Limited Sources/Sole Source Rationale

1. REQUIRING AGENCY AND CONTRACTING OFFICE:

Requesting Agency:

Naval Sea Systems Command (NAVSEA) Program Management Office for Information Technology (PMO-IT) 2510 Walmer Avenue, Suite A Norfolk, Virginia 23513 – 4637

Contracting Activity:

Defense Information Systems Agency (DISA) Defense Information Technology Organization (DITCO) Software Section (PL8321) 2300 East Drive Building 3600 Scott Air Force Base, Illinois 62225

2. Procurement Title: Remote Print Manager (RPM) Elite software and Support

Funding Document Number: N0002418MP00781 Purchase Request Number: To be determined (TBD) Contract Number: TBD

3. Statutory Authority: Federal Acquisition Regulation (FAR) 13.106-1(b)(1), are provided to support Brand Name limited source justification for proposed orders exceeding the micro-purchase threshold, but not exceeding the simplified acquisition threshold.

4. Description of Action: NAVSEA PMO-IT requires proprietary Brooks Internet Software Inc, Remote Print Manager (RPM) Elite software and Support. Only the original equipment manufacturer (OEM) or authorized reseller can provide. This software and support will support the Component Enterprise Data Center (CEDC) host the Maritime System Environment (MSE) suite of applications being implemented into the Shipyards.

The period of performance is date of award through one year. Fiscal Year 2018 operations and maintenance funds have been provided on Military Interdepartmental Purchase Request Number N0002418MP00781. The applicable North American Industry Classification System code is 541519, with a size standard of $27.5 million.

Brook’s RPM software provides extensive formatting capabilities in text printing and the ability to work with third party software. RPM supports Line Printer Daemon (LPD) and stream protocols, enabling users to receive and customize print jobs from any UNIX or Windows-based system to any local or remote Windows printer.

Specifically, RPM Elite is fully integrated with Windows Security allowing administrators to control access through the Distributed Component Object Model (DCOM) Configuration utility in Windows. This feature configuration can be controlled using the Windows Registry and incoming print jobs can be secured with the NTFS file system.

Without Brook’s RPM software, an alternative software would be required. While there are products available on the market as listed above, a new product would require halting of current print schedules for the setup of new product print scheduling requirements and resetting rules. This would result in delays of critical reports being available when required for the time the rework is being complete. In addition to an estimated 6 months and more than $100,000 to integrate.

5. Proposed Sole Source Contractor: Brooks Internet Software, Inc. or authorized resellers

6. Market Research: Market research conducted for this procurement in May 2018, included gathering data from previous acquisitions, reviewing current contracts, internet searches, contacting the manufacturer and authorized resellers, conducting internal discussions, and determining potential sources. Only the name brand Brooks Internet Software has been found to provide the proprietary features necessary to sustain their products while maintaining compatibility across the Navy’s infrastructure. The Brooks Internet Software is essential to the Government’s requirements, and from the conducted market research, it is known that Brooks Internet Software is a proprietary product, and the software support is only available from the OEM or their authorized reseller(s). The OEM owns the copyrighted software with all legal rights, privileges, and ownership contained therein. No other contractors or distributors can legally obtain access to the software or make duplicate copies, because copyrights and patent laws protect the software. No other source may legally modify or change the software, nor would they have access to the source code to do so.

Market research concluded that the brand-name, proprietary requirement items are not available through Department of Defense Enterprise Software Initiative Blanket Purchase Agreement, General Services Administration Schedule or National Aeronautics and Space Administration Solutions for Enterprise-Wide Procurement contract vehicles. The required software is available via open market with identified sources including a large and small business. A small business set aside is not applicable to the procurement.

Government will request all available discounts for this lowest priced, technically acceptable requirement.

Based on current market research, dated May 2018, it has been determined that only the aforementioned brand name Brooks Internet Software product provided by the OEM or an authorized reseller, can fully support the Government’s need. This requirement is for proprietary products and no competitor functional replacement products exist in the market at this time to meet the Government's need. The Government will continue to conduct market research to determine if there are changes in the market place that would enable future competitive actions, i.e. there are similar products and/or product support in the marketplace that provides the same functionality, the original equipment manufacturer releases ownership rights of product, or it is economically feasible to procure a new system.

7. Upon the basis of the following justification, I, as the Contracting Officer, hereby approve this limited source justification for the proposed contract action pursuant to the authority cited above as the particular brand-name product is essential to the Government's requirements, and market research indicates other companies' products or services do not meet, or cannot be modified to meet, the agency's needs.

Based on the justification provided by NAVSEA, a determination has been made to solicit brand name Brooks Internet Software from authorized sources, including the OEM and authorized reseller(s), for the above-described requirement.
