Limited Sources/Sole Source Rationale For all Requirements under $250K
1. REQUIRING AGENCY AND CONTRACTING OFFICE:
Requesting Agency:
Pacific Missile Range Facility 32 Miles West Kaumuali’i Hwy Kekaha, HI 96752-0128
Contracting Activity:
DISA/DITCO/PL712
477 Essex Street, Building 77, Suite 180 Pearl Harbor, HI 96860-5815
2. Procurement Title: Koke'e and Makaha Aerial Fiber Periodic Maintenance Funding Document Number: To determined Purchase Request Number: Same as funding document number Contract Number: To be determined Task/Delivery Order Number: N/A Estimated Value:
3. Statutory Authority: Only one responsible source and no other supplies or services will satisfy agency requirements, 10 U.S.C. 2304(c)(1). (FAR 6.302-1/DFARS 206.302-1).
4. Description of Action: The nature of this contractual action is periodic maintenance of an aerial fiber optic cable required to support data transport capabilities between Pacific Missile Range Facility (PMRF) Barking Sands main base site and PMRF’s remote instrumentation sites at Koke'e and Makaha Ridge. The fiber optic cable is owned by the Kaua'i Island Utility Cooperative (KIUC) and provides PMRF exclusive use of a portion of the fiber cable via an existing Memorandum Of Agreement (MOA).
Additionally, Per the MOA, the aerial fiber optic cable in the electrical space on KIUC transmission and distribution poles is solely owned and operated by KIUC. While KIUC reserves 60 of 72 strands of fiber contained within the ADSS aerial cable for PMRF use, the MOA states that the Government does not have any access to any of the poles, ducts, conduits, rights-of-way, or any utility property including the installed aerial fiber optic cable owned by KIUC. KIUC retains exclusive use of the remaining 12 of 72 strands.
5. Proposed Sole Source Contractor: Kaua'i Island Utility Cooperative (KIUC)
6. Market Research: As the sole owner of the fiber optic cable, and the owner of the majority of the infrastructure that the fiber cable is installed on, KIUC is the only source available to conduct the maintenance. KIUC is the only company with ownership and access rights to the poles, ducts, conduits, rights-of-way, and any utility property including the installed aerial fiber optic cable. No other options exist to go to another source to repair the KIUC-owned fiber optic cable. Going to another source would require installation of a new fiber optic cable at an exponentially higher cost than maintaining the existing cable, not to mention violating the MOA.
7. Upon the basis of the following justification, I, as the Contracting Officer, hereby approve this sole source justification for the proposed contract action pursuant to the authority cited above as the particular service is essential to the Government's requirements, and market research indicates other companies' products or services do not meet, or cannot be modified to meet, the agency's needs.
Based on the justification provided by PMRF, a determination has been made to issue a sole source solicitation for the above described requirement.
