ADDENDUM 52.212-2
52.212-2 EVALUATION--COMMERCIAL ITEMS (JAN 1999)
(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors will be used to evaluate offers:
1. Product Information: Submit descriptive literature, a matrix, or other information that demonstrates that the proposed product meets all the mandatory salient characteristics of each product specified.
2. Past Performance References: Submit at least 3 references; companies that you have conducted business with for delivery of products that are similar to those listed in this solicitation. Provide the following information for each reference:
(1) Delivery Period
(2) Company Name and Address
(3) Point of Contact Name and Title
(4) Phone Number
(5) Facsimile Number
(6) E-Mail Address
(7) Description of Product Delivered
The references will be asked to provide information on your company’s past performance with regard to timeliness of delivery, quality of products, and business relations. The contracting officer will contact the references provided to obtain this information. Any other past performance information available to the Contracting Officer will also be considered. Please fax list of references to Senta Hanson (804) 734-8269 or email to senta.hanson@deca.mil
3. Price:
(b) Award will be made to the lowest-priced technically acceptable offeror. Offerors will be determined to be technically acceptable if their proposed product is rated acceptable, and by receiving a satisfactory overall rating in the past performance evaluation factor. For the proposed product to be acceptable, the offeror's product must meet or exceed the stated mandatory salient characteristics. Total evaluated price will be determined per group by applying each offeror’s unit price to the estimated quantity per sub-CLIN, and totaling all sub-CLINs for the base and option years for a total evaluated price
(c) The evaluation of past performance will be an assessment based on a consideration of all relevant facts and circumstances. It will not be based on absolute standards of acceptable performance, but an offeror's overall past performance history. The Government is seeking to determine whether the offeror has consistently demonstrated a genuine concern for customer satisfaction, and timely delivery of quality goods. This determination is a matter of judgment.
(d) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
(e) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award or date of award (See Addendum to 52.212-4 regarding EDA access of orders).
ADDENDUM 52.212-4
ADDENDUM TO FAR 52.212-4
CONTRACT TERMS AND CONDITIONS—COMMERCIAL ITEMS
Provide products described in the Schedule of Supplies/Services to Defense
Commissary Agency Commissary Agency (DECA) stores.
TYPE OF CONTRACT): Indefinite Quantity, Indefinite Delivery (IDIQ) type with firm-fixed prices and with a guaranteed minimum purchase quantity for each line item.
PERIOD OF PERFORMANCE: Base: 12-month period beginning from date of award. There will be four one-year option periods.
ORDERING INFORMATION:
a. The contracting office will place orders by providing the contractor written delivery orders via the Department of Defense Electronic Data Access website at: http://eda.ogden.disa.mil/. The contractor must complete the on-line registration that is available at that address in order to have access to retrieve documents displayed there.
b. The minimum quantities that the government guarantees will be purchased per year under the contract and the maximum quantities that can be purchased per year are listed at the end of the Schedule of Supplies/Services. The quantity stated within each CLIN, base or option, is the maximum that can be ordered for that item, per year; that maximum quantity can only be changed by contract modification.
c. DECA, at its option, may choose to place consolidated orders for more than one store location. Consolidated orders may be issued for known requirements for up to a 6-month period; DECA may choose to consolidate for shorter periods, at its option. Delivery order CLINs for consolidated orders will contain the total quantity of each item being ordered. An attached spreadsheet will breakdown the order by delivery location. The spreadsheet will contain: Store name, CLIN number, quantity ordered, and requested delivery date.
d. In addition to consolidated orders, DECA may place individual delivery orders for items required outside the periods covered by consolidated orders.
DELIVERY/SHIPPING INSTRUCTIONS: Each delivery order will contain the delivery location and any other necessary delivery/shipping instructions. The contractor can find the delivery address and points of contact information for each store at www.commisssaries.com.
Required delivery is 30 days after receipt of order (ARO). The contractor may propose an alternate delivery schedule. _________Contractor accepts 30 days ARO delivery. _________Contractor proposes _____ days ARO delivery.
PAYMENT INFORMATION: The payment procedures stated in paragraph a., below, will apply at the time of contract startup; however, it is likely that in order to comply with advances in electronic commerce procedures, including Wide Area Work Flow (WAWF), the method for payment and the paying office will change during the contract performance (see paragraph b., below).
a. When the contract commences payments will be made in accordance with DFARS 252.232-7000, Mandatory Payment by Government-Wide Purchase Card (GPC) (Dec 2006). A separate invoice for each delivery will be mailed, faxed, or preferably, sent as an attachment to an e-mail, to the GPC holder named in Block 18a of each delivery order. The GPC holder will determine if the charge is justified and if so, will provide the contractor written-pre-authorization to charge the GPC. The contractor shall not make a charge without first receiving the written pre-authorization from the cardholder.
b. Clause 252.232-7003, entitled Electronic Submission of Payment Requests (May 2006), is included in this contract. Procedures for payment outlined in paragraph a., above, are intended to comply with paragraph (c) of that clause. Paragraph (c) states that if either the contractor or the government does not have the capability to process payments electronically, an alternate method is to be used; paragraph a., above, is the interim alternate method for payments under this contract. If during the period of performance of this contract, the Contracting Officer determines that DECA (including stores) and the contractor have mutual capability to comply with new electronic commerce procedures, including WAWF, the Contracting Officer may require the contractor to convert to the electronic procedures; the Contractor will be provided a 30 day advance notice before the effective date for compliance. Conversion will be at no additional cost to the government.
