It will provide upgrades and support coverage for the deployed solution licensing configuration. It will sustain engineering efforts which are reliant on this procurement and allow for current engineering schedule, maintenance planning and logistics support to move forward on schedule. The items being procured are manufactured by Good Technology, Inc., which has been approved by the ONE-NET Program Office and Fleet Customer to provide user registration and authentication on the One-Net operational disaster recovery and archiving capabilities on the ONE-NET enterprise.

4. IDENTIFICATION OF STATUTORY AUTHORITY:

Only one responsible source and no other supplies or services will satisfy agency requirements, 10 U.S.C.2304(c)(1). (FAR 6.302-1/DFARS 206.302-1).

5. DEMONSTRATION OF CONTRACTOR’S UNIQUE QUALIFICATIONS:

Description of events. Blackberry Enterprise service / Good Technology warranty Support are key components of the ONE-NET Architecture within its internal and external environments and include secure user registration and authentication using these products. ONE-NET has made substantial investments in the existing networking infrastructure, which consists primarily of Blackberry Enterprise service / Good Technology, Inc.’s systems network equipment. ONE- NET’s mission includes significant requirements to support a broad range of Department of Defense (DOD) missions. Maintaining network operational availability is a critical component of that support. The existing ONE-NET infrastructure utilizes the Blackberry Enterprise service or Good Technology, Inc. software products, which are proprietary products.

Justification.

(1) Minimum Government requirements. The renewal of the Good Technology, Inc.

software support, which is associated with the manufacturer’s account 33004067 as outlined in paragraph 3 is required.

(2) Proposed sole source contractor. Good Technology, Inc. software products are brand-name, proprietary software products, which are only available to the government through the manufacturer. The products are sold to the government through authorized resellers. However, the proprietary owner does not authorize third party software modification or patches to its software, which is copyrighted with all legal rights, privileges, and ownership contained therein. No other source may legally modify or change the software, nor would they have access to the source code to do so.

(3) Discussion regarding cause of the sole source situation. The Blackberry Enterprise service / Good Technology software are proprietary and ONE-NET personnel are trained and have developed a specialized expertise working on Blackberry Enterprise service / Good Technology oriented network environment, which requires Blackberry

Enterprise service / Good Technology MAINTENANCE support. ONE-NET has made a substantial investment of both funding and training to achieve the current state of the network operational stability and functionality.

(4) Demonstration of unique source. BlackBerry Enterprise service / Good Technology is the only technical hardware and hardware warranty support option capable of servicing this proprietary operating system. Blackberry Enterprise service / Good Technology equipment is currently installed in the ONE-NET Infrastructure and is the only suite of technical support capable of servicing ONE-NET networking equipment due to the proprietary nature of the Blackberry Enterprise service / Good Technology.

(5) Procurement discussion. BlackBerry Limited / Good Technology, Inc.’s software support were previously procured through an unrestricted open-market purchase order N000189-15-P-1408, which was issued by the Navy. The support expired on October 22, 2016. There are a number of authorized resellers that have been identified for the open-market renewal, including one small business and two large businesses. Other government contract vehicles were found to be NA to this requirement.

(6) Impact. This procurement will provide continued support services to the existing network infrastructure. If expanded competition were to take place and resulted in a selection of a non- BlackBerry Limited / Good Technology, Inc. enterprise software solution, the government estimates that there would be no demonstrable technical value. There would be unacceptable risks and delays in sustaining the ONE-NET critical mission network operations by two or more years. The government estimates that it would cost several millions of dollars to swap existing equipment with a different hardware and software infrastructure items. There would also be substantial costs and time required to retrain users and administrators that sustain the networks, in addition to the time and labor involved with installation of the replacement equipment.

The increasing costs and delays are unacceptable to the Navy, at this time.

6. FEDBIZOPPS ANNOUNCEMENT/POTENTIAL SOURCES:

As required by FAR 12.603, a synopsis / written solicitation will be issued to reduce the time required to solicit and award the contract for the acquisition of the required commercial items. This procedure combines the synopsis required by 5.203 and the issuance of the solicitation into a single document.

7. DETERMINATION OF FAIR AND REASONABLE COST:

A lowest priced technically acceptable evaluation methodology is applicable to this requirement.

