Answers to Questions Submitted by Contractors:
Contracting
1. Q. Does the bid bond for the seed project need to submitted with the proposal?
A. Yes. Please include the bid bond on Standard Form 24 as part of the price proposal per Section II.A of the Solicitation. Standard Form 24 is attached to Amendment 4.
2. Q. With regard to the subcontractor Relationship Factor for 10 points--In the event we do not have the local subcontractor relationships from prior work, will a Teaming Agreement suffice to show there is a relationship established and an Agreement in place with the required subs?
A. If a teaming agreement is used to substitute local relationship requirement, teaming agreement must have been established and dated prior to solicitation issue date
3. Q. On the Prior Experience Background Information Form, The General
Instructions state, "The technical proposal shall consist of a written narrative with supporting data that addresses the technical performance requirements defined in the Section V.A.1 of the solicitation." Is the technical narrative a summary of the information captured in Forms A-E? If not, would you please explain what the technical narrative is?
A. The technical narrative is made up of the answers to the questions on Forms
A- E.
4. Q. In Prior Experience Form A, "The offeror must provide the following information within 2,000 words or less: - Original request (Including the Scope of Work). Are you requesting the formal word-for-word Scope of Work? Or are you requesting a summarized Statement of Work? Please clarify what information is being sought?
A. A summary of the scope of work for the project as part of the detailed statement we requested is acceptable. This statement is to describe the work you were requested to do as well as the services you provided.
5. Q. In Amendment 2, Solicitation – Section II.E – “Requirements for Joint Venture
Offerors” was amended to state that “… past performance information must be submitted for the primary member of the joint venture only.”
Requiring that all projects submitted MUST be experience of the primary member of the JV is counter to CFR 125.8 (e), which states, “When evaluating the past performance and experience of an entity submitting an offer for a contract set aside or reserved for small business as a joint venture established pursuant to this section, a procuring activity must consider work done individually by each partner to the joint venture as well as any work done by the joint venture itself previously.”
Will the Government please reconsider the requirement that the projects must come from the primary member of the JV and return to the original requirement allowing submission and evaluation of projects from both JV partners?
A. The requirement remains unchanged per Amendment Two.
Project Management
1. Q. Is this just a resurfacing an asphalt pavement parking lot. According to the solicitation, there was going to be interior and exterior finishes as well. Is the resurfacing of the parking lot one phase of the IDIQ package?
A. The seed project is only the resurfacing of the asphalt parking lot.
2. Q. Fog Seal- There may be an issue finding a contractor to perform fog seal as it is an old spec and not commonly used in the area. It is also typically used on older surface not new surface.
A. Fog seal is not necessary.
3. Q. Prime Coat- What is the purpose of the prime coat? Prime Coat is typically used on stone that is a limited depth or will be left exposed for more than 7 days prior to paving. We feel there is no need for this application.
A. Prime coat is not necessary as there is no full depth replacement. Tack coat coverage should ensure overlay attaches to existing asphalt layer.
4. Q. During the site inspection, it was noticed that on the second aisle way east of River Road (near the reserved spots) there is a manhole that is lower than the existing surface. Does the government want this manhole ring raised to be flush with the new surface or left in place as is and have the new surface feathered to meet existing elevation of the manhole ring?
A. Left in place and feathered to meet existing elevation.
5. Q. Along the west side of the parking lot, the painted curb is a “yellow” color which appears to have faded. Please confirm whether GSA wishes to have this re-painted?
A. Curb does not need to be repainted.
6. Q. Please advise as to the number of regular and Handicapped parking spaces for stripping.
A. Contractor can visit the site to verify this information.
7. Q. Please advise as to the number of signs that are to be removed and reinstalled.
A. Contractor can visit the site to verify this information.
8. Q. Can you please clarify the security requirements for this project? The RFP states that we need badging to enter building, however, based on the project scope, we won't enter the building. Please clarify if we do or do not need to be badged to complete this particular project.
A. A badge is only required to enter the building. If workers do not enter the facility, then no badge is required. No work for seed project has to be conducted inside the building.
