Exception to Fair Opportunity Justification and Approval
Advanced Technology Support Program III (ATSP3) Indefinite Delivery / Indefinite Quantity
(lD/IQ) Task Order Contract
I. Contracting Activity
Defense Microelectronics Activity, Contracting Office (DMEA/MEE), McClellan, CA
II. Nature and/or Description of the Action Being Approved:
This is a follow-on contracting action.
Delivery Order 76 (CET 11-137) on the IDIQATSP3 contract, H940O3-04-D-0002 (BAE), developed and designed a state-of-the-art sensor device from advanced scope technology. The work accomplished on this Delivery Order has been very successful. As a result, the requiring activity (Naval Health Research Center) now wishes to further develop this system for frontline combat applications facilitating diagnostic determinations under adverse frontline, day/night conditions. NHRC seeks to modify existing systems to characterize relevant sensor signatures and to optimize processing algorithms for combat applications. Technically speaking, the requiring activity wishes to further integrate this device into a system including computer automation. This follow-on task (CET 12-208) also provides more advanced algorithm development and characterization based on observations at the University of California at Davis.
Advanced sensor systems offers self-contained light-weight systems that are extremely sensitive prototypes consisting of a digital sensor system capable of close range focus demonstrating specific battlefield applications in real-time. A set of algorithms loaded on a laptop PC will also be available to support data capture, algorithm development, and system demonstration. The award will be funded using NHRC FY11 RDT&E funds. The estimated ceiling for this contract is $736,505.00 for the basic. This project is fully funded.
III. Description of the Supplies/Services or Nature of Construction: In this effort, the contractor will provide expertise in science and technology as well as professional knowledge of infrared sniper scope and applied technology.
IV: Authority Cited: FAR 16.505(b)(2)(i)(B) Only one awardee is capable of providing the supplies or services required at the level of quality required because the supplies or services ordered are unique and highly specialized.
V: Reason for Authority Cited: BAE has completed a previous effort for DMEA on contract number H94003-04-D-0002-0076, under which all ATSP3 awardees were given a fair opportunity to be considered. BAE was the only contractor to propose and they provided superior results. Moreover, BAE possesses the proven background, knowledge and experience crucial to continue this outstanding level of research support. Their depth and breadth of experience in this area is extensive. Furthermore, BAE has repeatedly proven its ability to tap a deep pool of knowledge and experience in the requisite functional areas directly and indirectly related to the task at hand. As a consequence, award to any other source would negatively impact both cost and schedule, potentially negating our ability to perform these requisite tasks on schedule.
RELATIONSHIP TO PREVIOUSTY PERFORMED CONTRACTS: This is a follow-on task to CET 11-137.
RATIONALE FOR SOLE SOURCE AWARD: BAE's unique skills and experience derived from their work on CET 11-137 make them uniquely qualified to further develop this research and development effort. Using another vendor would waste government capital and hamper both cost and schedule.
OTHER ATTERNATIVES CONSIDERED: None
IMPACT IF THIS J&A IS NOT APPROVED: Since BAE developed a proof of concept on the original order that was highly successful, redundant efforts could cause the Government unnecessary risks in the areas of schedule, technical and cost if this J&A is not approved.
VI. Effort to Obtain Competition: None.
VII. Actions to increase Competition: None.
VIII. Market Research: Market research has been conducted through contacting knowledgeable individuals in Government and performing internet inquiries. BAE was the only contractor found with the previous expertise in this specialized area.
IX. Interested Sources: BAE Systems & information and Electronic Systems integration, 65 Spit Brook Road, Nashua, New Hampshire 03051-0858.
X. Other Facts: None.
