STANDARD PROVISION - 27 - APPROVALS AND PERMITS - AUG 2013

Contractor/Telecommunications Provider (TP) receiving this contract shall be responsible for having or obtaining all approvals and permits necessary to provide this service. A TP that does not currently hold all required approvals and permits may be deemed technically acceptable. The contracting officer will treat approvals and permits issues as a matter for contract administration. As part of any responsibility determination the contracting officer may determine, in their sole discretion, that a TP does not have the present ability to obtain required permits and approvals, and seek clarification from any TP, and disqualify a TP from award based upon lack of TP responsibility. Inability of Contractor/TP to obtain any such approval or permit during performance of any resulting contract shall not be a valid basis for not meeting service date or providing service.

Failure of a Contractor/TP to obtain any approval or permit necessary to provide this service may result in termination of this contract by U.S. Government for default at no cost to U.S. Government and/or receipt of a negative past performance rating.

ACCEPTABLE CONTRACTOR/TELECOMMUNICATIONS PROVIDER (TP) RESPONSE:

Paragraph M.14 STANDARD PROVISIONS, delete:

STANDARD PROVISION - 30 - CONTRACT PERIOD - AUG 2015

**This contract for this telecommunications service shall have an estimated contract period of 60 months.

However, this estimated contract period is not guaranteed. The minimum service period shall be one month.

Accordingly, after meeting minimum service period, U.S. Government may discontinue service, at no additional cost to U.S. Government. U.S. Government will provide Contractor/Telecommunications Provider (TP) 30 days notice prior to discontinuing service.

Quotes that do not accept the minimum one month service period may be excluded from the competition and found unacceptable. In the event U.S. Government is unable to obtain quotes that meet this minimum service period, U.S. Government may consider quotes with a minimum service period greater than one month.

** The estimated service life of 60 months shall begin on the date of award. It does not begin when the circuit is installed.

ACCEPTABLE CONTRACTOR/TELECOMMUNICATIONS PROVIDER (TP) RESPONSE:

“UNDERSTAND/WILL COMPLY.”

Paragraph M.14 STANDARD PROVISIONS, add:

PROVISION - 30 - CONTRACT PERIOD - SEP 2016

**This contract for this telecommunications service shall have an estimated contract period of 60 months.

However, this estimated contract period is not guaranteed. The minimum service period is one month.

Quotes that do not accept the minimum one month service period may be excluded from the competition and found unacceptable. However, the Government reserves the right to waive this provision for all quotes and consider quotes with a minimum service period longer than one month, when it is to the benefit of the U.S. Government. Thus, a Contractor/Telecommunications Provider (TP) may provide more than one quote, one at a rate that accepts the minimum one month service period, and others at rates that propose a different minimum service period. After meeting the minimum service period, U.S. Government may discontinue service, at no additional cost to U.S. Government. U.S. Government will provide Contractor/Telecommunications Provider (TP) a 30 day notice prior to discontinuing service.

**The estimated service life of 60 months shall begin on the date of award. It shall not begin when the circuit is installed.

ACCEPTABLE TELECOMMUNICATIONS PROVIDER (TP) RESPONSE: “UNDERSTAND, WILL

COMPLY”
