SECTION SF 30 BLOCK 14 CONTINUATION PAGE

The following items are applicable to this modification:

QUESTION #1: In the revised CBA Cost Breakout included with Amendment 0002, the calculation for pension does not include holidays. Is it your intention and that of the CBA that employees are not paid pension on holidays?

ANSWER: Holidays will not be included in the CBA Cost Breakout at this time. On page 18 of the CBA the Pension Fund Contribution Rate in paragraph B states, “… all paid hours including sick and vacation” unlike the Health and Welfare Contribution Rate in paragraph A that states,“… compensated hours including holiday, vacation, and sick leave.” Since there is a difference in the language, DeCA interprets that to mean that holidays are not included in the pension fund calculation. If the parties to the CBA advise otherwise the change can be made to the CBA Cost Breakout at a later time.

QUESTION #2: The calculations in the revised CBA Cost Breakout appear to be wrong in more than one place. The calculation for the pension for the Stocker/FDS loaded hourly rate should be the following: =C15+((D51*8)/2080). The same should apply to the other loaded rate calculations, please clarify this calculation.

ANSWER: The CBA Cost Breakout has been amended to reflect the appropriate calculations in cell “L20” to ensure the pension for the loaded hourly rates is calculated correctly in all loaded wage rate categories.

QUESTION #3: In reference to the Collective Bargaining Agreement (CBA) issued on November 9th, we would like to request that you provide a seniority list of the workforce, for we view it as material to the CBA.

ANSWER: FAR 22.1020 entitled Seniority List states, “If a contract is performed at a Federal facility where employees may be hired/retained by a succeeding contractor, the incumbent prime contractor is required to furnish a certified list of all service employees on the contractor's or subcontractor's payroll during the last month of the contract, together with anniversary dates of employment, to the contracting officer no later than 10 days before contract completion. (See paragraph (n) of the clause at 52.222-41, Service Contract Act of 1965.) At the commencement of the succeeding contract, the contracting officer shall provide a copy of the list to the successor contractor for determining employee eligibility for vacation or other fringe benefits which are based upon length of service, including service with predecessor contractors if such benefit is required by an applicable wage determination.”
