Limited Sources/Sole Source Rationale
1. REQUIRING AGENCY AND CONTRACTING OFFICE:
Requiring Agency:
Army Resilience Directorate (ARD) ATTN: Pailin Jogthong 2530 Crystal Drive Arlington, VA, 22202
Contracting Office:
Defense Information Systems Agency/Defense Information Technology Contracting Organization/PL83 2300 East Drive, Building 3600 Scott Air Force Base, Illinois 62225-5406
2. Procurement Title: Scantron Insight Scanners and ScanTools Prisma Software
Funding Document Number: 11537818 Contract Number: To Be Determined (TBD) Estimated Value:
3. Statutory Authority: 10 U.S.C. 2304c(c)(5); and Regulatory Authority Federal Acquisition Regulation (FAR) 16.505(a)(4).
4. Description of Action: The purpose of this requirement is to procure brand name, proprietary Scantron Insight scanners and ScanTools software in support of the Army Resilience Directorate (ARD). This procurement will be a awarded as a firm-fixed-price purchase order to Scantron Corporation, the original equipment manufacturer (OEM), who has proprietary rights to the product. The period of performance is date of award through one year. Fiscal year 2020 Operation and Maintenance funds will be used to fund this effort and have been provided on Military Interdepartmental Purchase Request number 11537818. The applicable North American Industry Classification System code is 541519, Other Computer-Related Services, with a size standard of $30 million. The total estimated price for the proposed acquisition is

Currently, the ARD is using two Scantron OpScan 6 Scanners that are no longer supported for maintenance by Scantron due to equipment age. Failure of either of these machines will directly impact the Army's ability to use Unit Risk Inventory (URI) survey data for the SECARMY approved Suicide Prevention Pilot. Data gathered on the URI is fed into the Department of the Army Management Information System (DAMIS) records from the scanners to an Oracle Database for DAMIS.
Immediate replacement will positively impact the Army's ability to continue with the gathering/scanning of URI survey data to support the Suicide Prevention Pilot.
ARD seeks to replace both outdated scanners with new Scantron iNSIGHT 700C scanners with Scantron Prisma software. Scantron is the only manufacturer that met the requirements to maintain the ability to use the URI survey instrument. The Prisma software utilizes Optical Mark Recognition (OMR) capabilities to read the URI surveys. Both the Prisma software and the Scantron iNSIGHT 700C scanners are on the Joint Service Provider approved products list for use on the Pentagon Network.
If current outdated equipment is not replaced with the Scantron OMR capable scanners, ARD will be required to develop and re-design a new survey instrument (URI), purchase new scanners and associated software, and develop new algorithms to read survey results with the ability to load to the Oracle Database, which would be a significant loss of time and funds for the Government.
Scantron Insight Scanners and ScanTools Prisma software are only available from Scantron Corporation, the OEM. Scantron Corporation owns the copyrighted software with all legal rights, privileges, and ownership contained therein. No other contractors or distributors can legally obtain access to the software or make duplicate copies, because copyrights and patent laws protect this product. No other source may legally modify or change the product, nor would they have access to the source code to do so.
5. Proposed Sole Source Contractor: Scantron Corporation (CAGE: 50YC7, Large Business)
6. Market Research: Market research, dated May 2020, included gathering data from previous acquisitions, contacting knowledgeable persons in the Government and industry, internet searches, and reviewing existing Government-wide acquisition contracts. A search of available OMR capable scanners and associated scanning software determined that Scantron was the only manufacturer that met the requirements to maintain the ability to use the URI survey instrument. Market research confirms that this product is not available through Department of Defense Enterprise Software Initiative Blanket Purchase Agreement, General Services Administration Federal Supply Schedule or the National Aeronautics Space and Administration Space Administration Solutions for Enterprise- Wide Procurement contract vehicles. The product is only available through an open market order via Scantron Corporation, the sole source provider for this requirement.
The sole source solicitation will be sent directly to Scantron Corporation.
Based on current market research, it has been determined that only the aforementioned brand name can be provided by Scantron Corporation and fully support the Governments need. This requirement is for proprietary product support and no competitor functional replacement products exist in the market at this time to meet the Government's needs.
The Government will continue to conduct market research to determine if there are changes in the market place that would enable future competitive actions, i.e. there are similar products and/or product support in the marketplace that provides the same functionality, the OEM releases ownership rights of product, or it is economically feasible to procure a new system.
7. Upon the basis of the following justification, I, as the Contracting Officer, hereby approve this sole source justification for the proposed contract action pursuant to the authority cited above as the particular product is essential to the Government's requirements, and market research indicates other companies' products or services do not meet, or cannot be modified to meet, the agency's needs.
Based on the justification provided by ARD, a determination has been made to sole source this requirement to Scantron Corporation.
