JUSTIFICATION FOR AN EXCEPTION TO FAIR OPPORTUNITY

Upon the basis of the following justification, I, as the Procuring Activity Competition Advocate, hereby approve this exception to fair opportunity pursuant to the authority of FAR 16.505(b)(2)(i)(B).
1. REQUIRING AGENCY AND CONTRACTING OFFICE:

2. NATURE/DESCRIPTION OF ACTION(S): The purpose of this action is to issue a modification to American Systems Corporation’s (ASC) existing task order HC1028-08-D- 2001/0003 under the ENCORE II contract vehicle for an increase level of effort. The modification will be issued as firm-fixed-price for a 12 month period to provide the necessary critical database administration and information assurance (IA) technical expertise to support the configuration, upgrades, enhancements, integration, and testing and analysis of the infrastructure services for DSCA/SCES. Funding will be provided via FY 14 foreign military sales administration funds. The estimated life cycle value is $1,096,369.

3. DESCRIPTION OF SUPPLIES/SERVICES: The SCES program requires the following-additional information technology materials and services in option period 3 (September 30, 2014 through September 29, 2015):
Database Administration Support (task 5) In February 2014, the SCES program was re-base lined resulting in the Increment 1 deployment schedule being delayed by 11 months. As a result, additional database administration (DBA) support is required for the non-production environment during option period 3 to support the pre-initial operating capability (IOC) development and testing being conducted by the SCES development teams. This additional DBA support includes storage structure modification, storage area network administration and allocation, performance monitoring and tuning, master data management, and support for the transition of these services to the lifecycle support services contractor. Under the original contract award, the contractor was scheduled to be providing only sustainment support during option period 3.
Information Assurance (IA) Support (task 3) During option 3, contractor will provide additional IA deliverable support for the transition to Department of Defense Directive DoDD 8500.1 dated March 14, 2014. This transition to the risk management framework (RMF) is the result of a new DoD directive and was not a requirement anticipated at the time of award of the original contract. As a result of the delay in the SCES schedule, initial authority to operate (IATO)/authority to operate (ATO) for the program was delayed from March 2014 to late 2014 resulting in an unplanned requirement for continued IA support to obtain the IATO/ATO for the program.
4. SUPPORTING RATIONALE, INCLUDING A DEMONSTRATION THAT THE
PROPOSED CONTRACTOR'S UNIQUE QUALIFICATIONS OR THE NATURE OF THE
ACQUISITION REQUIRES USE OF AN EXCEPTION TO FAIR OPPORTUNITY:
(a) Exception to Fair Opportunity. The order must be issued on a sole-source basis as only one awardee is capable of providing the supplies or services required at the level of quality required because the supplies or services ordered are unique or highly specialized. Due to the interconnection between the on-going work and the proposed changes, only one awardee is capable of effectively providing the supplies or services required at the level of quality required.
(b) Description of the Justification.
The incumbent, ASC is currently providing service for both DBA support (Task 5) and IA support (Task 3) on an Oracle enterprise resource planning system (ERP) as outlined in the performance work statement. At the time of award and subsequent modifications, the government had planned to reach IOC during option period 2, anticipating sustainment level of support in option period 3. Due to the delays and new requirements discussed above, developmental efforts must continue into option period 3. The contractor responsible for the overall development of this program must continue support of the pre-IOC development and testing. These additional services in option period 3 are not severable from the on-going developmental efforts and extending efforts will avoid unacceptable risks during this critical pre-deployment period.

(c) Justification:
(1) Minimum Government requirements. The minimum requirements are advanced system engineering expertise of Oracle ERP DBA and IA support, to include access to ASC’s facilities and proprietary information necessary for troubleshooting managed infrastructure service issues, configurations and the other specialized services required by DoD.
(2) Proposed sole source contractor. ASC, 14151 Park Meadow Drive, Suite 500
Chantilly, VA 20151-4230.
(3) Discussion regarding cause of the sole source situation. At the time of award, program delays and additional IA requirements could not have been anticipated. Need for a sole source action is based upon the non-severable nature of the services from the on-going development efforts and extending efforts will avoid unacceptable risks during the critical pre- deployment period.
(4) Demonstration of unique source. This requirement is an increased level of effort in option period 3 to tasks already being performed under the current task order. These tasks are not severable from the existing tasks being performed by ASC and could not effectively be performed by another contractor without losing accountability for the entire program.
(5) Procurement discussion. ASC is the current SCES Hosting and Managed IT Support Services provider. Support of the requested increase in Oracle ERP DBA and IA support by another contractor is not feasible based on the additional time and expense that would be incurred by the Government.
(6) Impact: Not continuing DBA support into option period 3 of the pre-IOC development and testing being conducted by the SCES development teams will put the program at an unacceptable risk level during this critical pre-deployment period.
Without additional IA support during option period 3, the SCES Program will not be able to transition to the RMF as required by DoDD 8500.1 (dated March 14, 2014). Non-compliance with this new requirement will result in the program losing the authority to connect (ATC) and ATO. Successful completion of the DoD Information Assurance Certification and Accreditation Process and compliance with the SCES program schedule is essential to securing interim and final ATC to the Defense Information Systems Network which will be required for SCES.