Award will be made on the basis of the lowest evaluated price that meets or exceeds the acceptability standards for non-price factors. The total price quote will be used to determine the lowest priced offer, and evaluation will continue to higher priced offerings only until the lowest priced technically acceptable and otherwise properly awardable offering is identified. Should only one quote be received, then the quote will be evaluated to determine that it is technically acceptable cost reasonable. The government will perform an evaluation of the offeror’s proposed costs to ensure the costs are fair and reasonable based on published or market prices for the same or similar items, the independent government cost estimate pricing, and available historical prices for the required renewal support products. The contracting officer will also determine the information valid for comparative purposes. Certified cost or pricing data is not required for this acquisition, in accordance with FAR 15.403-1(b)(1) and FAR 15.403-1(b)(3).

8. MARKET RESEARCH:

a. Government market research for this procurement was completed by the Fleet Cyber Warfare Command in October through late-November of 2016. The team surveyed the market through internet research, contacting the manufacturer and authorized resellers, conducting internal discussions, holding vendor meetings, and reviewing government-wide acquisition contracts.

b. The first step taken in conducting market research in support of this requirement was to determine if other than brand name software products were a solution the government could consider.

At this time, there are no viable products in the marketplace that can fully meet the government’s requirements. No current products can provide a family of ‘like’ products to support the BlackBerry Limited or Good Technology, Inc.’s infrastructure. Introducing an alternative product into the current infrastructure would result in additional, unnecessary, and substantial duplication of time and costs, which are not expected to be recouped through competition. Good Technology, Inc.’s software products are proprietary and only available from the proprietary owner or their authorized resellers.

Their software products are currently accredited as an approved solution, which is a critical part of the ONE-NET environment. Compatibility with other ONE-NET deployed solutions is necessary to maintain the network. An alternate solutions would not currently provide for certification and accreditation or (C&A) compliance.

c. Market research revealed that the Good Technology, Inc.’s software support products are not available through a DoD Enterprise Software Initiative Blanket Purchase Agreement. The requirement can also not be fulfilled through a General Services Administration (GSA) Federal Supply Schedule order. There is one GSA schedule holder, Carahsoft Technology Corporation. However, only a few of the requirement items are currently available on the GSA schedule. The requirement could be competed among multiple potential resellers that are NASA Solutions for Enterprise-Wide Procurement or SEWP contract holders. However, government market research indicates that more favorable pricing would be available through an open-market order. The government identified potential reseller sources for the products, including a small business, Avid Systems, and large businesses, New Tech Solutions and Sterling Computers. No reseller was found to be able to provide at least 50 percent of the cost of contract performance for this requirement. The requirement cannot be a small business set-aside due to the limitations on subcontracting, in accordance with FAR 52.218-14. It is recommended that this requirement be competed among large and small open-market resellers that are authorized BlackBerry Limited / Good Technology, Inc. resellers.

9. ANY OTHER SUPPORTING FACTS: None.

10. LISTING OF INTERESTED SOURCES: None. However, responses to the FBO posting of the synopsis with written solicitation will be considered prior to proceeding with any award.

11. ACTIONS THE AGENCY MAY TAKE TO REMOVE OR OVERCOME BARRIERS

THAT LED TO THE EXCEPTION TO FULL AND OPEN COMPETITION:

(a) Procurement History. The prior $144,380.00 annual support was provided by Avid

Systems under the Navy purchase order N00189-15-P-1408 with POP of October 22, 2015 through October 21, 2016. The support contract was competed among large and small businesses. Support under other SPAWAR orders expired October 21, 2016.

(b) At this time, full and open competition for software functionality is not feasible due to the government’s substantial investment in the Good Technology, Inc. infrastructure. This acquisition is to renew the support for the Good Technology, Inc. software products. If the proprietary software owner surrenders their legal ownership, copyright, and/or intellectual property software rights and moves to a complete open-source solution, then the government will seek full and open competition for Good Technology, Inc.’s software products. Regardless, the government will continue to search the marketplace to determine if alternative solutions exist. If the government requires functionality change, then the government will seek full and open competition.

12. REFERENCE TO THE APPROVED ACQUISITION PLAN (AP): A written AP is not required as the estimated cost of this requirement is below the dollar cost threshold in which such a written AP is required.
