JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION

Under Federal Acquisition Regulation Subsection 6.302-1 Limited Sources Justification

Upon the basis of the following justification, I, as Branch Chief of Construction Acquisition branch of the Acquisition Management

Division of the General Services Administration (GSA), Northwest Arctic Region, Public Buildings Service, hereby approve this limited sources justification pursuant to the authority of Section 253, Competition Requirements of United State Code, Title 41:

Public Contracts (41 U.S.C. § 253).

1. Identification of agency and contracting activity.

The requiring activity is the United States Department of Defense (DoD), United States Army Corps of Engineers (U.S. ACOE), Seattle District, 4735 East Marginal Way South, Seattle, WA 98134. The contracting activity is United States General Services

Administration (GSA), Public Buildings Service (PBS), Northwest/Arctic Region, Acquisition Management Division (10P1PQ), located at 400 15 th

Street SW, Auburn, WA 98001. The acquisition point of contact for this action is Keith Goodsell, Contract

Specialist, (253) 931-7775, keith.goodsell@gsa.gov. The technical point of contact is William Garrett, Project Manager, (253) 931-

7889, william.garrott@ gsa.gov

2. Nature and description of action being approved.

The proposed action is to include unique materials and proprietary services in the award of competitive solicited task order under the existing Service Disabled Veteran Owned Small Business set-aside Western Service Centers (WSC) Design-Build Construction

Indefinite Delivery Indefinite Quantity (IDIQ) Multiple Award Task Order Contracts (GS-10P-14-LT-D-0034, GS-10P-14-LT-D-0035, GS-10P-14-LT-D-0036, and GS-10P-14-LT-D-0037) pursuant to FAR 16.505. A list of specific brand name/unique items and proprietary services are identified in Section 3 below. The Solicitation requires that prime contractor compete subcontracted work to the maximum extent possible, with the exception of the brand name/unique items and proprietary services, which must be acquired through authorized vendors/service providers.

The U.S. ACOE requires tenant improvements including interior office build-out; construction of demising wall, conversion of a meeting den to special needs room and storage room railing at the regional headquarters facility as part of a reduction in lease space. The work will be performed under a GSA/PBS competed contractual action that awarded on behalf of the U.S. ACOE pursuant to the 40 U.S.C. § 592 (b)(2) and the executed reimbursable work authorization between the parties.

A full design and specifications for the required change have been provided by Rolluda Architects, Inc. and its architectural and engineering team under Purchase Order GS-10P-15-LT-P-0021. There are products/key finishes, including system components for controls, lighting, HVAC, fire alarm and sprinkler, flooring, sound masking, and doors that must be kept consistent with the existing building standard, as well as be fully integrated and compatible with the existing building systems. The design drawings and specifications are controlled due to sensitive but unclassified building information contained therein and therefore exempt from public release under the Freedom of Information Act (5 U.S.C. § 552).

The U.S. ACOE Headquarters Building was completed and occupied in October 2012 under contract GS-10P-09-LT-C-0112 with

Sellen Construction Company, Inc. The 3-story low rise, open architecture, 209,000 square foot facility has been the recipient of over twenty-eight design and construction awards for sustainability and design quality. It has been recognized as one of our region’s most energy efficient office buildings with many cutting edge and custom features that are unique to the building. Environmental controls including daylighting, lighting, HVAC, and other system are carefully balance to operate in conjunction with one another to create an atmosphere that is comfortable to the tenants within the building, yet extremely energy efficient. Additionally, the interior design and finishes add market value to the facility which needs to be maintained as much as practically possible.

The Federal Government has a substantial investment in both the initial design and construction of the facility, but more importantly, our investment in the continued long-term environmentally-responsible future operation and management of the facility needs to be maintained to continue to reap the benefits of the energy efficiency and high performance work environment. As such, it is critical to match existing finishes and features to the maximum practical extent. The GSA has went to great lengths to preserve our investment in the original architect’s design intent and in the resulting spatial and workplace qualities, as well as it’s sustainability characteristics, by utilizing many of the original design team firms in design of the changes to the building to accommodate the U.S.

ACOE’s space reduction and integration of a second tenant agency within the building.

