Purchase Request Number: N4523A18MP013V3 Contract Number: To Be Determined (TBD) Task/Delivery Order Number: TBD Estimated Value: $135,075.00
3. Statutory Authority: The following paragraphs, IAW Federal Acquisition Regulation Part 13.106-1(b)(1)(i), are provided to support sole source limited source justification for proposed orders exceeding the micro-purchase threshold, but not exceeding the simplified acquisition threshold.
4. Description of Action:
Brand-name, proprietary, Automic Software Inc.’s software maintenance renewal (formally Appworx and UC4) is required by the Naval Sea Systems Command (NAVSEA) Management Systems Support Division (MSSD) for the Navy shipyards, which include Norfolk (NNSY), Puget Sound Naval (PSNS), Pearl Harbor (PHNSY) and Portsmouth (PNS). The Automic Software Inc.’s software products are commercial web-based information technology (IT) tools used for batch scheduling, and various interfaces between applications and report distribution. The period of performance is January 1, 2018 to December 31, 2018. The total amount of this procurement is estimated to be $135,075.00. This acquisition is to renew software updates and upgrades; support currently provided under purchase order HC102817P0020, which expires December 31, 2017. The applicable North American Industrial Classification System Code is 511210 Software Publishers, with a size standard of $38.5 million.
Automic Applications Manager is used by the Information Assurance branches across the four shipyards. It is an enterprise job scheduler tool that automates applications and balances workloads across platforms. It reduces IT operation expenses by improving application automation. The Master and Agent software takes the individual components of script-like programs, schedules, printers, and conditions and allows the user to define them as discrete objects. The user can combine the objects to handle numerous and varied needs. The object can be changed, and then rolled-out to every object user.
The Government has invested over $2,670,000 in Automic licenses and software support since 2012. The application was specifically designed to utilize Automic functionality, which includes process automation, batch job scheduling, and other tasks. The Automic program is used by over 40,000 users and controls the Material Access Technology or MAT and cost software. Without the renewal support NNSY, PSNS, PHNSY and PNS personnel will not have the availability of this required tool to complete mission tasks. Without the Automic software support, the naval shipyards would not receive the upgrades, patches, and fixes to the Automic software, which could result in work stoppage and other detrimental impacts to the Navy.
Procuring an alternative software would result in substantial duplication of cost to the Government that is not expected to be recovered through competition and would require an extensive number of modifications and unacceptable delays in fulfilling Agency’s requirements. The Government estimates that researching, testing, training, approving, and implementing alternative software infrastructure would cost in excess of $1 million.
5. Proposed Sole Source Contractor: On January 19, 2017, CA Technologies and Automic Software, Inc. jointly announced that CA Technologies acquired Automic Software, Inc. Automic Software, Inc. in October 2017 continues to directly sell the required software renewal products directly. Resellers are not authorized to sell the proprietary products.
6. Market Research: Automic Software, Inc. is the sole provider of the requirement items. Based on current Government market research performed in October 2017, the Navy determined that only the Automic Software Support can fully support Government needs. Government market research, in October through November 2017, revealed the required items are not available through a Department of Defense Enterprise Services Initiative Blanket Purchase Agreement, General Services Administration Federal Supply Schedule, or the National Aeronautics Space and Administration Solutions for Enterprise-Wide Procurement contract vehicles. This open-market procurement will be sole sourced to the small-business, Automic Software, Inc. The request for quote and Government intent to issue a purchase order to Automic Software, Inc. will be advertised on FedBizOpps.
7. Upon the basis of the following justification, I, as the Contracting Officer, hereby approve this sole source justification for the proposed contract action pursuant to the authority cited above as the particular brand-name product is essential to the Government's requirements, and market research indicates other companies' products or services do not meet, or cannot be modified to meet, the agency's needs.
Based on the justification provided by the US Navy, a determination has been made to issue a sole source solicitation for the above described requirement.
