MOD 02

Upon the basis of the following justification, I, as Procuring Activity Competition Advocate, hereby approve the use of OTFAOC of the proposed contractual action, pursuant to the statutory authority of Section 4202 of the Clinger-Cohen Act of 1996. The regulatory authority is FAR 6.302-1, Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.

6. FEDBIZOPPS ANNOUNCEMENT/POTENTIAL SOURCES:

A synopsis for this action will be published on the Federal Business Opportunities (FedBizOpps) website, as required by FAR 5.201. The synopsis will completely identify the Government’s minimum mandatory requirements.

7. DETERMINATION OF FAIR AND REASONABLE COST:

The contracting officer will perform an evaluation of the offeror’s proposal and proposed costs to ensure the costs are fair and reasonable, based on comparison with the cost or prices outlined below. The contracting officer will also determine the pricing information valid for comparative purposes. Certified cost or pricing data is not required for this commercial acquisition, in accordance with FAR 15.403-1(b)(3). Proposal pricing of the sole-source provider will be compared with the following pricing information:

a. Commercial price list or published market prices for the service.

b. Independent Government cost estimate pricing for the required support renewal.

8. MARKET RESEARCH:

a. Market research was performed from August 2013 through April 2014 by DISA team members. Market research was conducted with a request for information (RFI) issued as part of the COMSATCOM Tiger Team Study, interviews with current COMSATCOM service providers, discussions with satellite communications subject matter experts within both the DoD and industry, and online research.

b. The first step taken in conducting market research was to review responses from the RFI, “Measuring Utilization of Bandwidth,” issued in October 2013 by DITCO in support of the COMSATCOM Tiger Team Study. The RFI was issued to only current future commercial satellite communication services acquisition (FCSA) contractors, but in the RFI responses, it was identified that bandwidth monitoring was conducted either by sub-contracting for that service with SAT Corporation or it would require the FCSA contractors to make an investment to deploy their own suite of monitoring equipment and software. No other contractors were identified, other than SAT Corporation, that provide spectrum monitoring and bandwidth utilization as a commercially available service. Since the DoD leases approximately 7 GHz of COMSATCOM bandwidth on 50 satellites globally, it was determined that it would be cost prohibitive for the DoD to make the investment for an organic bandwidth monitoring capability.

c. The second step in conducting market research was to determine a method of procurement. Market research revealed that the required services are not available through existing Government contract vehicles. The support is not available through a General Services Administration Federal Supply Schedule, National Aeronautics and Space Administration Solutions for Enterprise-Wide Procurement contract, or any other Government contract vehicle.

9. ANY OTHER SUPPORTING FACTS:

None.

10. LISTING OF INTERESTED SOURCES:

SAT Corporation expressed an interest in the procurement. As stated in Paragraph 6, above, a synopsis will be published on the FedBizOpps website, as required by FAR 5.201.

11. ACTIONS THE AGENCY MAY TAKE TO REMOVE OR OVERCOME BARRIERS

THAT LED TO THE EXCEPTION TO FULL AND OPEN COMPETITION.

a. Procurement History. None.

b. If the Government’s required functionality changes, then the Government will seek full and open competition.

12. REFERENCE TO THE APPROVED ACQUISITION PLAN (AP):

An approved AP is not required for this acquisition.
