Limited Sources/Sole Source Rationale

1. REQUIRING AGENCY AND CONTRACTING OFFICE:

Requesting Agency:

Defense Information Systems Agency (DISA), Joint Service Provider (JSP) 1155 Defense Pentagon Washington, DC 20301-1155

Contracting Activity:

DISA, Defense Information Technology Contracting Organization (DITCO)/PL8321 2300 East Drive Scott Air Force Base, Illinois 62225

2. Procurement Title: NOMAD Software Support Renewal

Funding Document Number: DJPMZ90000, Subject to Availability of Funds Order Number: To be determined Estimated Value: XXXXXXXXXX NAICS: 511210, $38.5 million sales size standard

3. Statutory Authority: Federal Acquisition Regulation (FAR) 13.106(b)(1): In accordance with (IAW) FAR Part 13.106(b)(1), for purchases not exceeding the simplified acquisition threshold, the contracting officer may solicit from only one source if the contracting officer determines that the circumstances of the contract action deem only one source reasonably available (e.g. urgency, licensing agreements, brand name or industrial mobilization).

4. Description of Action: Brand name, proprietary, original equipment manufacturer (OEM), Select Business Solutions, Inc.’s Nomad and UltraQuest software renewal support is required for the DISA JSP, Arlington, Virginia. Currently installed Nomad, Napa, and UltraQuest software products support JSP’s Washington Headquarters Services Allotment Accounting System (WAAS) and Trust Fund Accounting System (TFAS). This renewal is associated with Select Business Solutions, Inc.’s software license agreement or SLA customer number AR011928 and account number 81P388. The software renewal support is necessary to obtain software updates, patches, and fixes for the configuration and interfaces of WAAS and TFAS. The period of performance is October 1, 2018 – September 30, 2019. This firm fixed price procurement will continue support of the HC102818P0013 order, which expires September 30, 2018. Fiscal year 2019 operation and maintenance funds of Military Interdepartmental Purchase Request number DJPMZ90000, which are Subject to Availability of Funds, IAW the FAR clause 52.232-18 - Availability of Funds.

These NOMAD and UltraQuest software products provide WAAS and TFAS with business intelligence reporting tools with access to a variety of data sources for records and analysis. The products integrate with other relational database engines such as DB2 for z/OS and DB2 for z/VM. The needed NOMAD software support is necessary to provide updates, patches and fixes to the existing software infrastructure, and configure with the WAAS, TFAS, and various interfaces.

5. Proposed Source: Government market research is detailed in paragraph 6 and supports the brand name requirement.

6. Market Research: Based on current market research, dated 20 July 2018, it has been determined that only the aforementioned NOMAD software renewal support provided by Select Business Solutions, Inc., can fully support the Governments need. This requirement is for proprietary products and/or product support and no competitor functional replacement products exist in the market at this time to meet the Government's need. The Government will continue to conduct market research to determine if there are changes in the market place that would enable future competitive actions, i.e. there are similar products and/or product support in the marketplace that provides the same functionality, the original equipment manufacturer releases ownership rights of product, or it is economically feasible to procure a new system. Select Business Solutions, Inc.

Government market research found that the software support is only available through the OEM, Select Business Solutions, Inc., which is a small business. Therefore, two or more small businesses are not available for this renewal requirement and small business set aside is not applicable to this procurement. The software products are not available through a DoD Enterprise Software Initiative Blanket Purchase Agreement or other Government-wide Acquisition Contracts. An open market procurement is applicable and recommended.

7. Upon the basis of the following justification, I, as the Contracting Officer, hereby approve this limited sources justification for the proposed contract action pursuant to the authority cited above as the particular Select Business Solutions, Inc.’s NOMAD and UltraQuest software renewal support is essential to the Government's requirements, and market research indicates other companies' products do not meet, or cannot be modified to meet, the agency's needs.

Based on the justification provided by DISA JSP, a determination has been made to solicit the brand name NOMAD and UltraQuest renewal software support from Select Business Solutions, Inc. for the above-described requirement.
