JUSTIFICATION AND APPROVAL
FOR OTHER THAN FULL AND OPEN COMPETITION
1. Contracting Office: Defense Commissary Agency (DeCA), Resale Contracting Division, (LEARS), 1300 E Avenue, Fort Lee, Virginia 23801-1800.
2. Type of Contract Action: Modification of contract HDEC02-04-D-0001 with Military Deli Bakery Services (MDBS). The proposed modification will extend the period of performance three
(3) months from June 1, 2016 to August 31, 2016. The contract type is a requirements type. The Resale Stock Fund Activity, Defense-Wide Working Capital Fund provides funding.
3. Description of Supplies/Services: This action will provide uninterrupted services of delicatessen and bakery operations at commissaries located in forty-one (41) commissary store locations within the DeCA West Area to include Alaska and Hawaii. The proposed three (3) month extension would increase the estimated contract value by $6,044,293.11 for a new total estimated contract amount of $95,061,555.10 and extend the contract performance period through August 31, 2016.
4. Authority Cited: 10 U.S.C. §2304(c)(1), in accordance with FAR 6.302-1, Only One Responsible Source and no other supplies or services will satisfy Agency requirements.
5. Reason for Authority Cited:
Contract HDEC02-04-D-0001 expires on May 31, 2016. Inclement weather experienced during the convening of the evaluation board delayed the evaluation process. The customer’s commitment to the SSEB was redirected due to the transition in work assignments and unscheduled mandatory training for a key member of the board, which further delayed the evaluation process. Additional rounds of discussions were required prior to final proposal revisions. During final proposal revisions the advisement of legal counsel was required regarding timeliness of information received, which resulted in further delays in the evaluation process. After review of the technical narratives received by the evaluation board, additional information and clarifications were required. An additional three
(3) months is required to complete, Agency level contract reviews, to conduct senior management briefings/approvals, execute the contract award(s) and allow for a sixty-day startup period for the contract awardee(s). The projected contract award date is June 30, 2016 with a performance start date of September 1, 2016.
In the absence of a contract extension, commissaries covered under this contract will be without deli/bakery operations and the service members serviced by these commissaries will be denied their full commissary benefit provided to them by statute under 10 U.S.C §2481 and 10 U.S.C. §2484. The commissary benefit is the cornerstone of the military quality of life and it is essential that DeCA provides a fully operational commissary. Loss of these products would negatively impact DeCA’s mission to provide for the military and their families.
MDBS has been performing this contract successfully providing products that conform to the contractual requirements and terms and conditions. They have systems in place to continue uninterrupted service.
MDBS is the only known source available that has the necessary infrastructure established to provide uninterrupted deli/bakery operations in accordance with federal, state and agency requirements to the DeCA commissaries given the time constraints involved for this extension period.
