Program/Item: ACC VCE Support Services Estimated Dollar Value: $309.710.70
JUSTIFICATION AND APPROVAL
FOR OTHER THAN FULL AND OPEN COMPETITION
1. Contracting Activity: U.S. Army Contracting Command – New Jersey
2. Description of Action: The proposed acquisition will be a modification to Task Order HC1028-08-D-2006-ZP01 which was awarded competitively under the Defense Information Systems Agency’s (DISA) Encore II Indefinite Delivery Indefinite Quantity (IDIQ) contract to Data Systems Analysts Inc. (DSA), 10300 Eaton Place, Suite 500, Fairfax, VA 22030 on 2 August 2010. The proposed contract type for this action will be Firm Fixed Price and Time and Material modification. This action will extend the current task order for a period of twenty-nine (29) days from 1 September 2013 through 30 September 2013
3. Description of Supplies/Services: Virtual Contracting Enterprise (VCE) is a suite of knowledge-based, government developed, on-line contracting applications which standardize and automate the following contracting processes: Paperless Contract Files (PCF), Army Source Selection Interactive Support Tool (ASSIST), Contracting Officer Representative (COR) Tool, Contract Management (CM) Tool, Table of Distribution and Allowances (TDA), Procurement Data Warehouse, Business Intelligence (BI) modules and reporting, Dashboards, Adobe Smart Forms as well as Audio and Video training programs. These tools are used by Army Contracting Command (ACC) employees and other Department of Defense (DoD) employees in the preparation, execution, administration and management of Army, DoD and Federal contracts. Required services include process automation, application programming, technical support, integration/interface efforts and help desk staffing which are necessary to effectively sustain VCE business applications.
Task Order HC1028-08-D-2006-ZP01 requires an additional 29 days to the current performance period extending the period from 1 September 2013 through 30 September 2013. The extension of this task order is based on Federal Acquisition Regulation (FAR) clause 52.217-8 “Option to Extend Services”, which was included in the basic task order, but was not evaluated at the time of the award. Accordingly, in order to exercise the clause and extend the services under the Task Order for an additional twenty-nine (29) days, the action must fall within FAR Part 6.
Approval of this Task Order will allow sufficient time for award of the current re-compete of this effort without impact to Government operations. The total estimated value of this extension is $409,710.70.
4. Authority Cited: 10 U.S.C. 2304 (c) (1), as implemented by Federal Acquisition Regulation (FAR) 6.302-1(a) (2) “Only one responsible source and no other supplies or services will satisfy agency requirements.”
5. Reason for Authority Cited: The contractor personnel currently supporting this task order have been with the program for the past three years and are considered indispensible to the current mission. The current contractor is the only contractor who possesses the manpower and resources to provide the Web Support Services for the time required until award of the current re-compete. Continued support is imperative since the VCE automated contracting tools are utilized by ACC CONUS and OCONUS employees as well as Department of Defense (DoD) requiring activities and the Defense Contract Audit Agency in the accomplishment of their mission. Any break in service would result in mission failure.
6. Efforts to Obtain Competition: The ACC VCE business applications are currently being competed and are scheduled for award this fiscal year. Competition cannot be obtained for the twenty-nine (29) day extension of services since DSA is the only contractor who currently possesses the manpower and resources required to continue critical Web Support Services without a break in service A twenty-nine (29) day extension of services to the current Task Order on a sole source basis would provide the Government with the time required to award the new task order without an interruption in services.
7. Actions to Increase Competition: A competitive Request for Proposal was sent to all DISA ENCORE II vendors on 08 May 2013 and proposals were due on 10 June 2013. Although competitive source selection proceeding are currently in process, time constraints do not allow for the award of a competitive task order prior to the end of the current task order period of performance which is 01 September 2013. Award of a twenty-nine day (29) extension of services will allow for the award of a competitive task order by 29 September 2013.
8. Market Research: In accordance with the Market Research Report dated 28 December 2013, a review of mandatory sources and small business capabilities was conducted. A review of Computer Hardware, Enterprise Software and Solutions (CHESS) offerings indicated that although CHESS offers Information Technology Services, these services do not include the type of Computer System Design Services required for this effort. Additionally, there are currently no existing Army Contracts which can provide the type of Computer System Design Services required for this effort. Similar services are available thru General Services Administration (GSA) Schedule 70 contract holders however the requested services are available and have been previously procured thru an existing Department of Defense (DOD) DISA ENCORE II IDIQ contract, which is a preferred source.
Based upon the above market research, a request for information (RFI) was provided to all ENCORE II contract holders to determine current small business capabilities. Three contractors expressed interest in the requirement; one was a small business and two were large businesses. FAR 19.502-2(b)(1) states the KO must have a reasonable expectation that offers will be obtained from at least two responsible small businesses. Based upon the results of Market Research it was determined to be in the best interest of the government to solicit the requirement on an unrestricted basis to provide all twenty-six (26) DISA ENCORE II contract holders fair opportunity to submit a proposal.
9. Interested Sources: Based upon ongoing market research several sources are interested in the requirement. For this instant action, DSA is the only known source capable of realistically providing full performance of services during the extension period. The proposed contract action will be publicly synopsized through the Army Single Face to Industry (ASFI) in accordance with FAR 5.201.
