About this file
This document is a justification and approval for other than full and open competition for an emergency sole source contract awarded by the Department of Veterans Affairs. The contract is for $2,488,000 to repair process piping in steam tunnel H at the Dayton VA Medical Center. The piping system collapsed and requires urgent replacement of high pressure supply and return piping, concrete supports, insulation and other repairs. Buckeye Industrial Piping, LLC was awarded the contract on January 19, 2024 as the incumbent contractor already mobilized on site and knowledgeable about the steam system due to a previous emergency project. The justification cites urgent safety and operational needs to restore the medical center's redundant steam system before further failure could occur.

DEPARTMENT OF VETERANS AFFAIRS
Justification and Approval (J&A) For
Other Than Full and Open Competition (>SAT)
Acquisition Plan Action ID: 36C250-24-AP-0771
Contracting Activity:
Department of Veterans Affairs, VISN 10, Dayton VA Medical Center; 4100 West Third Street, Dayton, OH 45428-9000, Network Contracting Office (NCO) 10 – 552-24-2-6976-0002
Nature and/or Description of the Action Being Processed:
The proposed action is for an EMERGENCY sole source contract for “552-24-502 Repair Steam Tunnel H (Emergency)” at the VAMC in Dayton, OH. The contract will be for a new firm, fixed price with an IGCE of $2, , .
Description of Supplies/Services Required to Meet the Agency’s Needs:
The process piping system has broken in steam tunnel “H” which is part of the redundant steam line located on the opposite side of the VAMC campus from the earlier emergency repair parking lot B128 project. During the all of 202 the secondary loop of the steam tunnel “H” was noticed to have collapsed during an investigation at the Dayton VAMC campus. Investigation of confined space within the steam tunnel found that all of the active steam process pipes, ric-wil, mounting brackets and areas of the tunnel structure are long past their useful life cycle and are badly deteriorating. This emergency action is to remove and replace High Pressure Supply (HPS) and High Pressure Return (HPR) process piping to include the concrete pads/hangars/rollers and insulate the piping located in steam tunnel “H”.
This work is critical to ensure the Medical Center is fully operational and reduce the life safety and financial risk. VHA Directive 1810 speaks to having redundancy in the boiler plant and failure to have the redundancy may equate to a medical center unoperational. Without the redundant piping, the medical center does not have a backup system to heat the campus should the main steam tunnel fail.
Statutory Authority Permitting Other than Full and Open Competition:
41 USC 3304(a)(2), as implemented by FAR 6.302-2 Unusual and Compelling Urgency. Any delay in the award of a contract would result in serious injury, financial or other, to the Government, veterans, and staff at the facility.
Demonstration that the Contractor’s Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): The time involved in bidding and awarding the project would delay the completion of the work needed now and impact safety and heating operations on the Dayton VA Medical Center (VAMC).
This is an emergency requirement due to the safety of employees, patients and visitors at the Dayton VAMC. This work is critical to be completed now to ensure the Medical Center is fully operational. Buckeye Industrial Piping, LLC. (Buckeye) specializes in process piping, which is the exact type of work required here. This project requires urgent repairs to the process piping system in order to transport steam to the medical center.

Buckeye is already mobilized on station due to the emergency repair parking lot B128 project and is prepared to provide immediate service. They are already familiar with the site and with the steam system. VA would save critical time contracting directly with Buckeye as they would not need to mobilize like other firms may. Without immediate repair, the Government will be harmed financially and life safety would be impacted due to the closure of the medical center.
Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable:
the CO that the Anticipated Cost to the Government will be Fair and Reasonable:
The Government will evaluate prices proposed against the Independent Government Cost Estimate (IGCE) and similar projects awarded recently to ensure the cost is fair and reasonable to the Government.
Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted:
VA recently procured services similar in nature to the work required with this emergent need (September 2023). With that procurement, VA had considerable difficulty locating SD/ VOSB firms and to satisfy the Government’s requirements. After exhausting other available options, VA finally contracted with Buckeye. Buckeye is uniquely positioned to be onsite immediately with the requisite knowledge, skills, resources and ability (e.g. to source the required materials, to secure qualified labor and equipment, etc.) to quickly to complete this project. Every day passes increases the risk of catastrophic failure of the steam system. Due to the emergent nature of this project, no additional market research was conducted.
Any Other Facts Supporting the Use of Other than Full and Open Competition: Failure to this may result in the clos
. Buckeye Industrical Piping, LLC. possesses the specialized knowledge, skills and abilities to perform this work quickly and efficiently—at a fair and reasonable price to the Government. Buckeye has the capacity and is ready and able to begin work as soon as a contract is awarded and NTP issued.
