JUSTIFICATION

1. REQUIRING AGENCY AND CONTRACTING OFFICE:

a. Requiring Agency:

DISA Implementation and Sustainment Center (ISC) 1 Overcash Avenue, Building 12 Chambersburg, Pennsylvania 17201

b. Contracting Office:

DISA/DITCO

2300 East Drive Scott Air Force Base, Illinois 62225-5406

2. NATURE/DESCRIPTION OF ACTION(S):

a. The nature of this action is to procure proprietary, commercial off-the-shelf (COTS) CCA software support for DISA ISC. The procurement will be awarded as a firm-fixed-price (FFP) contract to the original equipment manufacturer (OEM) and sole-source provider, CCA, using open market procedures. This procurement will perpetuate existing coverage which expires September 30, 2015. This procurement will provide software support for the Model 204 (M204) products that are operating in the DISA ISC software infrastructure.

b. The period of performance for this requirement is one year, estimated to begin October 1, 2015 through September 30, 2016. Fiscal year 2016 defense working capital funds will be provided under a Military Interdepartmental Purchase Request. The applicable North American Industry Classification System code is 511210, Software Publishers, with a sales size standard of $38.5 million.

3. DESCRIPTION OF SUPPLIES/SERVICES:

The objective of this contracting effort is to procure brand name CCA software support for the M204 products in support of DISA ISC. The CCA software support entitles and authorizes continued usage of CCA software products and provides DISA staff access to product expert systems, product repair, product distribution, and documentation. Additionally, the support provides new software versions, releases, fixes, and upgrades. The CCA M204 software provides a large, high-transaction database system, incorporating a programming language and an environment for application development. This software supports multiple applications transmitted to or processed by DISA-managed systems and facilities. M204 encompasses numerous interfaces which all work in succession to provide the scalability that DISA requires supporting its mission. M204 products support large-scale applications that process vast databases which contain multifaceted structures. Support is required for each software product version in DISA’s inventory, as identified below:

Product Model CPU MIPS

M204 Advantage 2828-E04 291 - Computer Associates (CA)-Top Secret Security Interface 2828-E04 291

M204 Advantage 2818-P02 - 392 M204 CA-Access Control Facility ACF2 Interface 2818-P02

M204 Core System 2828-I03 396 M204 User Language 2828-I03 390 M204 Time Sharing Option TSO Transaction Processing Interface

2828-I03

M204 Resource Access Control Facility Security Interface

2828-I03

4. IDENTIFICATION OF STATUTORY AUTHORITY:

Only one responsible source and no other supplies or services will satisfy agency requirements and Section 4202 of the Clinger-Cohen Act of 1996 and FAR 6.302-1/Defense FAR Supplement 206.302-1.

5. DEMONSTRATION OF CONTRACTOR’S UNIQUE QUALIFICATIONS: CCA’s software is proprietary, and support is only available from CCA. CCA is the OEM for the required software support, and CCA does not allow any third party software modification or patches to its software.

Page 3 of 4 Pages

a. Description of events. The CCA M204 products have been fully implemented, including design, creation, configuration, testing, training, and migration of the operational set of users into the DISA ISC infrastructure, for over 15 years. CCA M204 software requires continuous a support to provide new software versions, releases, fixes, and upgrades, as well as access to product expert systems, product repair, product distribution, and documentation to support DISA’s data base management system.

b. Justification:

(1) Minimum Government requirements. The minimum government requirement is for software support of the software licenses identified in Section 3.

(2) Proposed sole source contractor. CCA is the OEM of the required M204 proprietary software and is the only source capable of satisfying the government’s requirement for software support. CCA does not have authorized resellers.

(3) Discussion regarding cause of the sole source situation. Only CCA will satisfy this requirement, as the software is a proprietary product of CCA. CCA owns the copyrighted source software with all legal rights, privileges, and ownership contained therein. No other source may legally modify or change the software, nor would they have access to the source code to do so. No other contractor or distributor can make duplicate copies, because copyright and patent laws protect this CCA software.

The use of CCA software support is essential to the government’s requirements.

(4) Demonstration of unique source. As referenced above, the CCA M204 software is proprietary software, manufactured by CCA. Only CCA will be able to satisfy the program’s requirement for the software support, since CCA does not have authorized resellers.

(5) Procurement discussion. DISA has already invested more than 15 years in research, substantial man-hours and technical support resources to develop and maintain the current environment that relies on the CCA M204 products. The current CCA M204 software has proprietary features and has been tested and integrated into the DISA architecture and is a proven product that fully meets ISC’s requirements.

(6) Impact: M204 is a data base management system with an integrated programming language (formerly user language, now simple objective user language) which supports mission critical applications written by Navy Bureau of Personnel, United States Army Security Assistance Command, and Defense Logistics Agency. As this product is so deeply imbedded in the DISA infrastructure, not renewing the support could cause severe issues with personnel management and user security information, and reengineering a new solution would result in the loss of the current investment.

6. FEDERAL BUSINESS OPPORTUNITIES (FBO) ANNOUNCEMENT/POTENTIAL

SOURCES:

Page 4 of 4 Pages

DISA ISC requires a sole source award to CCA for the renewal of software and support. A sources sought notice for this requirement was published to the FBO website on June 18, 2015, as required by FAR 5.2, and no responses were received.

7. DETERMINATION OF FAIR AND REASONABLE COST:

The contracting officer will make a determination that the anticipated cost to the government is fair and reasonable, based on comparison of commercial list pricing, previous history, and comparison of the independent government cost estimate. A determination will be made that the contract represents the best value to the government and results in the lowest overall price alternative.
