JUSTIFICATION AND APPROVAL

FOR OTHER THAN FULL AND OPEN COMPETITION

1. Contracting Office: Defense Commissary Agency (DeCA), Resale Contracting Directorate, (LEARS), 1300 E Avenue, Fort Lee, Virginia 23801-1800.

2. Type of Contract Action: Modification of contract HDEC02-04-D-0001 with Military Deli Bakery Services (MDBS). The proposed modification will extend the period of performance six (6) months from December 1, 2015 to May 31, 2016. The contract type is a requirements type. The Resale Stock Fund Activity, Defense-Wide Working Capital Fund provides funding.

3. Description of Supplies/Services: This action will provide uninterrupted services of delicatessen and bakery operations at commissaries located in 41 commissary store locations within the DeCA West Area to include Alaska and Hawaii. The proposed six (6) month extension would increase the estimated contract value by $12,088,586.22 for a new total estimated contract amount of $89,017,262.93 and extend the contract performance period until May 31, 2016.

4. Authority Cited: 10 U.S.C. §2304(c)(1), in accordance with FAR 6.302-1, Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.

5. Reason for Authority Cited:

Contract HDEC02-04-D-0001 expires on November 30, 2015. The projected acquisition milestones under Justification and Approval (J&A) HDEC02-12-70, Amendment 0004, were delayed due to the departure of the Contracting Officer for this requirement and the subsequent hiring of a new Contracting Officer. The new Contracting Officer was then required to focus attention on the completion of another priority solicitation and contract action which occurred within the Resale Services Support Branch. These actions include: the requirement to procure 72 pieces of equipment for 32 stores by the fiscal year end, and the cancellation of acquisition HDEC02-14-R-0001 for delicatessen and bakery operations for 17 locations within the DeCA East and Central Areas. This resulted in the re-procurement of the requirement under solicitation number HDEC02-16-R-0002.

The additional six (6) months are needed to allow sufficient time to complete the technical evaluation, discussions, Agency level contract reviews, senior management briefings/approvals, and allowance for a thirty day startup period for the contract awardee(s). The startup period allows for the awardee(s) to transition into its automated systems and to ensure the systems are functioning properly. The projected award date is April 29, 2016 with a performance start date of June 1, 2016.

In the absence of a contract extension, the availability of delicatessen and bakery products will cease in the commissaries covered under this contract and the service member will be denied their commissary benefit provided to them by statute under 10 USC §2481 and 10 USC §2484. The commissary benefit is a cornerstone of the military quality of life and it is essential that DeCA provides a fully operational commissary. Loss of these products would negatively impact DeCA’s mission to provide for military members and their families, especially during the upcoming holiday season.

6. Efforts to Obtain Competition: A sources sought notification was not issued for this requirement due to the fact no contractor would be capable or willing to provide service for only a six month period. In order to ensure continuity of service, the requirement to post a sources sought notice is waived by the Head of the Contracting Activity as allowed by DFARS/PGI 206.302-1.

This justification and approval (J&A) will be made available for public inspection, after the completion of the contract modification, in accordance with FAR 6.305.

7. Fair and Reasonable Cost Determination: No changes from the initial J&A.

8. Market Research and Interested Sources: No changes from the initial J&A.

9. Actions to Increase/Foster Competition: No changes from the initial J&A.

10. Other Factors: Not applicable.

APPROVAL

Based on the above mentioned justification, I hereby approve the six (6) month extension from December 1, 2015 until May 31, 2016, for the continuation of delicatessen and bakery operations for forty-one (41) commissary locations in DeCA West Area to include Alaska and Hawaii covered under contract HDEC02-04-D-0001, on an other than full and open competition basis pursuant to the authority of 10 U.S.C. §2304(c)(1), provided funds are available, or will be available, and provided that the services and products herein described have otherwise been authorized for acquisition.
