JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION (OTFAOC)

Justification for OTFAOC Number: JA18-001

Upon the basis of the following justification, I, as Procuring Activity Competition Advocate, hereby approve the use of other than full and open competition of the proposed contractual action pursuant to the authority of 10 U.S.C.2304(c)(1).

1. REQUIRING AGENCY AND CONTRACTING OFFICE:

Requesting Agency:

Camp Lemonnier, Djibouti (CLDJ) N6 Communication Department, PSC 831 Box 0080

FPO, AE 09363

2. NATURE/DESCRIPTION OF ACTION(S):

(a) CLDJ N6 is requesting a new contract be created with a 1-year base plus four 1-year option periods to provide commercial telecommunications services at the Djiboutian Navy pier. This procurement will be awarded as a firm fixed price (FFP) contract with monthly invoices provided to CLDJ N6 with a breakdown of each line and usage for the Djiboutian Navy pier. Overseas Contingency Operations funds will be used to fund this contract.

(b) The period of performance (PoP) will consist of a 1-year base period and four, 1-year option periods for a total contract life cycle of five years. Fiscal year 2018 Overseas Contingency Operations funds will be provided via Military Interdepartmental Purchase Request for the base year. The applicable North American Industry Classification System code is 517919, All Other Telecommunications, with a size standard of $32,500,000. The

To account for any increases, a contingency funding line will be included that will provide for a surge on quantities needed. Lease of equipment and services quantities may change if additional units are added in option periods.

There will be a onetime use funding line included to fund the move the 89 POTs analog lines from the copper demarcation to the MSAN (fiber to copper interface) unit presently located in the 650 Compound once the work is 100% complete. This will bring all lines to the standard as set forth in this PWS. Currently, 11 of the 89 have already been moved leaving the remainder 78 lines to be moved to the fiber solution. Once completed, one hundred and fourteen (114) commercial telephone lines in use by CLDJ N6 are on Fiber Optic Cable. All numbers will be included in an attachment for numbers associated with CLDJ.

Contractor will need to be able to provide, upon award, a wiring diagram (cut sheet) to CLDJ N6 showing the cable pair interface between the channel cards of the MSAN and the 32 pair EU standard backplane. The present wiring of the backplane cross connects to the camp infrastructure were installed opposite of normal installation standards of left to right and due to United Status standards not being followed has made troubleshooting difficult at the technical control facility (TCF) compound and having the wiring diagram is a necessity.

Performance Requirements: Contractor shall provide all labor and materials necessary to supply commercial Dial Central Office (DCO) dial tone services in support of requirements for voice network access to the public switch telephone network (PSTN).

Contractor shall provide and maintain one hundred and fourteen (114) PSTN telephone lines/numbers to the commercial demarcation located at the MSAN demarcation in the TCF compound. Contractor shall provide and maintain additional lines that the Government may require during the base period and option periods of performance. The decision to increase capacity will not be automatic and will be the decision of the Government.

Commercial Connectivity: The contractor is responsible for maintaining connectivity from the DCO to the contractor side of the termination block at the MSAN demarcation in the TCF compound. The government is responsible for extending service from the government side of the termination block at the MSAN demarcation in TCF compound to the customer jack on the wall within the confines of Camp Lemonnier, Djibouti.

Plant Documentation: The contractor shall maintain accurate and legible cable pair and associated telephone number assignment records in hard copy and Microsoft Office compatible electronic format, using best commercial practices. Records shall be made available to the specified Technical Point of Contact (TPOC), other government personnel appointed by the TPOC, or the government personnel holding the position of the TPOC (due to the turnover of personnel in a deployed environment), when service is initially established and whenever changes occur thereafter.

Trouble Shooting Assistance: Contractor shall provide troubleshooting assistance via telephone or on-site when service related problems occur.

a. Telephonic support is defined as a Technical Service Center (TSC) available twenty-four hours per day, seven days per week to provide remote monitoring, testing and diagnostics capability.

b. On-site routine technical support shall be available for non-emergency service, during duty hours (0800 through 1700, Sunday through Thursday), excluding United States or Djibouti national holidays.

c. On-site emergency technical support shall be available 365 days per year. After Government initiation of a service request for on-site emergency diagnostic support, the contractor shall respond no later than four (4) hours after notification.

4. IDENTIFICATION OF STATUTORY AUTHORITY: Only one responsible source and no other supplies or services will satisfy agency requirements, 10 U.S.C.2304(c)(1). (FAR 6.302-

1/DFARS 206.302-1).

5. DEMONSTRATION OF CONTRACTOR’S UNIQUE QUALIFICATIONS: Djibouti Telecom S.A. is the only provider for commercial telephone and internet services in the country of Djibouti. Our analysis has determined that a new contract with this company is the most advantageous method in fulfilling the Government’s needs.

