LIMITED SOURCES JUSTIFICATION AND APPROVAL FOR
FEDERAL SUPPLY SCHEDULES ORDERS EXCEEDING THE SIMPLIFIED
ACQUISITION THRESHOLD
FAR 8.405-6
This acquisition is conducted under the authority of the Multiple-Award Schedule Program and 48 CFR, Chapter 1, Subchapter B, Section 8.405-6(a)(1)(i)(B).
(i) Identification of the agency and the contracting activity and specific identification of the document as a limited source justification.
Agency: General Services Administration
Office of the Chief Information Officer
1275 First Street, N.E.
Washington, DC 20417
Contracting Activity: General Services Administration
Office of Administrative Services
Internal Acquisition Division (H lEA)
1800 F Street, NW
Washington, DC 20405
Procurement Request Number: PR201306170004
LSJ Number: IAD-LSJ-13017
(ii) Nature and/or description of the action being approved.
The proposed action is to award a task order on a sole source basis against General Services
Administration (GSA) Multiple Award Schedule (MAS) 70, Information Technology
Professional Services (SIN 132-51), for continuity and continuation of GSA Infrastructure
Technology Global Operations (GITGO) support services to the GSA Office of the Chief
Information Officer (OCIO).
Proposed Contractor: Catapult Technology, Ltd.
7500 Old Georgetown Road, 11th Floor
Bethesda, MD 20814-6198
MAS Contract Number: GS-35F-0401N
DUNS: 958045346
(iii) A complete description of the supplies and/or services required to meet the agency’s needs.
The GSA OCIO requires uninterrupted continuation of GITGO support services to sustain day-to-day operations and maintenance of GSA’s IT Infrastructure systems and services during transition to the new GSA Technology Operations (GTO) contract. Specifically, services will provide for uninterrupted support and continuity of GITGO services in the areas of Program Management, Client Management Services, Enterprise Help Desk Support, Local
Support, Network Operations, and Transition Phase-Out Support.
The sole source task order will provide the necessary management and subject matter expertise required to (1) maintain a reliable, scalable, and available IT infrastructure to support GSA global operations and mission critical business transactions, (2) maintain comprehensive desktop and device management, and (3) sustain responsive service levels to over 15,000 GSA end-users.
The sole source task order will have a 10-day base period to complete scheduled transition by July 19, 2013 and two 45-day options for continuity of services in the event transition is delayed; the task order will include FAR Clause 52.217-8 Option to Extend Services for up to six months extended services. The Option to Extend Services will allow multiple extensions in smaller increments of time, as needed, to maximizing task order flexibility. The overall duration of the term of the task order should all options be exercised is 9 months and 10 days beginning July 10, 2013 through April 17, 2014. The task order will be a Hybrid Time-and-Materials Labor Hour and Firm-Fixed-Price contract type and based on the Independent
Government Cost Estimate will cost $42,448,868.00.
(iv) An identification of the LSJ rationale, and if applicable, a demonstration of the contractor’s unique qualifications to provide the required supply or service.
The authority permitting other than full and open competition is FAR Subpart 8.405-
6(a)(1)(i)(B) - Only one source is capable of responding due to the unique or specialized nature of the work.
A. GSA awarded the "GSA Technology Operations" (GTO) task order under the GSA
Alliant Small Business GWAC to AAC, Inc., on February 27, 2013. The GITGO-to-GTO transition commenced at award but was delayed 55-days due to a GAO protest. GAO dismissed the protest, GSA has taken corrective action and the GITGO-to-GTO transition activities resumed with a planned completion date of July 19, 2013. The
GITGO task order expires July 09, 2013, prior to transition completion. Overlap between the GITGO contract and the GTO contract is critical to complete transition activities that will ensure a seamless transition.
B. The proposed sole source task order is a stopgap measure to ensure mission critical infrastructure and end-user support services currently delivered under the expiring GITGO task order remain uninterrupted while services are transitioned to the new GTO task order. GSA intends to discontinue services under this task order following completion of the GITGO to GTO transition.
C. Only Catapult Technology, Ltd. Is capable of providing these continuous support services due to the unique or specialized nature of the work. Catapult
Technology, Ltd. has successfully performed the full spectrum of GITGO services for over 6 years. As the incumbent contractor, they are the only known contractor with the required knowledge, experience, qualifications, and security clearances to perform the requirements. They have the expertise and hands-on knowledge to sustain current GITGO operations without interruption and are the only source capable of transitioning services, which is currently ongoing in conjunction with AAC, Inc.’s Transition-In Plan.
D. A competitive acquisition is not feasible as only the incumbent is capable of performing during this transition period as the phasing out contractor. Even if this were not the case, a competitive acquisition would result in substantial duplication of cost to the Government that is not expected to be recovered through competitive award of a short-term support services task order. Seeking competition for the interim period during transition to GTO is not possible and would significantly increase program risk and result in schedule delays and degradation in infrastructure services that support GSA global operations and mission critical business systems. A requirement of this magnitude and complexity would require a minimum of six (6) months to plan, solicit, evaluate, negotiate, and award a short-term task order. Such costs include the time of technical, contracting, and legal personnel to support a short-term competitive task order; the costs and risks associated with multiple contractor transitions, learning curves, and operational inefficiencies; and increased government management and oversight of multiple contractor transitions. It is neither cost effective nor realistic to expect another contractor to meet logistical requirements for worldwide support and achieve full operational capability to perform these services for the relatively brief interim period. It is highly unlikely that any other source would expend the resources and time to submit a proposal for this requirement in an attempt to replace the incumbent contractor to provide continuity of services only to transition to the GTO task order.
