About this file
This justification and approval document outlines a planned sole source award for initial consumable supply purchases to support new semi-automatic packager units at four Department of Veterans Affairs mail outpatient pharmacy sites. The key details include:
-
The requirement is for brand-specific mailer bags and printer ribbons from Sharp/Pregis and PAC Machinery to match equipment installed between August and October 2023. Estimated costs total $1,505,064.06 for the six-month supply across Chelmsford, Dallas, Hines, and Murfreesboro sites.
-
A justification for other than full and open competition is provided under authority that only one responsible source exists to meet the agency's need for brand-specific products. Market research found only one authorized distributor for each manufacturer.
-
The planned sole-source awards are identified as serving an initial need with opportunity for future competitive procurements once additional product options can be evaluated. Compliance with Buy American statutes and consideration for small business opportunities are also discussed.

( ) (2) Unusual and Compelling Urgency per 41 USC §3304(a)(2) as implemented by FAR 6.302 2;

5. Demonstration that the Contractor’s Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority):

Sharp Auto Bagger Station Clamco Auto Bagger Station
OFOC SOP Revision 11 Page 3 of 5 Original Date: 03/22/11 Revision 11 Date: 02/11/2021
36C77023AP0511
Chelmsford has both types of Auto Baggers, where Dallas, Hines, and Murfreesboro only has the Clamco Auto Baggers on site. This requirement represents an initial supply to cover only the first six months of operation after equipment has been installed s
6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable:
As there are two manufacturers, Sharp/Pregis a Large Business and PAC Machinery a small business Sources Sought was issued to both SAM.gov under 36C77023Q0303 and GSA under RFQ1631862 on June 2nd 2023 citing the Brand Specific need for the following consumable supplies to reach as many vendors as possible
7. Determination by the CO that the Anticipated Cost to the Government will be Fair and Reasonable:
There is historical data specifically for the Bags from purchases the Charleston CMOP has made over the past two years. No historical data exists for the Ribbons.
The IGCE is based on recent data provided by the contractor to the facility that is installing the Semi Auto Packers, as they were needed to perform the Factory Acceptance Test(FAT) at the Factory.
o The bags and ribbons were purchased by the vendor installing the new “Semi Auto Packers” to perform “Factory Acceptance Testing(FAT).
Requirement will also be competed “Unrestricted”
8. Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted:
Market Research was conducted through VETCERT, GSA, and SAM.gov citing the “Brand Specific” need to procure mailer bags and printer ribbons from the two manufacturers.
A total of 15 vendors responded to both Sources Sought Notices
36C77023AP0511
OFOC SOP Revision 11 Page 4 of 5 Original Date: 03/22/11 Revision 11 Date: 02/11/2021 ased on historical data there are two known “Authorized Distributors for SHARP/Pregis:
NGA3 Services LLC – A SD/VOSB – Contract 36C77023P0240 Tesnsion Envelope CORP. A Large Business – Contract 36C77022P0111
Based on the Non Manufacturer Rule, NAICs Code 326111 has been waived but only for the “Bags” not for the ribbons by the SBA.
o The rule of two cannot be met to set this aside for small businsesses since there is only one small business Authorized Distributor for either Brand Name product.
o Also the limitations of subcontracting can not be met to support a small business set aside as SHARP is considered a Large Business manufacturer.
To increase competition, the requirement will be solicited Unrestricted citing the potential for a multiple award, providing vendors to quote for both manufacturers or just one.
I the BAA, all items are made in America by both manufacturers.
Any Other Facts Supporting the Use of Other than Full and Open Competition:
This will be based on a name brand justification so competition will be limited to those that carry the brand of bags and ribbons needed.
Listing of Sources that Expressed, in Writing, an Interest in the Acquisition:
M Pak Inc. A Women Owned small business is an Authorized Distributor of the PAC Machinery bag and ribbons NGA3 Services LLC –
Authorized istributor for SHARP bags and ribbons Tension Envelope Corp. A Large Business –
Authorized Distributor of SHARP bags and ribbons
A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required:
As noted, this requirement only represents the initial 6 months supply of consumables to allow addit ional time for products to be vetted toward meeting the needs long term.

IX. Other Considerations
Identify other considerations gathered from market research, e.g., opportunities for small business participation o Any Vendor other than the manufacturer, must provide a letter from the manufacturer showing they are an “Authorized Distributor”
Discuss qualifying factors, including such issues as past performance, references, product testing or evaluation, customer satisfaction, warranties, and quality problems o This is a Brand Specific Need because the product was tested at the
Factory to ensure it could meet production needs Describe consideration of green (sustainable products and services https://sftool.gov/greenprocurement and http://www.gsa.gov/portal/content/105365. Include discussion of energy efficiency standards of market products, if applicable o Recyclable content will be noted in contract.
o
Discuss consideration to Buy American Statute. Does Buy American, Trade Agreement or an Exception to Buy American apply (FAR Part 25). Are there domestic end products available for this acquisition?
o BAA will apply
VHAPM Part 810 Market Research SOP Page 12 of 12 Revision: 08, Effective Date: 04/27/21 o Both manufacturers have confirmed that product is produced in America.
X. Market Analysis Summary (DO NOT RANK)
Provide market research conclusions and recommendations o There are small business “Authorized Distributors” but the rule of two cannot be met as there is only one Authorized Distributor for each manufactured product.
o Limitations on Subcontracting cannot be met to set this aside as the product will be provided by a large business
Document the decision and rationale to satisfy the agency’s need with a commercial item/service, if market research so warrants o Items are commercially available
Document the decision and rationale if the agency’s need cannot be satisfied with a commercial item/service o N/A Provide supporting documents, as appropriate
XI. DETERMINATION:
This is a Brand Specific Need. There are two manufactures of the products needed.
Based on the market research conducted there is only one VIP verified and capable SDVOSBs capable of performing the requirement. In addition, only one small business in any of the other targeted socio-economic groups appeared to qualify as an “Authorized Distributor” for some of the product needed as well. However a set-aside is not feasible as the rule of two cannot be met to set the requirement aside as:
There is only one small business that was identified to provide product from either of the manufacturers.
The limitations on subcontracting cannot be met to set the requirement aside
Therefore, it is anticipated that all sources (large and small businesses) will be solicited for this requirement using competitive procedures with the opportunity for multiple awards. This market research information is not more than 12 months old.
