JUSTIFICATION FOR AN EXCEPTION TO FAIR OPPORTUNITY

Number: JA 14-042

Upon the basis of the following justification, I, as the Procuring Activity Competition Advocate, hereby approve this exception to fair opportunity pursuant to the authority of FAR 16.505(b)(2)(i)(C).

“The order must be issued on a sole-source basis in the i nterest of economy and efficiency because it is a logical follow-on to an order already issued under the contract, provided that all awardees were given a fa i r opportun ity to be considered for the origina l order.”·

2. NATURE/DESCRIPTION OF A CTION(S):

This Justificat ion and Approval (J&A) is to award a follow-on task order under the GSA Alliant Governmentwide Acquisition Contract (GWAC) as an exception to fair opportunity to the incumbent , ManTech Advanced Systems International , Inc. (MASI), 100 N E Loop 410, Suite 450, San Antonio, TX 78216-4726. This proposed contract action is to complete the development of the U nified Cyber Analytic Portal (UCAP)

3. DESCRIPTION OF SUPPLIES/SERVICES :

This contract action is to provide development, test, and deployment services to mature the UCAP technology.

4. SUPPORTING RATIONALE, INCLUDING A DEMONSTRATION THAT THE

PROPOSED CONTRACTOR'S UNIQUE QUALIFICATIONS OR THE NATURE OF

THE ACQUISITION REQUIRES USE OF AN EXCEPTION TO FAIR OPPORTUNITY:

(a) Exception to Fair Opportunity.

The order must be issued on a sole-source basis i n the interest of economy and efficiency because it is a logical follow-on to an order already issued under the GSA Alliant GWAC, and all awardees were given a fair opportunity to be considered for the original order. This RDT&E effort made substantial progress under the initial order; however, more time is required to complete this RDT&E effort,

unacceptable delays to UCAP will also be multi ple agencies.

Any impact or gateway that affects

(c) Justification:

( 1 ) Minimum Government requi rements.

The mi nimum requirements include but are not l imited to development, test, and deployment activities to evolve the current UCAP capability

(2) Proposed sole source contractor.

MASI is capable of performing the tasks in the interest of economy and efftciency logical follow-on to an order already issued under their GSA Alliant.

Unified Cyber Analysis Portal-JA 14-042

A sole source award to MASI allows the Government to support this requirement with less cost and delay due to the unique nature of the current RDT&E effort. MASI engineers are intimately familiar with the UCAP appl ication which is based on thei r custom-bui lt architecture. Changing the contractor at this point would risk significant modification of the systems securi ty package, which wou ld include but not be l imited to the certification and accreditation package.

Not award ing this follow-on to MASI wou ld result i n a duplication of cost, due to the time required to transition the new contractor to an acceptable level of technica l experti se. The additional cost would be coupled with an u nacceptable delay of up to six months

(3) Discussion regard i ng cause of the sole source situat ion.

The cause of the sole source situation was unplanned i n - s c o p e changes that have increased the cost and schedule of this RDT&E effort.

(4) Demonstration of unique source.

MASI is a unique source because thei r engineers developed UCAP using a -Application Programming Interface (API) approach that allows UCAP to build upon decades of knowledge from MASI while also modularly integrating best of breed com ponents. As the developers of UCAP, MASI has the requisite, in-house engineering and design knowledge of the system and its intricacies.

(5) Procurement d iscussion:

Services for the UCAP development was previously acquired by the USAF. MASI was the contractor who worked on this initiative. The contract was issued to MASI in 2011. The task order Period of Performance expired 31 December 2013. The function was transferred to USCYBERCOM with additional in-scope changes that require additional work that is a logical follow-on to the previously acqu ired development support.

(6) Impact:

Page 3 of 5 Pages

Unified Cyber Analysis Portal -JA 14-042

Award to a differen t contractor would resul t i n substantial dupl ication of cost to government that i s not expected to be recovered through com petition.

This estimate combines a mix of historical data covering support work done to get new contractor up to speed with expedited ramp up cost to meet the dead lines for FOC

Attempting to complete the work in-house would incur additional engineering and implementation cost to reconstitute the contractor’s capabilities. The Government would incur cost and time delays for transfer of equipment, training and certification of personnel , and purchasing or licensing of the requi red software.

5. COST/PRICE FAIR AND REASONABLE DETERMINATION:

The Contracting Officer will determine whether the price is fa i r and reasonable using cost/price analysis and com parison to the IGCE.

6. MARKET RESEARCH:

7. ANY OTHER SUPPORTING FACTS: N / A

8. ACTIONS THE AG ENCY MAY TAKE TO REMOVE OR OVERCOME BARR IERS

THAT LED TO THE EXCEPTION TO FAIR OPPORTUNITY:

This is not applicable because of the basis of the authorization for this sole source order.

Situations of this nature are driven by unique circumstances that are recognized by statute and regulation as sufficient justification for a sole source order.

9. REFERENCE TO THE APPROVED ACQUISITION PLAN (AP):

A Stream l ined Acquisition Plan was accompl ished.
