THE FEDERAL BUREAU OF PRISONS

NATIONAL ACQUISITIONS SECTION

JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION

(>$3,000 and <$150,000)

This procurement is being conducted in accordance with the ordering procedures in the Federal Acquisition Regulation (FAR) Section 13.106-1(b) (1) (i) and the Bureau of Prisons Acquisition Policy Subpart 6.304(a), the Federal Bureau of Prisons has determined the use of other than full and open competition procedures is justified for this procurement action. The following is supporting documentation formatted in accordance with FAR subsection 6.303-2, for clarity, but not required as stated in FAR Section 13.501 (a) (1).

1. Identification of the agency and the contracting activity - U.S. Department of Justice, Federal Bureau of Prisons (Bureau), Central Office, Administration Division, Acquisitions Branch, National Acquisitions Section (NAS) .

2. Nature and/or description of the action being approved - This action is to issue a sole source indefinite delivery type contract so the Bureau may continue receiving Healthcare Accreditation Services. The current contract DJBP0700NASBPA052 expires on May 31, 2015. This new contract will allow the Bureau to continue to receive these services during the solicitation phase for a new 5-year contract vehicle. The contract period of performance is for seven months from June 1, 2015 through December 31, 2015.

3. A description of the supplies or services required to meet the agency's needs including estimated value - The Health Services Division (HSD) requirement is for the services required to enable the continued evaluation of the Bureau's healthcare programs by a nationally recognized, external source that has accreditation standards applicable to the scope of medical services provided at Bureau institutions.

The continued accreditation will ensure quality of care to the inmate population and compliance with program review and ACA standards. The Bureau currently provides healthcare to more than 210,000 inmates in more than 100 institutions geographically dispersed throughout the contiguous United States, Hawaii, and Puerto Rico.

5 .

An identification of the statutory authority permitting other than full and open competition - The statutory authority permitting other than full and open competition is 41 U.S.C. It has been determined the use of this authority is appropriate pursuant to FAR 13.106-1(b) (1) (i).

"Contracting officers may solicit from one source if the contracting officer determines that the circumstances of the contract action deem only one source reasonable available (e.g., urgency, etc.)"

A demonstration that the proposed contractor's unique qualifications or the nature of the acquisition requires use of the authority cited. - The Joint Commission survey is valid for 36 months. The initial accreditation and a reaccreditation are required between 36 and 39 months to continue with accreditation without any lapse. The Bureau has 19 institutions scheduled for the accreditation process in 2015. The survey ensures compliance in various areas of Bureau Healthcare, which includes the environment of care, human resources, infection prevention and control, emergency management, leadership, medication management, information management, provision of care, treatment and services, performance improvement and national patient safety goals.

The continued accreditation process with the current vendor will ensure the 19 institutions scheduled for accreditation in 2015 will not lapse and require reaccreditation at a much high cost to the Bureau. It will ensure quality of care to the inmate population and compliance with program review and ACA standards. The accreditation will also reduce Bureau risk in medical legal cases and the Joint Commission standards which are followed by the community organizations nationwide.

The Bureau previously extended the contract which expires May 31, 2015. The seven month period of performance should allow for a Request for Contract Action to be processed, a solicitation announced for the requirement and a new contract award. The Healthcare Accreditation Services must be provided by an accredited organization. The Bureau does not have these services available within the agency.

6. A description of efforts made to ensure that offers are solicited from as many potential sources as is practical, including whether a notice was or will be publicized as required by Subpart 5.2. - The Contracting Officer will publish the Justification for Other than Full and Open Competition on the Federal Business Opportunities website, FedBizOps.gov, in accordance with FAR 13.501(a) (1) (iii).

7. A determination by the contracting officer that the anticipated cost to the Government will be fair and reasonable - Based on the historical acquisition data, the Contracting Officer has made the determination that the proposed price is fair and reasonable.

8. A description of the Market research conducted and the results or a reason market research was not conducted - Based on the historical acquisition data and a list of companies in the market, the Contracting Officer has made the determination that since there are a sufficient number of vendors capable of bidding on a future solicitation the current need must be acquired immediately without interruption of services.

9. Any other facts supporting the justification - Continuing the Healthcare Accreditation Services with the current vendor is beneficial and necessary so there will not be a lapse in the accreditation process for the 19 institutions scheduled for 2015. The seven month contract would allow for the RCA to be processed and a solicitation announced for a new requirement.

This acquisition of accreditation services will ensure continued quality of care to the inmate population and compliance with program review and ACA standards. The accreditation will also reduce the Bureau's risk in medical legal cases and other risk management issues.

10. A listing of sources, if any, that expressed, in writing, an interest in the acquisition. The contractor for Healthcare Accreditation Services is as follows:

The Joint Commission One Renaissance Boulevard Oakbrook Terrace, IL 60181

I I i i

11. A statement of the actions, if any, the agency may take to remove or overcome any barriers that led to the exception to fair opportunity before any subsequent acquisition for the supplies or services is made - For the reasons previously made, no actions are available which could remove competition barriers for the required services at this time. However, the Bureau is in the process of preparing a solicitation for a competitive 5-year contract vehicle for these services.

In addition, the Contracting Officer will publish the Justification for other than full and open competition on the Federal Business Opportunities website, www.fedbizopps.gov, in accordance with FAR 13.501
