· Option 4: 365 days after date of option exercise

B.4

PLACE OF PERFORMANCE

See Section F.

B.5

FIRM FIXED PRICE

This is a firm fixed price (FAR 16.202) contract with a single award IDIQ component. The CM shall provide a firm fixed price cost proposal along with the proposed labor rates as specified below.

B.6

FIRM FIXED PRICE: OFFICE SPACE, EQUIPMENT, AND SUPPLIES

The Contractor shall provide a firm fixed price in the base year and each option year for all office space, equipment, and supplies as set forth in Section H.6.

B.7

ADDITIONAL SERVICES

(a) Maximum Total Amount for Additional Services. The additional work under the base year and each of the four potential option years will each have a Maximum Order Limit (MOL) of $10,000,000 for a total potential aggregate contract total of $40,000,000. Annual unused MOL balance of each period may be brought forward to the succeeding periods.

(b) Guaranteed Minimum for Additional Services. The Government will order at least $2,500 in additional services during the base year of the contract. (Note: The guaranteed minimum order amount applies to the base year only. Award of the additional option years is not guaranteed nor is there a guaranteed minimum order amount in any given option year that is exercised.)

(c) Additional services will be procured through the issuance of contract task orders as requirements occur. Contract task orders will be issued using the GSA Form 300, titled “Order for Supplies and Services.” A GSA Form 300-A may be used for continuation sheets when necessary. Attachments forming part of each contract work order may also be used for lengthy statements of work, etc. All contract task orders will be priced with an appropriate fixed dollar value and indicate a performance period for the required services. The task order performance period may extend beyond the expiration date of the current contract effective period (The end date for either the base year or exercised option years whichever is latest). Task orders, and associated modifications, must be signed by the Contracting Officer or a designated Contracting Officer’s Representative (COR) to be valid (Designated COR’s will be identified in writing at contract award). The GSA Form 300 or SF30 will also be used to modify issued task orders when necessary.

(d) The hourly contract man-hour rates shall be used for pricing the level of effort in each contract task order. Rates for disciplines not included in the initial contract must be priced and incorporated by modification to the basic contract before being used in contract task orders unless adequate cost and pricing data is available to demonstrate the reasonableness of the rate/cost.

(e) Cost proposals for task orders shall typically be submitted within five (5) working days after receipt of the Government proposal request and scope of work unless a longer time is requested or granted due to the complexity of the request. Typically, the CM will be provided with a project specific statement of work with a proposal request as initiation of a task order. When authorized or requested by the Government, reimbursable incidental expenses required in connection with the work scope shall be included as part of the cost breakdown in the proposal. The firm fixed price for each contract task order will be based on fixed hourly rates established in the contract for the effective period(s) when they will be performed, the negotiated level of effort for each required discipline, travel (if authorized), miscellaneous items, reproduction costs, deliverables, and all other terms agreed upon by the parties.

(f) When urgencies occur, the Contracting Officer may unilaterally issue contract task orders on a not-to-exceed price basis and the CM is required to immediately proceed with performing all such work. Definitive pricing for such task orders shall be resolved as quickly as possible after the order is issued through negotiations between the parties.

(g) The estimated hours provided on the attached spreadsheets are for evaluation purposes only. They are not intended to provide any indication of the amount of additional work that the government may or may not request under the contract.

(h) The hourly rates proposed by the CM and accepted at contract award for each respective performance period, i.e., the base year or one of the four option years, are to be fixed for the duration of that period, including any short term extensions to the last option period not exceeding six (6) months.

(i) The contract cost principles and procedures in the Federal Acquisition Regulation (FAR) at Part 31 apply to the development of the required hourly rates. The CM shall comply with these prerequisites in forming the required hourly rates for the indicated disciplines/labor categories in each time period and any pricing for additional services.

