JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION (OTFAOC)
JUSTIFICATION FOR AN EXCEPTION TO FAIR OPPORTUNITY
Justification for OTFAOC Number: JA 12-058Upon the basis of the following justification, I, as Procuring Activity Competition Advocate hereby approve the use of other than full and open competition of the proposed contractual action pursuant to the authority of 10 U.S.C. 2304(c)(1).
JUSTIFICATION
1. REQUIRING AGENCY AND CONTRACTING OFFICE:
Requiring Agency:
Joint Chiefs of Staff/ DOM-OCIO
The Joint Staff
Room 1D565, The Pentagon
Washington, DC 20310 Contracting Office:
Defense Information Systems Agency (DISA)/Defense Information Technology Contracting Organization (DITCO), ATTN: PL8313.
2300 East Drive
Scott AFB, Illinois 62225-5406
2. NATURE/DESCRIPTION OF ACTION(S):
The objective of this effort is to provide a bridge contract using the Encore II contract, HC1028-08-D-2026-0009 to continue the critical network modernization support engineering, testing, integration, deployment and support of major information technology (IT) improvements to the Joint Staff Information Network (JSIN).
This solution requires continuity of staffing by the incumbent prime contractor (which began in September 2010) starting on 1 March 2012 for three months in order to ensure critical continuity of services provided to the Joint Staff against delivery order number HC1028-08-D-2026-0009. SRA International Incorporated is the only available integrator with the necessary intimate knowledge of and experience with the Joint Staff networks to address the current configurations and provide successful continuity of operations Because time is of the essence to put this 90 day bridge together and so that there is an uninterrupted continuous flow to the follow-on contract SRA is the logical choice.
a. Type of action: Firm Fixed Price
b. Estimate: Approximately $815.1K
c. Type of funding: Operations and Maintenance (O&M)
d. Year of funding: FY 2012
Current prime has the intimate knowledge and experience with the Joint Staff environment to be productive from day one. Our past experience has shown that a different vendor would take up to an additional 4 months to familiarize and understand the unique Joint Staff environment.
3. DESCRIPTION OF SUPPLIES/SERVICES:
This J&A is for services network operations, maintenance and services. This effort will provide personnel to augment existing personnel in running the 24x7 Network Operations Center, operational support to operate and maintain the evolving capabilities used with the JSIN enclaves, end user support, IT service desk support, and executive customer IT support.
· This procurement will be limited to a 92 day period of performance.
· Customer Activity: DODDAC: HQ0131
· Period of Performance: 1 March 2012 – 31 May 2012.
4. IDENTIFICATION OF STATUTORY AUTHORITY & DEMONSTRATION OF CONTRACTOR’S UNIQUE QUALIFICATIONS:
This acquisition is conducted under the authority of FAR 16.505(b)(2)(i)(B) - Only one awardee is capable of providing the supplies or services required at the level of quality required because the supplies or services ordered are unique or highly specialized.
The proposed work is a continuation of worked performed by SRA International, Inc. which was awarded on a sole-source basis on 1 September 2010. This critical work must be continued until those services are transitioned over to the follow-on contract. In accordance with FAR 52.217-8, Extension of Services, the Network Modernization contract was extended through 29 February 2012. This procurement action is to bridge the Network Modernization effort to SRA in order to provide the critical continuity of services.
· Current prime has the intimate knowledge and experience with the Joint Staff environment to be productive from day one. The Network Modernization contract scope of work is comprised of several network specific projects that this prime contractor has been performing for the past 18 months and has the in depth working knowledge of the Joint Staff networks. Given the short period of 90 days for this bridge contract, it would be unrealistic to award this to a different contractor and expect that any new vendors could acquire the necessary knowledge and familiarization of the Joint Staff networks to continue and complete these projects. Based on past experience with the changeover of contractors for this effort specifically: (1) January 2006 from FC Business Systems to L3 and (2) May 2009 from L3 to SRA, more than three months is required for any changeover. This past experience has shown that bringing in a different contractor would take an additional four months to obtain sufficient familiarization, training, understanding and experience within this dynamic environment prior to being able to plan, design and execute any projects associated with these crucial modernization efforts.
