SOURCE SELECTION INFORMATION – SEE FAR 2.101 AND 3.104

Limited Sources/Sole Source Rationale

1. REQUIRING AGENCY AND CONTRACTING OFFICE:

Requesting Agency:

United States Navy Management Systems Support Division (MSSD) Building 170, 6th Floor Portsmouth, New Hampshire 03804

Contracting Activity:

DISA/Defense Information Technology Contracting Organization (DITCO) Software Section – PL8321 2300 East Drive, Building 3600 Scott Air Force Base, Illinois 62225-5406

2. Procurement Title: Safeguard Send Software Support

Funding Document Number: N4215818MP80134, N3225318MP140841, N3904018MP80105, N4540418MP18022

Purchase Request Number: To Be Determined (TBD) Contract Order Number: TBD

3. Statutory Authority: Federal Acquisition Regulation (FAR) 13.106-1(b)(1), are provided to support Brand Name limited source justification for proposed orders exceeding the micro-purchase threshold, but not exceeding the simplified acquisition threshold.

4. Description of Action: Portsmouth Naval Shipyard (PNS), Norfolk Naval Shipyard (NNSY) & Pearl Harbor Naval Shipyard (PHNSY) and Submarine Maintenance Engineering, Planning and Procurement Activity (SUBMEPP) require brand-name, proprietary, Safeguard Send software support products of Sperry Software, Inc., the original equipment manufacturer (OEM). This requirement will perpetuate the support provided under contract number HC102817P0121.

The period of performance is April 26, 2018 through April 25, 2019. Fiscal Year 2018 operations and maintenance funds of Military Interdepartmental Purchase Requests N4215818MP80134, N3225318MP140841, N3904018MP80105, and N4540418MP18022 have been provided. The North American Industry Classification System code is 511210, with a sales size standard of $38.5 million.

Safeguard Send software is used to scan outgoing United States Navy Marine Corps Intranet (NMCI) email messages for keywords and reduce information spill risk. The Safeguard Send support renewal will allow the shipyards to obtain software upgrades and for personnel to continue day to day operations without having any break in software operations. The Department of the Navy and Secretary of the Navy Instructions (SECNAVINST) 5230.15 require all commercial off the shelf software to be vendor supported to ensure that the Navy has access to software patches to mitigate operational problems and security vulnerabilities.

The Shipyards and SUBMEPP will not receive updates, patches, and fixes in violation of SECNAVINST 5230.15 without the Safeguard Send support renewal. An alternative software solution would need to be approved by the NMCI team for deployment to approximately 28,500 users. The cost for training and software conversion is estimated to cost $140,000.00, and take a year to review, test and implement. Key word email scanning and alerts would be insufficient for security needs during the transition. Information spills, the Navy estimates to cost $11,200 each, and work stoppages would be unacceptable risks.

5. Proposed Sole Source Contractor: Sperry Software, Inc.

6. Market Research: Market research conducted in April 2018 included gathering data from previous acquisitions, internet searches, contacts with manufacturers and resellers, internal discussions, and other sources. Only the name brand, Sperry Software, has been found to provide the proprietary features necessary to sustain their products while maintaining compatibility across the infrastructure. The brand name product is essential to the Government’s requirements and market research indicates other companies’ similar products lack the capabilities and features and do not meet, and cannot be economically modified to meet the agency’s needs.

From the conducted market research, it is known that Safeguard Send software support is a proprietary product only available from the small business, OEM, Sperry Software, Inc., which does not authorize resellers. Sperry Software Inc. owns the copyrighted software with all legal rights, privileges, and ownership contained therein. No other contractors or distributors can legally obtain access to the software or make duplicate copies, because copyrights and patent laws protect this Sperry Software. No other source may legally modify or change the software, nor would they have access to the source code to do so.

7. Upon the basis of the following justification, I, as the Contracting Officer, hereby approve this sole source justification for the proposed contract action pursuant to the authority cited above as the particular brand-name product is essential to the Government's requirements, and market research indicates other companies' products or services do not meet, or cannot be modified to meet, the agency's needs.

Based on the justification provided by the Navy, a determination has been made to solicit an open-market quote from the sole source, the OEM, Sperry Software, Inc.
