LIMITED SOURCE JUSTIFICATION (Brand Name) For purchases below the Simplified Acquisition Threshold

Procurement Request Number HFLWSI230082PR

1. Contracting activity/agency

U.S. Department of Transportation, Federal Highway Administration (FHWA), Western Federal Lands Highway Division (WFLHD).

2. Description of the supplies and/or services required to meet agency needs

FHWA-WFLHD requires a PINE AFG2 Superpave Gyratory Compactor to replace aging existing equipment. The estimated value of this acquisition is approximately $45,000.00.

3. Rationale

The Pine AFG2 series of Superpave Gyratory Compactors are “backwards compatible” with the WFL laboratories existing specimen fabrication hardware and peripherals for calibration already in use within the laboratory.

The design and configuration of the existing specimen molds is unique to the PINE

AFG series of compactor and would preclude their usage in other devices.

The configuration and method of use for existing calibration equipment is not suitable to all other brands and or manufacturers of Superpave gyratory compactors.

4. Authority

FAR 13.106-1(b)(i) – The contracting officer has determined that the circumstances of the contract action deem only one source reasonably available (e.g., urgency, exclusive licensing agreements, brand-name, or industrial mobilization).
