About this file
This is a Sole Source Justification Form submitted by the Colorado Department of Public Health and Environment (CDPHE) to procure Guth Model 12V500 Alcohol Breath Simulators and related parts and repair services. The Evidential Breath Alcohol Testing (EBAT) Program requires these simulators to provide precise calibration standards for the I-9000 breathalyzer instruments used across Colorado for evidential breath alcohol testing. The procurement is justified as a sole source because the GUTH Model 12V500 is the only simulator validated by the EBAT program that pairs with the I-9000 breathalyzer, which is the single instrument used statewide for testing. The contract term extends from April 1, 2026, to February 11, 2029, with an estimated total value of $250,000 over the life of the project.
The justification demonstrates that GUTH Laboratories, Inc. is the only vendor capable of meeting the state's needs due to the proprietary nature of its products and the extensive training of approximately 4,000 law enforcement officers statewide on the GUTH equipment. GUTH holds multiple U.S. and foreign patents in breath alcohol analysis, is approved by the National Highway Traffic Safety Administration (NHTSA), and maintains products on the Conforming Products List (CPL). All certified premix solutions are traceable to National Institute of Standards and Technology (NIST) references. Historical pricing data from 2022 through 2025 shows simulator costs ranging from $1,079.10 to $1,168.50, with previous fiscal year expenditures documented from FY23 through FY26. The procurement contact is Corinne Reid, Program Manager for the EBAT Program, at 720-812-0373.

The Evidential Breath Alcohol Testing (EBAT) Program uses the Guth Model 12V500 with each I-9000 breathalyzer across the state. The GUTH Model 12V500 Alcohol Breath Simulator is an electronically temperature controlled, water-alcohol instrument for the purpose of providing a precise calibration standard for testing or calibration of alcohol breath analyzers. This PO would be used to procure additional simulators along with any parts connected and repairs, if necessary.

B. Explain in terms of 1 through 4, above, the basis for your identifying this as a sole source? A sole source is justified in the instance that this is the only vendor - not what the program may determine to be the best vendor. Is this the only vendor? Explain (See form instructions)…
Colorado’s Breath Alcohol testing protocols and procedures have been created with the GUTH12V500 simulators as a core component. To ensure that the I-9000 is operating properly, each breath test run includes a calibration check from a solution that holds a known concentration of alcohol, the simulator holds that solution and maintains its temperature for testing. This is the only vendor that makes a simulator that pairs with the I-9000 that has been validated by the EBAT program. Because the state uses only one instrument for all evidential breath alcohol testing, maintaining standard equipment is critical especially for consistency for the ~4,000 law enforcement officers around the state that are trained on these specific models.
B. What makes this good or service unique to meeting your needs?
Guth simulators and their repair of them, or attachments are critical to the completion of an evidential breath alcohol test. 4,000+ law enforcement officers are already trained on using these.
D. Is the Good or Service Proprietary (product or technology entirely owned by the individual/company and usually protected by trademark or copyright)?
Yes X
No
E. What type of required, specific and exclusive experience, certifications, licenses etc. are possessed by this vendor that directly relate to the good or service to be procured?
Guth Laboratories, Inc. holds numerous US and foreign patents in the field of Breath Alcohol Analysis. Their products are approved by the National Highway Traffic Safety Association (NHTSA) and appear on the Conforming Products List (CPL) . All of their Certified Premix Solutions are traceable to National Institute of Standards and Technology (NIST) references. All major manufacturer’s of evidential breath analyzers have accepted and use Guth simulators.
F. What research has the program conducted to justify this sole source?
The program regularly interacts with other vendors that manufacture breath alcohol testing instruments, there are additional companies that manufacture different instruments, but these are the only that are in use in Colorado currently.
G. Do you have an actual or potential conflict of interest in this purchase? (For example, is an individual from the Department or a family member affiliated with the vendor as an employee, board member, volunteer, etc.?)
Yes
No X
If Yes: Please Explain. (This space is limited – please provide additional documentation if applicable.)
H. This Section is Required – You must answer “Yes” to at least one.
1. Did you compare prices/rates to established catalog prices or market prices? (If “Yes”, attach documentation)
Yes
No X
2. Did you compare prices/rates to historical prices or rates for similar items or services procured in the past? (If “Yes”, attach documentation)
Yes X
No
3. Did you conduct a cost/price analysis? (If “Yes”, attach documentation)
Yes
No X
If No to #3 above:
4. Do you know if the cost is "fair and reasonable"?
Yes ☐
No ☐
Demonstrate how you determined fair and reasonable prices/rates: Attach additional pages if required.