Acquisition Regulations (FAR) Subsection 6.302-1, allows for other than full and open competition when there is only one or a limited number of responsible sources, and no other type of supplies or services will satisfy agency requirements.

5. Demonstration that the Proposed Contractor’s Unique Qualifications or the Nature of the Acquisition Requires Use of the Authority Cited.

FAR 6.302-1 provides for the use of the above authority when unique supplies or services from or a limited number of sources or from only one or a limited number of suppliers with unique capabilities. This application of authority applies for the above listed items in the table, as only products these products will match building standard and properly integrate with the existing building systems. The unique components/services listed in Section 3 above are required for several reasons (1) some components are required to match components currently installed within the Oxbow Building, such existing carpet squares, luminaires, finishes, etc.;

(2) some components are additions to installed systems where interoperability and configuration control is critical; and (3) some services are required to be provided by manufacturer’s authorized installers/programmers/other representatives to maintain existing warranties.

Building Automation System: Siemens Industry, Incorporated is the only one source that can provide product, service and support for Siemens Apogee manufactured equipment. The current platform installed in the Oxbow Building is the proprietary APOGEE®

Building Automation System from Siemens Industry, Incorporated. Siemens has stated in a letter dated May 18, 2010 that Apogee equipment is very technical in nature and requires factory trained service technicians with access to technical service bulletins and regular system updates to insure proper operation and reliability of the Automation System. Siemens service tools are proprietary and not made available to other vendors. The software and firmware updates are only available through the local Siemens Industry, Inc. office which can only be installed by Siemens service technicians. Programming coverage provided by Siemens for ongoing project work on site is contingent upon proper maintenance and system updates performed by factory trained personnel. As a result, ongoing service and support on the Siemens Apogee Automation System can only be provided by the local Siemens office.

Fire Alarm System: Only authorized/certified SimplexGrinnell trained installers/programmers can provide product, service and support for SimplexGrinnell 4100ES Fire Alarm System, associated software and components. The current platform installed at the

Oxbow Building is a proprietary SimplexGrinnell 4100ES with both TrueAlert™ Notification Appliances, SmartSync™ controls, that can support both IDNet™and MAPNET II® modules. As a result, ongoing service and support on the Siemens Apogee Automation System can only be provided by the local Siemens office.

High Density Filing System: Only authorized/certified Spacesaver® trained installers can provide product, service and support for

Spacesaver® High Density Filing Systems. The high density filing systems installed in the Oxbow Building are manufactured and warranted by Spacesaver®. Work performed by other firms on said systems will render the product warranty null and void.

Modular Office Furniture Systems: Only authorized/certified Knoll furniture system installers/movers can provide product, service and support for Knoll products. The office furniture currently installed and that will be installed in new offices that are being built for this project are manufactured and warranted by Knoll. Work performed by other firms on said systems will render the product warranty null and void.

Sound Masking System: The sound masking system installed within the Oxbow Building is a LogiSon Acoustic Network manufactured by K.R. Moeller. Use of like equipment and components from the same manufacturer is required for proper system interoperability, functionality, as well as configuration control. The cost of matching existing sound masking system would cheaper than having to completely redesign and install compatible sound masking system in the areas of the building that are being changed. The estimated cost for redesign and installation of different system would be in excess of $100,000 based on calculations by GSA’s architectural/engineering consultant.

Automated Roller Shade System: The roller shade system installed within the Oxbow Building is manufactured by MechoShade

Systems, Inc. The system is fully integrated with the daylighting system with automated adjustments being made throughout the day for adjustment of lighting within the building. Use of like equipment and components from the same manufacturer is required for proper system interoperability, functionality, as well as configuration control. The cost of matching existing roller shade would cheaper than having to completely redesign and install compatible roller shade system in the areas of the building that are being changed. The estimated cost for redesign would be approximately $11,000 based on calculations by GSA’s architectural/engineering consultant.

Luminaires and Lighting Fixtures: The lighting fixtures and luminaires installed within the Oxbow Building are manufactured by

Delray Lighting Inc., Litecontrol, and Pinnacle. These items have been customized and are full integrated with the daylighting system with automated adjustments being made throughout the day for adjustment of lighting within the building. Use of like equipment and components from the same manufacturer is required for proper system interoperability, functionality, as well as configuration control. The cost of matching existing lighting would cheaper than having to completely redesign and install compatible interior lighting finishes in the areas of the building that are being changed. The estimated cost for redesign and full one off custom made equipment and installation would be approximately $20,000 based on calculations by GSA’s architectural/engineering consultant.

