JUSTIFICATION

FOR OTHER THAN FULL AND OPEN COMPETITION

1. ContractingOffice-StoreServicesSupportDivision,ATTN: LEAS-West,Defense Commissary Agency ,Fort Lee,Virginia

2. Type of Contract Action – This justification i s initiated to modify the existing USAF Academy Commissary contract HDEC08-16-C-0016 to cover a three-month services extension. This will be a firm fixed price extension within the limits and at the rates specified in the contract. The period of performance will be July 1, 2017 through September 30, 2017. The type of funds to be used will be Defense Working Capital Funds.

3. Description of Supplies/Services -The objective of this three month extension is to provide continued services in shelf stocking, receiving/storage/holding area, and custodial for the USAF Academy Commissary at an est imated cost of . The Contractor shall furnish all personnel, supervision, supplies, equipment, tools, materials, and other items and services as necessary to perform the above commissary services.

4. Authority Cited - 10 U.S.C. 2304(c)(1) and FAR 6.302-1– Only One Responsible Source and No Other Supplies and Service will Satisfy Agency Requirements.

5. Reason for Authority cited - Due to time constraints and viability, the requested three month extension is determined to be in the best interest of the Government to allow for a continuation of services with the incumbent contractor. is already performing the services at a satisfactory level and is knowledgeable of all requirements to include existing sufficient staffing, existing negotiated contractual terms and conditions, and performance schedule can continue operations without delays or disruption. The anticipated new contract should be awarded by August 31, 2017. Issuing a new solicitation for this three-month period would present unacceptable delays in fulfilling the Governments requirement for shelf stocking, receiving/storage/holding area, and custodial services at the USAF Academy Commissary.

Disruption of these services would potentially result in a shutdown of the commissary, and thereby negatively impact the service for military members and their families. The time and costs associated with the Government to re-compete a three month effort would not be prudent and would not result in recouped costs over the life of a typical five-year contract. As such, extend ing the base period for an additional three-month period will allow the contracting activity sufficient time to make a subsequent award determination and eventual award.

6. Efforts to Obtain Competition -The current contract HDEC08-l6-C-0016 was competitively awarded to a Service Disabled Veteran-Owned small business concern, to perform shelf stocking, receiving/storage/holding area, and custodial operations. A new solicitation was issued as a competitive 100% Service Disabled Veteran-Owned set-aside. The requirement to post to theFederal Business Opportunities website (www.fbo.gov) for the proposed action under DFARS PGI 206.302-1 has been waived by the Head of the Contracting Activity (HCA) designee (see attached waiver).

7. Fair and Reasonable Cost Determination - The cost for the three-month extension will be at the current contract rates, which were determined fair and reasonable at time of initial award.

8. Market Research – Market research was conducted under the pending new award and

Control Number: HDEC08-17-36 reflected that several of Service Disabled Veteran-Owned Small Businesses were interested in a five year effort.

9. Other Factors: NA.

10. Interested Sources-The Government has not received any inquiries from any interested sources for the three month extension.

11. Action to Increase/Foster Competition - The new award will be a 100% Service Disabled Veteran-Owned set-aside and the Government expects sufficient competition on future procurements.

Technical/Requirements Certification - "I certify that the supporting data under my cognizance included inthis justification is accurate and complete to the best of my knowledge and belief."
