Ariel Software License Support and Subscription Renewal

3. Statutory Authority: Federal Acquisition Regulation (FAR) 13.106-1(b)(1) Soliciting from a single source (including brand name).

4. Description of Action: The nature of this action is to provide NEBS Program Office with a firm-fixed-price purchase order for the commercial off the shelf, brand name, and proprietary Ariel software license support and subscription renewal. This contract will perpetuate the existing license support and subscription currently being provided on contract number which expires June 14, 2019. The total estimated contract cost is Fiscal year 2019 funds were provided under Military Interdepartmental Purchase Request number

The Navy has fully integrated and implemented Ariel software into the technical architecture within the shipyards. NEBS purchases a yearly subscription to the Ariel Environmental Health & Safety (EH&S) regulatory databases to ensure Navy compliance with environmental laws and regulations. The EH&S module is the specifications database that houses all federal, state and local regulatory requirements Environmental Protection Agency and Occupational Safety and Health Administration. The specification database also maintains health and safety data found on a Material Safety Data Sheet to meet regulations on document availability. The required software support and renewal ensures Navy compliance with statutory environmental, health and safety requirements that regulate Navy maintenance and logistic processes.

Department of Defense (DoD) cyber security mandates require that all software products have current support to ensure proper functionality and minimize the security breach potential of all software products. This requiremetn provides the Navy with updates, patches, and fixes for the Ariel software products. Failure to renew the license support and subscription, the Ariel EH&S regulatory database, increases risk of Navy personnell and logisitcs worker that rely on this software for saftey information and compliance.

5. Proposed Sole Source Contractor: 3E Company Environmental, Ecological, and Engineering

Market Research: Market research confirmed that 3E Company Environmental, Ecological, and Engineering is the original equipment manufacturer (OEM) and maintains sole proprietary rights to Ariel software products. No other vendor, reseller, or distributor is legally authorized to sell Ariel support. The required software is not currently available on an existing DoD Enterprise Software Initiative Blanket Purchase Agreements, General Services Administration Federal Supply Schedule, or National Aeronautics and Space Administration Solutions for Enterprise- Wide Procurement V Government-wide acquisition contract.

Based on current market research, dated May 2019, it has been determined that only the aforementioned brand name product and product support provided by the OEM , can fully support the Government’s need. This requirement is for proprietary products and product support and no competitor functional replacement products exist in the market at this time to meet the Government's need. The Government will continue to conduct market research to determine if there are changes in the market place that would enable future competitive actions, i.e. there are similar products and/or product support in the marketplace that provides the same functionality, the original equipment manufacturer releases ownership rights of product, or it is economically feasible to procure a new system.

7. Upon the basis of the following justification, I, as the Contracting Officer, hereby approve this sole source justification for the proposed contract action pursuant to the authority cited above as the particular brand name product is essential to the Government's requirements, and market research indicates other companies' products or services do not meet, or cannot be modified to meet, the agency's needs.

Based on the justification provided by NEBS, a determination has been made to post a combined synopsis/solicitation on FedBizOpps and issue a sole source solicitation directly to the OEM for quotation for the above described requirement.