9. Q. Specification Section 321216 3.2.C.b calls for the milled surface to receive a
Prime Coat with a minimum of 72 hours cure time. As this is a mill and overlay project, a prime coat is not typically required due to the surface that the new asphalt is being applied to will have a tack coat applied before asphalt placement to ensure bonding of the two surfaces. In addition, the required 72 hours of cure time will require the work area to be closed off to traffic for the duration of the cure time to ensure that the prime coat is not damaged by traffic. Would the government consider eliminating this requirement?
A. Prime coat is not necessary as there is no full depth replacement. Tack coat coverage should ensure overlay attaches to existing asphalt layer.
10. Q. RFI Answers – Project Management #24 states to apply a fog seal per the specification (Specification Section 321216 3.2.H.a). Fog seal is typically used as a rehabilitation measure to extend the usable life span of an existing asphalt surface or as a protective coating on “tar and chip” installations. As this project is installing a new asphalt wear surface, will the government consider eliminating this requirement?
A. Yes. No fog seal is required for the overlay.

OBLIGATION:
We, the Principal and Surety(ies) are firmly bound to the United States of America (hereinafter called the Government) in the above penal sum. For payment of the penal sum, we bind ourselves, our heirs, executors, administrators, and successors, jointly and severally. However, where the Sureties are corporations acting as co-sureties, we, the Sureties, bind ourselves in such sum "jointly and severally" as well as "severally" only for the purpose of allowing a joint action or actions against any or all of us. For all other purposes, each Surety binds itself, jointly and severally with the Principal, for the payment of the sum shown opposite the name of the Surety. If no limit of liability is indicated, the limit of liability is the full amount of the penal sum.
CONDITIONS:
The Principal has submitted the bid identified above.
THEREFORE:
The above obligation is void if the Principal - (a) upon acceptance by the Government of the bid identified above, within the period specified therein for acceptance (sixty (60) days if no period is specified), executes the further contractual documents and gives the bond(s) required by the terms of the bid as accepted within the time specified (ten (10) days if no period is specified) after receipt of the forms by the principal; or (b) in the event of failure to execute such further contractual documents and give such bonds, pays the Government for any cost of procuring the work which exceeds the amount of the bid.
Each Surety executing this instrument agrees that its obligation is not impaired by any extension(s) of the time for acceptance of the bid that the Principal may grant to the Government.
Notice to the surety(ies) of extension(s) is waived. However, waiver of the notice applies only to extensions aggregating not more than sixty (60) calendar days in addition to the period originally allowed for acceptance of the bid.

INSTRUCTIONS
1. This form is authorized for use when a bid guaranty is required. Any deviation from this form will require the written approval of the Administrator of General Services.
2. Insert the full legal name and business address of the Principal in the space designated "Principal" on the face of the form. An authorized person shall sign the bond. Any person signing in a representative capacity (e.g., an attorney-in-fact) must furnish evidence of authority if that representative is not a member of the firm, partnership, or joint venture, or an officer of the corporation involved.
3. The bond may express penal sum as a percentage of the bid price. In these cases, the bond may state a maximum dollar limitation (e.g., 20% of the bid price but the amount not to exceed dollars).
4. (a) Corporations executing the bond as sureties must appear on the Department of the Treasury's list of approved sureties and must act within the limitations listed therein. The value put into the LIABILITY LIMIT block is the penal sum (i.e., the face value) of the bond, unless a co-surety arrangement is proposed.
(b) When multiple corporate sureties are involved, their names and addresses shall appear in the spaces (Surety A, Surety B, etc.) headed "CORPORATE SURETY(IES)." In the space designated "SURETY(IES)" on the face of the form, insert only the letter identifier corresponding to each of the sureties. Moreover, when co-surety arrangements exist, the parties may allocate their respective limitations of liability under the bond, provided that the sum total of their liability equals 100% of the bond penal sum.
(c) When individual sureties are involved, a completed Affidavit of Individual Surety (Standard Form 28) for each individual surety, shall accompany the bond.
The Government may require the surety to furnish additional substantiating information concerning its financial capability.
5. Corporations executing the bond shall affix their corporate seals. Individuals shall execute the bond opposite the word "Corporate Seal"; and shall affix an adhesive seal if executed in Maine, New Hampshire, or any other jurisdiction requiring adhesive seals.
6. Type the name and title of each person signing this bond in the space provided.
7. In its application to negotiated contracts, the terms "bid" and "bidder" shall include "proposal" and "offeror."