(j) In developing the required hourly rates, the CM must include all allowable profit, overhead, and general condition costs to include home office support, anticipated company-wide increases, fringe benefits, individual employee promotions, all direct labor costs, computer time, data entry, CADD usage, carrier/messenger services, local travel, supplies, equipment and communication services associated with this contract.

(k) The hourly rates listed by the CM and accepted at contract award will be the rates that will be used as the basis for pricing future task orders issued under this contract. The base year and each option period are to be separately priced.

Scope of Work

C.1

GENERAL INFORMATION

The U.S. General Services Administration (GSA) is soliciting proposals for Construction Management (CM) services for Phase 2 of the U.S. Department of Homeland Security Consolidation Project at St. Elizabeths (the “Project”) to include but not limited to, pre-planning, programming, design management, design review, procurement support, construction management, commissioning, post-construction support, and operations and maintenance support services.

C.2

PROJECT DESCRIPTION

Potential offerors are encouraged to review the documents and supporting materials posted at http://www.stelizabethswestcampus.com in order to better appreciate the unique nature of the St. Elizabeths campus, especially from historical and environmental perspectives. The specific projects covered in this effort will be five Phase 2 buildings along with the related site infrastructure. The scope will include construction management for the second phase of construction, which includes:

1. The Center Building, an adaptive-reuse renovation project of a 265,000 square foot existing historic office building for DHS,

2. The National Operations Center (NOC), a highly secured 375,000 square foot underground operations center for DHS groups, located contiguous to the Phase 1 US Coast Guard Headquarters Building.

3. Federal Emergency Management Administration (FEMA) Headquarters, is the only building planned for the East campus and comes in at 750,000 square feet of office space,

4. 2 parking structures, one for FEMA on the East Campus and one in the Center Building area,

5. Site infrastructure and civil work.

The CM for Phase Two is being contracted to be a part of the GSA project team and assist in managing all of the above construction work along with the design process and other Phase Two site related issues as described further in this solicitation. All construction contracts for these buildings will be procured as separate contract actions. All buildings on the campus will connected to the Central Utility Plant (CUP) either by tunnel or direct bury systems for supplied chilled water and power.

The overall campus development program involves a wide variety projects, where at any given time, it could be in various stages of development from pre-planning programming, design, procurement, construction, post construction, commissioning, and operations and maintenance. GSA has procured the services of Perkins + Will (P+W), Chicago, IL to provide architectural and engineering services for the Project.

The scope of services includes certain design phase services and procurement phase services related to the Phase 2 projects: the Center Building, Federal Emergency Management Agency FEMA Headquarters and the National Operations Center (NOC). GSA has contracted with HDR, Goody-Clancey and ZGF Architects for the Phase 2 projects.

C.3

SCOPE OF WORK

The CM shall provide all services required by and incidental to the Contract Documents ("The Work"). The Contract Documents (collectively, "the Contract") consist of the SF 33, Sections A-K of the Request for Proposals, the Contractor’s Technical Proposal, Specifications, Exhibits, and other Attachments identified herein. In consideration for, and upon condition of, the Contractor's completion of the Work, GSA shall pay the Contractor the price or prices established in Section B, subject to the terms and conditions set forth in this Contract.

C.4

OVERARCHING RESPONSIBILITIES AND LIMITATIONS

C.4.1 Environmental and Historical Considerations

The CM shall review, understand, and appreciate the issues, obligations, and responsibilities of GSA as they relate to the Environmental Impact Statement (EIS), the Record of Decision, and the Programmatic Agreement (PA). The CM shall assist in ensuring that the Project complies with all of these documents.

C.4.2 American Recovery and Reinvestment Act of 2009

Partial funding for this Project will be with funds from the American Recovery and Reinvestment Act ("Recovery Act") of 2009. Accordingly, the Project will be subject to unprecedented levels of transparency and accountability so Americans know where their tax dollars are going and how they are being spent. Mechanisms through special contract terms and conditions will be implemented to accurately track, monitor and report on taxpayer funds.