· SRA has expertise in this highly customized technical environment. The nature of the Joint Staff requires a vendor with working knowledge of the JS technical architecture, business processes and service organizations to effectively design, develop, and deploy capabilities rapidly across the Joint Staff. SRA has established effective coordination methods with organizations such as ITA and Defense Continuity Integrated Network (DCIN) who control JS ability to deploy servers, establish connectivity, apportion SAN space, provide server room access, and manage firewalls and connectivity. With a new vendor, the delivery of the above urgently needed capabilities to the Joint Staff would be significantly delayed. Given the POP of only 90 days, it is not expected that a new vendor would have time to become fully competent/performing.
· This extension effort is highly specialized because of the time constraints. The services are not unique or so highly specialized that they could not be performed by another contractor given an acceptable amount of time for transition. Due to the time constraints and need to avoid a break in service, only a vendor that is in place and can avoid disruptions associated with transitioning for the given short (90 day) effort are possible interested bidders.
5. COST/PRICE FAIR AND REASONABLE DETERMINATION: (FAR 16.505(B)(ii)(B)(5) The proposed costs will be thoroughly analyzed by the contracting officer and program team for a fair and reasonable determination. This analysis will include a comparison to the pre-established rates under the ENCORE II contracts and against the SRA’s DCAA approved Forward Pricing Rate Agreement. The total estimated value for this requirement is approximately $815.1K. The contracting officer will ensure that the costs are fair and reasonable for this effort. The contracting Officers has concluded that the order represents the best value that results in the lowest overall cost alternative (considering price, special features, administrative costs, etc.) to meet the Government's needs.
6. MARKET RESEARCH:
The incumbent contractor has intimate knowledge of the current projects in execution and of the unique JS network and architecture environment. During the first quarter of the FY12 we conducted Market Research from September through November 2011. We used the Small Business Administration Dynamic Search Tool and ThomasNet to identify two (2) small businesses (Vector Planning & Services, Inc. and Cornerstone Integration, Inc.) that could possibly perform the required services. However, after thoroughly researching the capabilities of these small businesses and comparing those to our requirements, neither appears capable of performing the required services. We have reviewed the capabilities of other vendors and have determined that there are other vendors who are capable of performing these services. However, SRA is the only vendor that is capable to perform in the given timeframe for the award and POP of the award. It would not be practical for any new vendors to perform for 92 days when much of that time will be consumed with transition. SRA is the only vendor (as the incumbent) with the intimate knowledge of the JS networks and is poised to continue with these critical projects between 1 March 2012 and 31 May 2012 while this effort is being recompeted in June 2012.
7. ANY OTHER SUPPORTING FACTS:
Due to the sensitive nature of the work of the Joint Staff and the criticality of the networks, an immediate solution is necessary. Without standardized applications, configurations and infrastructure, SRA has been required to expend additional hours and dollars to operate and maintain the diverse and complex environment to ensure the security of the JS network. Additionally, SRA has had outstanding performance in support of this effort. SRA was evaluated in a Command Cyber Readiness Inspection in January 2010 (CCRI) and scored the highest in DoD.
8. ACTIONS TAKEN TO REMOVE BARRIERS TO COMPETITION: (FAR 16.505(b)(2)(i)(B)) Our current Network Modernization contract was awarded as a sole-source to SRA International. We are in the process of recompeting this effort. In an attempt to remove barriers to competition, the Joint Staff will ensure the timely modernization of the networks for standardization and uniformity to allow for a competitive task order such that any vendor could compete for the operations and maintenance of the Joint Staff network. The effort that is performed as part of the Network Modernization contract will be integrated and become part of a larger IT contract recompete effort. The services from this recompete are scheduled to begin on 1 June 2012. If additional transition time is needed (for transition or award schedule slippage) order HC1028-08-D-2026-0004 will assume this work for another three months (1 June to 31 Aug 12) to provide for transition time prior to full performance under the coming competitive contract.