Lighting Control System: The lighting control system install within the Oxbow Building is manufactured by Lutron Electronics, Inc.

The system is fully integrated the lighting devices and other systems within the building to ensure proper adjustment of lighting within the building. The system is highly technical in nature and requires the use of like components from the same manufacturer is required for proper system interoperability, functionality, as well as configuration control. The cost of match existing components would cheaper than having to completely redesign and install compatible lighting system in the areas of the building that are being changed. The estimated cost for redesign and installation of different system would be in excess of $100,000 based on calculations by GSA’s architectural/engineering consultant.

Interior Finishes and System Integration: Every major aspect of the Oxbow Building was designed to create a high-performance interior environment that establishes a new modern and sustainable workplace standard. Floor, wall, and ceiling finishes installed in the Oxbow Building were carefully selected to promote biophilia – that is the idea that a physical, psychological, and social connection with nature leads to happier and more productive employees—was instrumental in the design strategy. A motivating concept in the design was to leverage the building's form to provide views to the outdoors from virtually any place within the building, thereby creating a workplace where employees would be excited and proud to come to work. It is noted that the building is of an open architecture concept, with open areas and officers with matching finishes throughout. Each finish and component listed in

Section 3 above that has not been previously addressed in this section is unique in terms aesthetics, functionality, and interoperability with other systems.

The cost of matching existing finishes would cheaper than having to completely redesign and install compatible interior finishes in the areas of the building that are being changed. The estimated cost for redesign and installation of different system would be in excess of $100,000 based on calculations by GSA’s architectural/engineering consultant.

Also it is critical to maintain system configurations and like components to the maximum extent to ensure compatibility of components and interoperability between building systems. Use of other brands is possible, but not practical, as there is often compatibility and interoperability issues that encountered that negatively impact the efficiency of building systems and the environment in which tenants must work. Correct of compatibility issues and wasted energy can be in the thousands of dollars, and in some instances require extensive engineering changes that would not be required if matching systems were utilized. It is simply more cost effective to match existing system components to the maximum extent possible.

The GSA's progressive sustainability requirements and high-performance benchmarks for the original construction require the

Oxbow Building to achieve a minimum of LEED Gold certification; attain an Energy Use Index (EUI) of 27.6 kBtu/SF/year; use 100 percent filtered outside air; meet an ENERGY STAR Score of 97; achieve energy performance 30 percent better than ASHRAE 90.1

2007 edition; and pass a one year performance evaluation to guarantee energy targets were met. It is imperative that these achievements not be compromised

The integrated design solution sets a new standard for high-performance, cost-effective, and sustainable workplace environments.

The building's narrow, 60 foot floor plate optimizes daylight penetration, reducing the need for artificial light and associated energy costs. Daylight reaches virtually all workstations. Low workstation partitions with noise-absorbing panels help to maximize daylight effectiveness, while affording easy work-group reconfiguration.

The exposed "diagrid" structure and mechanical systems add to the industrial aesthetic and exemplify the identity and mission of the

U. S. ACOE of "Building Strong." In addition to providing structural durability and safety, the efficiency of the diagrid structure allowed for a 15 to 20 percent savings of structural steel material around the perimeter of the building. The diagrid was also designed to be easily erected by using bolted connections for the majority of the joints, thereby saving time and labor costs.

Energy and water introduced into the building are leveraged to their highest possible use. Conditioned air is delivered to the workspace via air handling units and exhausted passively through the atrium to high-efficiency heat recovery systems. Available daylight, controlled for glare and unwanted heat gain, is directed to the office floor plates from two sides, offsetting the maximum possible amount of electric lighting.

Supplemental cooling is delivered via an energy-efficient system of passive 'chilled sails' suspended from the ceiling and supplied with cool water. The project team identified a highly efficient chilled sail system as a balanced solution that would provide 100 percent fresh air, passively modulated to maintain thermal comfort, and provide low-energy cooling even in peak conditions.