E. GSA OCIO does not have organic resources to meet IT/IM service requirements and demands currently supported under GITGO. Failure to award this sole source task order may result in an unacceptable break in services and the loss of incumbent expertise and knowledge that is critical to service transition. The repercussions of a break in service would have far reaching impact to GSA domestically and internationally. A break in service would interrupt client and Server Management
Services, (Enterprise Messaging and Collaboration Services, and Client Deployment
Services), Directory Management Services, Desktop Management Services (Software
Deployment, Client Engineering Services, Server Services), Enterprise Service Desk
Support, (Customer Service and Support, Remote Local services), Local Support
Services, Network Operations, Voice and Data Communications Services (Wide
Areas Network Services, Internetworking and Security Services, Network Operations
Center Services, Voice and Video Services, Remote Mobile Technologies) and
Information Technology Security. Disruption of these services will affect GSA’s email, teleconference via the web, voice and data capabilities, mobile devices, support for user’s technical issues and network performance and availability.
(v) A determination by the ordering activity Contracting Officer that the order represents the best value consistent with FAR 8.404(d).
The Contracting Officer has determined that the proposed Task Order to Catapult
Technology, Ltd., for continuation of GITGO services represents the best value and will result in the lowest overall cost alternative, considering price and administrative costs, to meet the Government’s needs. GSA has already determined the labor rates for services offered at fixed hourly rates under their GSA Schedule Contract GS-35F-0401N to be fair and reasonable. Discounted rates will be strongly encouraged and the Contracting Officer issuing the Task Order anticipates making an overall price fair and reasonable determination based on historical pricing and subsequent discounts proposed. Prior to issuance of the task order, the contracting officer will evaluate the level of effort and mix of labor proposed to perform the specific task being ordered. The contractor will be encouraged to provide all possible discounts to the government in determining the price for their proposal.
(vi) A description of the market research conducted among schedule holders, and the results of the research, or a statement why market research was not conducted. A statement must be made that the supplies and services are available from the FSS.
Services are available under Catapult Technology, Ltd’s Schedule 70 contract, GS-35F-
0401N. A comparison of Catapult Technology, Ltd’s, Schedule 70 IT labor categories and rates was conducted against the labor categories and labor rates of the following
Schedule 70 holder’s price lists for similar services under SIN 132-51 IT Professional
Services:
General Dynamics IT GS-35F-4357D
Unisys Corporation GS-35F-0343J
CACI, Inc. - Federal GS-35F-4483G
Catapult Technology, Ltd’s rates were found to be comparable to their competitor’s rates and in many cases slightly lower than their competitors. The rates were already found fair and reasonable at time of the Schedule Contract award. While there are a number of contractors that can provide similar services as those required to support the
GITGO program; Catapult Technology, Ltd., is the only source that has the institutional knowledge of GSA’s IT infrastructure that is required to seamlessly transition GITGO services to a new contractor. Their incumbent knowledge cannot be transferred or replaced without a substantial delay in the transition schedule.
(vii) Any other facts supporting the limited source justification.
Concurrent with this effort, GSA awarded the GSA Technology Operations (GTO) task order for the next generation of enterprise-wide IT/IM support services under the
Alliant Small Business Government Wide Acquisition Contract Vehicle (GWAC) to AAC, Inc. The task order award was made February 27, 2013 with a period of performance of one year base and four one-year option periods. The GITGO-to-GTO transition commenced at award but was delayed 55-days due to a GAO protest. GAO dismissed the protest allowing GSA to take corrective action, so the GITGO-to-GTO transition activities resumed with a transition completion date of July 19, 2013.
(viii) A statement of the actions, if any, the agency will take to remove or overcome any barriers that led to restricted consideration before any subsequent acquisition for supplies and services is made.
This action is necessitated because of the CICA Stay affected by GAO Protests B-408058/
B-408058.2. GSA has taken corrective action pursuant to GAO’s dismissal and will continue to provide detailed information and accountability for evaluations and decisions made to resolve all protests filed against the GTO contract awarded to AAC, Inc. on February 27, 2013. As soon as GSA receives approval to move forward and complete transition, this sole source task order to Catapult Technology, Ltd. will no longer be necessary.
(ix) The ordering activity Contracting Officer’s certification that the justification is accurate and complete to the best of the Contracting Officer’s knowledge and belief.
(x) Evidence that the supporting data is the responsibility of technical or requirements personnel (e.g., verifying the Government’s minimum needs or requirements or other rational for limited sources) which form a basis for the justification and have been certified as complete and accurate by technical/program personnel.
