DETERMINATION

For

SINGLE SOURCE OR BRAND NAME SOURCE SOLICITATION - FAR 13 (≤SAT)

1. Contracting Agency: Department of Defense Education Activity (DoDEA) – Procurement Division

2. Description of Supplies and Services:

This requirement will cover membership fees for DoDEA District Puerto Rico Field Office Schools at Fort Buchanan and Ramey locations to allow participation in various interscholastic sport events with local Puerto Rico area schools. Since DoDEA Puerto Rico is isolated from stateside DODEA schools, association membership is required in order to compete with local schools for the purpose of promoting the DoDEA Athletic Program. Fort Buchanan schools are located in the Metro Area of the Island and Ramey Schools at the West Area of the Island of Puerto Rico (2.5 hours away) with heavy traffic on normal hours.

The total estimated value for high school membership fee/estimate annual athletics events: School Year - 230 meets (home and away games) is $<redacted> for a base period of performance to start on or about September 1, 2019 plus four (4) option periods for a total of $<redacted> . Estimate price will cover High School Membership Dues, Mini Leagues Membership Dues, Track and Field, Cross Country, Football, Volleyball, Boys/Girls Soccer (indoor-outdoor) Boys/Girls Baseball/Softball, Swimming, Golf, Scorebooks, and Fines.

3. Description of Action: DoDEA District Field Office-Puerto Rico intends to award a one-time firm-fixed price purchase order in the estimated amounts below to provide these services during a performance period of September 1, 2019 through August 31, 2020 (basic period) with four option periods.

These figures are based on the forecasted potential complexities of this requirement. Historical data indicates that the actual requirement is revised by the Alliance every five years. Price revision on a year will be in effect next year of participation 2019, the Alliance will meet this month to agree on final costs for the new School Year 2019-20.

4. Authority: FAR 13.106-1(b)(1): Soliciting from a Single Source: solicitations may be limited to one source only if the Contracting Officer determines that the circumstances of the contract action deem only one source is reasonably available.

5. Market Research:

The Requiring Activity has strong personal knowledgeable and historical information about vendors’ capabilities of providing the required services in Puerto Rico (PR) schools. The Puerto Rico High School Athletic Alliance (PRHSAA)is the only vendor utilized by PR schools.

6. Rationale for Single Source or Brand Name:

The Puerto Rico High School Athletic Alliance (PRHSAA), CAGE 4JGP4, is the only source reasonably available to provide the required services. DoDEA Puerto Rico does not have the opportunity to travel and compete with other DoDEA schools within USA territories for regular games. Nearest DoDEA Puerto Rico school is in the West side of the Island of Puerto Rico (2.5 hours away with heavy traffic on normal hours) unless additional road tolls cost is added to travel to this school. PRHSAA is a unique association governing body and serves as the only bilingual (English/Spanish) interscholastic alliance that is available on the Island of Puerto Rico compatible with rules for sports are those that DoDEA follows. These rules not only dictate how sports are played, but also include safety requirements, officiating standards, and consistent standards and rules for competing in sports activities but will not overview instructions under DoDEA 2740.1 Regulation “Interscholastic Athletic Program”, re-issued on July 6, 2006.

PRHSAA is a non-profit, non-sectarian, secular organization incorporated in Puerto Rico in accordance with authority established by Article IV of PRHSAA Constitution and By-Laws on May 24, 1969. Presently, PRHSAA has 32 schools members/participants. DoDEA Puerto Rico is the only federal state government agency among all their members.

PRHSAA serves as governing body compose of official representatives from each member school and the officers of the organization (council members). PRHSAA assures that referees, umpires, arbiters or sport officials that are officiating at competitive athletics or sporting events detect infractions of rules and decide penalties according to established regulations by PRHSAA alliance.

DoDEA Puerto Rico has been a member of PRHSAA since 1982. There is no other interscholastic league for children under 19 years old. PRHSAA sponsored most of the sports events listed herein. Activities are conducted in the English language although Spanish language use is also common usage during the activities.

Each member school will be assessed a fee to cover for operating costs of the Alliance. This amount is determined annually by the Council at the start of the school year by June 2019. Each Athletic Director is responsible to inform their intention of participating on an interscholastic program with the Alliance stating their level and categories of the events. Based on this intention, Alliance will inform the Athletic Directors their fees costs of participation.

School Athletic Directors, as requestors, must inform the need to allocate funds for the purpose to pay for fees of the Alliance that will cover for the following Alliance Costs:

· Office administration/Office Supplies

· Finance/Administration Costs

· Purchase of Trophies/Awards

· Tournaments Ceremonies Expenses

· Championship Ceremonies Expenses

(Referees, umpires, arbiters (sports official) fees will be paid directly by each League Arbitration Association. These sports leagues are part of the Council Alliance member. Fees are regulated by the US Labor Department, Wage and Hour Code 99630 – Sport Official - $15.94 per hour plus mileage expenses.

Government’s interest is in maintaining an athletic program that offers students the opportunity to compete with other students their age. In addition, competitive sports enhance the physical, mental and emotional development of students while combating childhood obesity. Non-participation in interscholastic athletic association diminishes DoDEA’s ability to operate a successful athletic program as students will not be able to compete in sports. A sports program without competition can have a negative impact on students who desire to improve or enhance their skills in sports as well reduce their chance of obtaining athletic scholarships and awards for their athleticism.
