DEPARTMENT OF VETERANS AFFAIRS

Justification for Single Source Awards IAW FAR 13.106-1 For

Over Micro-Purchase Threshold but Not Exceeding the SAT ($250K)

Acquisition Plan Action ID: 36C242-22-AP-2850

1. Contracting Activity: Department of Veterans Affairs, Network Contracting Office 02, located at James J. Peters VA Medical Center 130 West Kingsbridge Road, Bronx, NY 10468 in support of VA Northport Medical Center Police Service, seeks to purchase Brand Name Harley Davidson motorcycles equipped with police package with 2237# 632-22-4-3085-0106 funded action.

2. Brief Description of Supplies/ Services required and the intended use/Estimated Amount:

The proposed action is for approval to compete as a small business set-aside, firm-fixed price, open market award for brand name Harley Davidson motorcycles for Northport VAMC. The required motorcycles are to be used for training new officers for their certification, patrol of medical center grounds, motorcade escorts, community events and funeral processions. The motorcycles are equipped with sidecar kits for protective support.

These motorcycles are currently being utilized at Northport and this purchase will ensure a consistency of standardized appearance, performance, training and parts with all motorcycles at the medical center.

The estimated amount for the procurement:

3. Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used:

Harley-Davidson brand motorcyles is considered the gold standard when it comes to training officers in the field and puts a special emphasis on getting accustomed to the H-D ABS breake system and corning technology. Police motorcycles have very unique characteristics compared to civilian motorcycles. The combined center of gravity on a police motorcycle is much higher than civilian motorcycles, since officers sit up much higher on the seat to provide more maneuverability. The clutches are heavy duty and tires have a special bead that is designed to come off the tire in a wreck or deflation situation. They have much more power than civilian models because of the special components in the motor. This is a critical component. Northport VAMC would have to duplicate inventory of spare parts at additional expense in order to maintain the fleet and require additional training of the officers on new motorcycles if another motorcycle was purchased, this would not be cost effective. Harley-Davidson motorcyles is a sole source product: manufactured, sold and distributed by Harley-Davidson distributors. All upgrades/repairs is completed solely by

4. Description of market research conducted and results or statement why it was not conducted:

Market research was conducted, which included searching Veterans Information Page (VIP), GSA E-buy, SBA Small business dynamics (DSBS), VANAC, Contract Opportunities, SAC mandatory contracts, Non-expendable (NX) equipment and ECAT. The VIP results showed that there is one (1) potential vendor capable of providing the motorcycles. The search results in SBA, VANAC, ECAT, NX and SAC showed zero (0) potential sources. CO posted a sources sought notice in GSA E-buy on 08/12/2022 through 08/17/2022 on RFQ#1579719 and contract opportunities on 08/17/2022 through 08/23/2022 under source number 36C24222Q1116. The results yielded one (1) response from ( ), a small business on GSA E-buy and three (3) positive responses from ( from contract opportunities. was offering a different brand of motorcycle. The three responses from contract opportunities are providing the exact same motorcycle needed for the requirement. Since this is for a brand name motorcycle, CO believes a small business open market set-aside would be in the best interest of the Government for price fair and reasonable.
