JUSTIFICATION REVIEW DOCUMENT
Description of Acquisition: Modification to extend the contract performance period for HDEC02-08-D-0001, with Raymond Express International to provide the uninterrupted delivery of fresh fruits and vegetables to 29 commissary store locations assigned to the Defense Commissary Agency.

JUSTIFICATION AND APPROVAL
FOR OTHER THAN FULL AND OPEN COMPETITION
1. Contracting Office: Defense Commissary Agency (DeCA), Resale Contracting
Directorate (LEARC), 1300 E. Avenue, Fort Lee, Virginia 23801-1800.
2. Type of Contract Action: Modification of contract HDEC02-08-D-0001 with Raymond
Express International. The proposed modification will extend the period of performance three (3) months from April 1, 2015 to June 30, 2015. The contract type is a requirements contract. The Resale Stock Fund Activity, Defense-Wide Working Capital Fund provides funding.
3. Description of Supplies/Services: This action will provide fresh fruits and vegetables for resale in 29 commissary store locations within the West Area of the Defense Commissary Agency (DeCA). The proposed three (3) month modification would increase the estimated contract value by $8,645,163 for a new total estimated contract amount of $77,339,082 and extend the contract performance period until June 30, 2015.
4. Authority Cited: 10 U.S.C. §2304(c)(1), in accordance with FAR 6.302-1(a)(2), only one responsible source and no other supplies and services will satisfy Agency requirements.
5. Reason for Authority Cited:
Contract HDEC02-08-D-0001 expires on March 31, 2015. Only the incumbent contractor can provide full, uninterrupted service to the commissaries until the new award is in place. The additional three months is needed to allow sufficient time for completion of Agency level contract reviews, to conduct senior management briefings/approvals, and to allow for a startup period for the contract awardee. The projected award date is April 1, 2015 with a performance start date of July 1, 2015.
In the absence of a contract extension, commissaries covered under this contract will be without fresh fruits and vegetables and the service members serviced by these commissaries will be denied their full commissary benefit provided to them by statue under 10 USC §2481 and 10 USC §2484. The commissary benefit is the cornerstone of the military quality of life and it is essential that DeCA provides a fully operational commissary. Loss of these products would negatively impact DeCA’s mission to provide for the military and their families.
Raymond Express International has been performing this contract successfully providing products that conform to the contractual requirements and terms and conditions. They have the systems in place to continue uninterrupted service. Raymond Express International is the only source available that has the necessary infrastructure established to provide uninterrupted service in accordance with federal, state and agency requirements to the DeCA commissaries for this extension period.
6. Efforts to Obtain Competition: Solicitation HDEC09-14-R-0002 was issued on February 3, 2014 on a full and open competitive basis, identifying the Government’s intention to procure a full line of fresh fruits and vegetables to the 29 commissary store locations covered under the subject contract. In order to further foster competition, the solicitation was published in FedBizOpps on March 14, 2014. This justification will be made available for public inspection, after the completion of the contract modification to extend contract performance with the incumbent contractor, in accordance with FAR 6.305.
7. Fair and Reasonable Cost Determination and Contracting Officer Certification:
The Contracting Officer has determined that the anticipated cost to the Government for the contract modification for the three (3) months extension will be fair and reasonable based on cost and/or price analysis of the contractor’s proposal. Based on the percentage of savings that has been achieved over the current contract performance period, the incumbent contractor has demonstrated the ability to meet the minimum percentage of patron savings required under the proposed contract performance extension. The incumbent contractor has agreed to continue meeting the minimum percentage of patron savings required under the proposed contract performance extension.
