffing roles, minimum profit/expense requirements, product movement compensation, exterior cleaning/snow removal responsibilities, and product expiration removal timelines. An appendix lists attendees from a pre-solicitation site visit held on December 4, 2018.

SECTION SF 30 - BLOCK 14 CONTINUATION PAGE

The following have been added by full text:

Solicitation HDEC08-18-R-0018 for Shelf Stocking, Receiving/Storage/Holding Area, and Custodial Operations at the Dover Air Force Base (AFB) Commissary, located in Dover AFB, Delaware is hereby amended as follows:

1. ENCLOSURE 1: Questions were received in accordance with solicitation instructions. This enclosure provides all questions and answers.

2. ENCLOSURE 2: List of attendees from the Pre-Award Site Visit at the Dover AFB Commissary on December 4, 2018.

3. Attachment1, Performance Work Statement (PWS) Dated September 21, 2018, is removed in its entirety and replaced with Attachment1 PWS Dated December 21, 2018. Changes were made to the PWS effective date and paragraph 4.3.3.1, Cleaning and Dusting, which are highlighted in yellow.

4. Attachment 2, WD 2015-4271 Rev 7, removed in its entirety and replaced with Attachment 2, Collective Bargaining Agreement (CBA) Agreement Between Crescent Resources, LLC Dover Air Force Base Commissary and Local Union No. 780 Motion Picture and Video Tape Laboratory Technicians, Allied Crafts and Government Employees, August 1, 2018 to July 31, 2021.

5. Attachment 3, Vol I Cost Breakout, removed in its entirety and replaced with Attachment 3, Vol I Cost Breakout (Revised).

6. The proposal receipt date is changed to January 18, 2019 at 3:00 p.m. EST.

ENCLOSURE 1:

1. Upon research we have discovered there is a CBA in place at this facility but was not released in the solicitation. Will this be released at a later date? Which rates will apply to the proposal, Wage Determination or CBA?

RESPONSE: The Collective Bargaining Agreement (CBA) is included in the Amendment.

2. Will EO 13706 have any effect if there is a CBA in place?

RESPONSE: In accordance with the United States Department of Labor, if a CBA ratified before September 30, 2016 applies to an employee’s work performed on or in connection with a covered contract, and the CBA provides the employee with at least 56 hours (or 7 days) of paid sick time (or paid time off that may be used for reasons related to sickness or health care) each year, the requirements of the Executive Order and the Final Rule will not apply to the employee until the date the agreement terminates or January 1, 2020, whichever is first.

If the CBA provides the employee with paid sick time (or paid time off that may be used for reasons related to sickness or health care) each year, but the amount provided under the CBA is less than 56 hours (or 7 days), the contractor must provide covered employees with the difference between 56 hours (or 7 days) and the amount provided under the existing CBA in a manner consistent with the EO and Final Rule or the terms and conditions of the CBA.

3. In section 4.3.3.1 of the PWS the requirement mentions overlays for ESL’s. Upon inspection of the store the referenced overlays were not present. Will these overlays be re-installed? IF not, what is the cleaning requirement with the overlays not in place?

RESPONSE: The cleaning requirements are identified in the PWS. However, if lens covers exist that are 3 to 4 feet long, the contractor is not required to remove the lens covers to clean the track.

4. There is not an assistant project manager listed in the CBO, does this mean there is not allowed to be an assistant manager?

RESPONSE: In accordance with the Performance Work Statement (PWS), the prospective offeror can provide an onsite Project Manager (PM) or alternate who shall be present and act with full authority for the contractor on all contract matters relating to the daily operation of the contract and be responsible for the overall management and coordination of work. The PM or alternate may be working supervisors. Ultimately it is the prospective contractor’s responsibility to determine the specific labor categories and overall staffing needs necessary for each area of operation.

5. Is there a required minimum G&A/Profit in the CBO? Listed in the CBO are zeros.

RESPONSE: No.

6. In 4.4.2.7 the PWS references contractor being responsible to store merchandise moved from the sales area to the RSHA, freezer, or cooler locations. What compensation is associated with the moving of this product from the sales area to the storage areas or is that part of the storing requirement?

RESPONSE: The compensation associated with the moving of this product from the sales area to the storage areas is incorporated in the prospective offeror’s proposed hours on the Direct Labor Summary where the workload is identified.

7. Considering the Dover Commissary is a stand-alone building are there no requirements for cleaning or policing the left and right sides of the building? Also are there no emergency exits that require snow shoveling on the left or right sides of the building?

RESPONSE: Please see Exhibit 4-6-4, page C4-26, of the Performance Work Statement (PWS) for outside area and snow and ice removal information. Exits are located at the rear of the building and the square footage is identified in the PWS.

8. The Dover Commissary has a sales area that has been created from RSHA space. Part of the walls of this area are plastic tarps suspended from the ceiling. Is the maintenance, dusting, cleaning of these tarps part of the high cleaning requirement?

RESPONSE: No.

9. The PWS states the contractor is required to remove expiring items “prior to” the start of the Commissary next business day. Is there a specific timeframe associated with the “prior to” requirement?

OR does the contractor determine the removal process and procedures?

RESPONSE: In Section C4, Paragraph 4.3.3.3.1 it states that the contractor shall remove items from the shelf prior to the start of the first commissary business day based on the date of expiration. This means that product should stay on the shelf up until the date of expiration. Coordination with the Store Director is required to determine if product can be removed before product expiration.