(a) Description of events.

Djibouti Telecom is the only provider of commercial phone services in Djibouti and Eastern Africa. There are no other local vendors that provide commercial telephone services in Djibouti City, Djibouti.

(b) Justification.

(1) Minimum Government requirements. The minimum government requirement consists of commercial telecommunications dial tone services to Camp Lemonnier, Djibouti.

CLDJ has tailored this minimum requirement to the following specification:

a) Provide and maintain one hundred and fourteen (114) PSTN telephone lines/numbers to the commercial demarcation located at the MSAN Demarcation in the TCF compound at Camp Lemonnier, Djibouti.

b) Maintain connectivity from the DCO to the contractor side of the termination block at the MSAN demarcation to the demarcation in the TCF compound.

c) Provide commercial Dial Central Office (DCO) dial tone services in support of requirements for voice network access to the public switch telephone network

(PSTN).

d) Provide and maintain additional lines that the Government may require during the base and option periods of performance.

e) Provide troubleshooting assistance and technical support for routine, after hours, and emergencies.

(2) Proposed sole source contractor. Djibouti Telecom is the proposed sole source contractor. Djibouti Telecom is the Djibouti government-run telecommunications company based in Djibouti City, Djibouti. Djibouti Telecom is the sole provider of telecommunications services for landline, mobile and internet services to the general public. Djibouti Telecom has provided the United States Navy (USN) N6 Camp Lemonnier Djibouti (CLDJ) with Lease, Usage, and Caller ID service of Commercial Telephone lines for the past 4 years.

(3) Procurement discussion. The Government has done due diligence to conduct extensive market research to determine if there are changes in the marketplace that would enable competitive actions, i.e. there are similar products and/or product support in the marketplace that provides the same functionality, the original equipment manufacturer releases ownership rights of product, or it is economically feasible to procure a new system. During discovery, it has been found that no other company in the country of Djibouti and, for that matter, all of Eastern Africa can provide the specific needs and services identified.

Djbouti Telecom is the Djibouti Government-run company that provides landline, mobile and internet services to the general public and has been delivering telecommunications services to Camp Lemonnier, Djibouti. The initial contract N68171-12-C-C006 was awarded in 2012 and administered by the Navy Supply (NAVSUP) Fleet Logistics Center Sigonella in Naples, Italy. The procurement came to DISA in 2013 and in June of the same year, DITCO awarded contract HC1021-13- P-0009 to Djibouti Telecom under full and open competition. In September 2017, a sources sought for the follow-on was posted on FedBizOpps. Three potential contractors responded, but they were determined not able to provide the requested dial tone telecommunications services required by CLDJ. Therefore, this effort will be a stand-alone sole source contract to Djibouti Telecom using open market procedures.

(4) Impact. Telecommunications in Djibouti falls under the authority of the Ministry of

Communication and Culture. If another company would provide services, they would have to obtain a national authorization from the Government of Djibouti and a license agreement with Djibouti Telecom; therefore an increase in cost will occur. Foreign licenses and national authorization approvals could be a lengthy process. Our timeline does not lend itself to wait for a license agreement to be in place as this is a lengthy process and can take years.

6. FEDBIZOPPS ANNOUNCEMENT/POTENTIAL SOURCES: A synopsis of this action will be published on FedBizOpps website, as required by the FAR in accordance with FAR Subpart 5.2.

A redacted J&A will be posted with the solicitation when posted to FedBizOpps. CLDJ conducted an informal analysis for market research utilizing contact with other knowledgeable individuals in Government (other military members and contractors at Camp Lemonnier who are familiar with the environment) regarding market capabilities. In addition, a sources sought was posted on FedBizOpps on September 6, 2017 with responses due on September 28, 2017. Three interested companies responded; however, all three companies did not demonstrate their ability to perform the services required of this acquisition. An additional eight companies expressed

Contract Period: 1 July 2013 - 31 December 2017, consisting of a one-year base period plus three (3) one-year options and a 6 month extension pursuant to FAR 52.217-8, Option to Extend Services Type of Acquisition: Full and Open Competition

(b) CLDJ N6 conducted proper market research as well as have verbal confirmation from both U.S. Embassy, Djibouti and Staff Judge Advocate (JAG) offices that can back up the claim of the sole propriety of the only telecommunications company offering these services in the country of Djibouti. Unless another company can get a Service Level Agreement with Djibouti Telecom, they cannot offer the same service.

12. REFERENCE TO THE APPROVED ACQUISITION PLAN (AP): In accordance with Defense Acquisition Regulation Supplement 7.103(S-91)(1)(vii), an AP is not required.
