Acquisition ID#: _36C244-24-AP-1473_______
DEPARTMENT OF VETERANS AFFAIRS
Justification and Approval (J&A) For
Other Than Full and Open Competition (>SAT)
Acquisition Plan Action ID: 36C244-24-AP-1473 Healthcare for Homeless Veterans (HCHV) Coatesville VA Medical Center
1. Contracting Activity: Department of Veterans Affairs, VISN 04, Coatesville VA Medical
Center (CVAMC) HealthCare for Homeless Veterans Program
2. Nature and/or Description of the Action Being Processed: The purpose of this contract is to award to the Incumbent, Fresh Start is to provide care, and rehabilitation services to Veterans experiencing homelessness, including Veterans diagnosed with severe mental illness and substance abuse disorders.
This contract is for a 12-month IDIQ for the estimated amount of $1,566,480.00. The current contract ends 1/31/2024 and sole source bridge contract is needed to avoid interruption in services. A 10-year IDIQ was awarded but is anticipated to be terminated for breach of contract. New contract is anticipated to be solicited as soon as possible.
3. Description of Supplies/Services Required to Meet the Agency’s Needs: The VA has been providing direct and specialized services for homeless Veterans for nearly 25 years.
The Secretary of the VA has set a zero-tolerance policy for homelessness within the Veteran population. As part of the plan to end homelessness among Veterans announced in late 2009, the Veterans Health Administration (VHA) has been increasing both capacity of existing programs and services offered to program participants. The plan calls for utilizing new models of care not previously offered by VA.
The Coatesville VAMC established Independence Hall through Health Care for Homeless Veterans (HCHV) in July of 2010. Independence Hall is a 40-bed transitional housing program for homeless veterans. It serves two distinct populations: Homeless Veterans with a serious mental illness (SMI) and substance abuse disorders, and homeless Veterans in need of emergency housing in flex beds, which are time limited.
It is critical that these services continue without interruption while the new long-term contract is solicited and awarded. Stopping these services without a replacement would severely affect the mental health and situation of veterans currently residing in Independence Hall.
The new long-term contract will be providing the same services currently provided but they will be transitioning to an offsite location provided and operated by the new contractor. The transition time from onsite services to offsite services is the driving factor for awarding this sole source bridge contract for a 12-month period.
4. Statutory Authority Permitting Other than Full and Open Competition: .
( ) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements per 41 USC §3304(a)(1) as implemented by FAR 6.302-1;
(x) (2) Unusual and Compelling Urgency per 41 USC §3304(a)(2) as implemented by FAR 6.302-2;
( ) (3) Industrial Mobilization, Engineering, Developmental or Research Capability or Expert Services per 41 USC §3304(a)(3) as implemented by FAR 6.302-3;
( ) (4) International Agreement per 41 USC §3304(a)(4) as implemented by FAR 6.302-4
( ) (5) Authorized or Required by Statute per 41 USC §3304(a)(5) as implemented by FAR 6.302-5;
( ) (6) National Security per 41 USC §3304(a)(6) as implemented by FAR 6.302-6;
( ) (7) Public Interest per 41 USC §3304(a)(7) as implemented by FAR 6.302-7;
5. Demonstration that the Contractor’s Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority):
The 12-month contract will be needed to avoid lapse in coverage. A cure notice has been sent to the contractor that was awarded the 10-year IDIQ and termination is anticipated for breach of contract. The incumbent contractor, Fresh Start, has been providing these services for the last 5 years and capable and willing to continue performing these services.
6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: In accordance with FAR 6.302-2 Unusual and compelling urgency, it would not be conducive to interrupt services and switch to another vendor prior to the new long-term contract be re-solicited. Market research was conducted on the Fresh Start for performance and there is no reason to believe that they will not be able to continue to provide satisfactory or higher services.
7. Determination by the CO that the Anticipated Cost to the Government will be Fair and
Reasonable: The Fresh Start had slightly increased pricing from the previous contract ordering period that will expire 1/31/2024. The current rate is $102 per Veteran per day on the current contract 36C24423D0070. The new 12-month contract is priced at $107 per Veteran per day of occupied bed. It is determined fair and reasonable based off the average census, rise in salaries, and rise in prices over the last few years.
8. Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: Due to the urgency of award and a need for continued services without interruption, extensive market research was not conducted.
The basis for a sole source contract to the existing contractor in this situation is to continue to provide services until the new long-term contractor can be solicited and awarded.
9. Any Other Facts Supporting the Use of Other than Full and Open Competition: N/A
10. Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: N/A
11. A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: A long term contract will be solicited for competition since the current 10-year IDIQ is moving toward termination. This 12-month contract is to continue services to avoid a lapse in Veteran housing.
12. Requirements Certification: I certify that the requirement outlined in this justification is a Bona Fide Need of the Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge and belief.
