Note 1: See guidance at the end of this document for completing the following sections.

Note 2: Each field will expand automatically if additional space is needed.

I. Contracting Activity.

Air Force Air Force Installation Contracting Agency (AFICA) 773/ESS on behalf of the Air Force Medical Service (AFMS) 1940 Allbrook Drive, Building 1, Wright-Patterson AFB, OH 45433-7401

II. Nature and/or description of the action being processed.

This is a Justification for Other Than Full and Open Competition describes the need for a Decentralized Blanket Purchase Agreement (BPA) for non-personal services for the Hazardous Material (HazMat) Infrared Detector (ID) Elite, manufactured by Smiths Detection, Inc., the Original Equipment Manufacturer (OEM). The anticipated BPA number will be FA8052-16-A-0013 and awarded to Smiths Detection Inc.

The HazMatID Elite is used by the Bioenvironmental Engineer (BEE) teams as a first responder capability for the detection and identification of various hazardous material classes under the Air Force Medical Service (AFMS) Home Station Medical Response (HSMR) mission.

This is a follow-on requirement to the existing contract FA8052-13-D-0012 (T.O.s 0002 and 0003), previously awarded to Federal Resources Supply Company. This contract was awarded to Federal Resources Supply previously due to the OEM, Smiths Detection, stating that they were not accustomed to performing the tracking, shipping, and administrative duties required in the Performance Work Statement (PWS) accompanied withFA8052-13-D-0012.

Therefore, the contract was awarded to Federal Resources Supply who handled the tracking, shipping, and administrative duties while the Smiths Detection performed the maintenance as a subcontractor. The updated PWS for this requirement states that the Government will be performing the tracking, shipping, and administrative duties.

Therefore, there is no longer a need to utilize Federal Resources Supply as a "go through" company for this requirement.

III. Description of supplies/services required to meet agency needs.

The contemplated BPA will streamline the acquisition process for frequently required maintenance/repair services.

The contractor shall furnish the necessary personnel, materials, facilities and OEM certified technicians to perform a comprehensive method of maintenance and repair of the HazmatID Elite, part number 029-1001-G1 to include technical inspection and diagnostics evaluation on HazMatID Elite unit(s) sent to the contractor's service facility and return shipment of the unit(s). The Contractor will determine the scope of repair(s) and provide a quote outlining the service; to include parts and labor, necessary to return the unit to full OEM operational status. The Contractor will then conduct Preventive Maintenance Checks and Services (PMCS) to ensure units are returned to fully operational status.

The estimated value of the BPA for the entire three year period is . The estimated period of performance is 18 September 2016 to 17 September 2019. The type of appropriation used to fund these requirements for all contract periods are O&M.

The maximum estimated quantities for repair of the HazMatID Elite, part number 029-1001-G1 are as follows for each contract period:

Due to the nature of these repairs, one BPA call will be used for the evaluation of the units and another BPA call will be required for the repair portion. This ensures that the authorized caller has time to review the evaluation quote and determine that the amount of labor hours quoted are reasonable. All rates and prices for labor and parts will

[ Enter security markings here -- or delete this text. ] Page 4 of 6 be in the price list, which will be attached to the BPA upon award.

IV. Statutory authority permitting Other than Full and Open Competition.

This requirement is excluded from competition requirements under the authority of 10 U.S.C. 2304(c)(1), as implemented by FAR 6.302-1, Only one responsible source and no other supplies or services will satisfy agency requirements.

V. Demonstration that the contractor's unique qualifications or nature of the acquisition requires the use of the authority cited above (applicability of authority).

As the OEM, Smiths Detection, Inc., is the only company that can maintain, service and repair their proprietary equipment and software for the HazMatID Elite unit, part number 029-1001-G. The OEM is the only company that has the certified technicians to perform these services and no other companies. Smiths Detection has stated they will only sell replacement parts to the equipment owners.

If the Government were to replace the units instead of repairing them, it would cost $53,750.00 per unit, which would amount to $2,902,500.00. This price is based on pricing listed on the GSA Contract GS-07F-081DA held by Smiths Detection Inc. for new units. With that said, maintaining and servicing these units would be most advantageous for the Government.

VI. Description of efforts made to ensure that offers are solicited from as many potential sources as practicable.

The proposed action will be synopsized in accordance with FAR 5.203 for the required time frame in FAR 5.203(a).

The intent to award sole source will be publicly available in accordance with FAR 5.203(a) via the Government Point of Entry (GPE) on FedBizOpps. Pursuant to FAR 5.102(e), copies of the solicitation issued under other than full and open competition will be provided to firms requesting copies that were not initially solicited, but only after advising the requester of the determination to limit the solicitation to a specified firm or firms as authorized under FAR Part 6. All responsible sources may submit a capability statement, proposal, or quotation, which shall be considered by the agency.

Other Actions: Pursuant to FAR 5.301(d) and FAR 6.305, for other than full and open competition, the agency shall make publicly available within 15 days after the contract award, the J&A required by FAR 6.303-1, as required by 10 U.S.C. 2304(1) and 41 U.S.C. 3304(f). Any interested vendors capable of providing services for possible future efforts will be encouraged to submit a capabilities statement to the contracting officer.

VII. Determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.

The Contracting Officer will determine the price to be fair and reasonable based on price analysis of the labor rates, parts listing, profit on labor, and technical inspection rates. The price analysis will be accomplished using

[ Enter security markings here -- or delete this text. ] Page 5 of 6 procedures listed in FAR 13.106-3(a) which include, but are not limited to, a comparison against available historical pricing, published price lists and other Government Agency invoices to determine price fair and reasonable. In accordance with FAR 15.403-1(b)(3) and (c)(3), a Certificate of Current Cost or Pricing Data will not be required at conclusion of negotiations though other than certified cost and pricing data will be obtained if needed.

A new price fair and reasonable determination will be accomplished whenever the price list is updated, but at least annually for the duration of the period of performance.

As stated above, due to the nature of these repairs one BPA call will be used for the evaluation of the units and another BPA call will be required for the repair portion. This ensures that the authorized caller has time to review the evaluation quote and determine that the amount of labor hours quoted are reasonable. All rates and prices for labor and parts will be in the price list, which will be attached to the BPA upon award.

VIII. Description of the market research conducted and the results, or a statement of the reasons market research was not conducted.

IX. Any other facts supporting the use of Other Than Full and Open Competition.

Maintenance, service and repairs can only be performed by their certified technicians to void any warranty or recertification fees due to their proprietary equipment and software.

In an attempt to enhance competition, this market research, as a minimum, will include discussions with the user to identify any changes in the market place, contacting and meeting with any potential new vendors, and speaking with the OEM in regards to certifying other companies to work on their units.
