UNION DUES OR FEES (Dec 2004) (Reference 22.1605)

(a) Definition. As used in this clause—

“United States” means the 50 States, the District of Columbia, Puerto Rico, the Northern

Mariana Islands, American Samoa, Guam, the U.S. Virgin Islands, and Wake Island.

(b) Except as provided in paragraph (e) of this clause, during the term of this contract, the

Contractor shall post a notice, in the form of a poster, informing employees of their rights concerning union membership and payment of union dues and fees, in conspicuous places in and about all its plants and offices, including all places where notices to employees are customarily posted. The notice shall include the following information (except that the information pertaining to National Labor Relations Board shall not be included in notices posted in the plants or offices of carriers subject to the Railway Labor Act, as amended (45 U.S.C. 151-188)).

Notice to Employees

Under Federal law, employees cannot be required to join a union or maintain membership in a union in order to retain their jobs. Under certain conditions, the law permits a union and an employer to enter into a union-security agreement requiring employees to pay uniform periodic dues and initiation fees. However, employees who are not union members can object to the use of their payments for certain purposes and can only be required to pay their share of union costs relating to collective bargaining, contract administration, and grievance adjustment.

If you do not want to pay that portion of dues or fees used to support activities not related to collective bargaining, contract administration, or grievance adjustment, you are entitled to an appropriate reduction in your payment. If you believe that you have been required to pay dues or fees used in part to support activities not related to collective bargaining, contract administration, or grievance adjustment, you may be entitled to a refund and to an appropriate reduction in future payments.

For further information concerning your rights, you may wish to contact the National Labor

Relations Board (NLRB) either at one of its Regional offices or at the following address or toll free number:

(2) Download a copy of the poster from the Office of Labor-Management Standards website at http://www.olms.dol.gov; or

(3) Reproduce and use exact duplicate copies of the Department of Labor’s official poster.

(g) The Contractor shall include the substance of this clause in every subcontract or purchase order that exceeds the simplified acquisition threshold, entered into in connection with this contract, unless exempted by the Department of Labor Deputy Assistant Secretary for Labor-

Management Programs on account of special circumstances in the national interest under authority of 29 CFR 470.3(c). For indefinite quantity subcontracts, the Contractor shall include the substance of this clause if the value of orders in any calendar year of the subcontract is expected to exceed the simplified acquisition threshold. Pursuant to 29 CFR Part 470, Subpart B—Compliance Evaluations, Complaint Investigations and Enforcement Procedures, the

Secretary of Labor may direct the Contractor to take such action in the enforcement of these regulations, including the imposition of sanctions for noncompliance with respect to any such subcontract or purchase order. PROJECT DESCRIPTION

Edith Green Wendell Wyatt (EGWW) Federal Building Modernization Project at 1220 SW Third Avenue, Portland, OR.

Originally (approximately 2 years ago), this project envisioned a building upgrade to include ADA restrooms, seismic, electrical, HVAC distribution, complete building re-cladding, secure entry, blast and seismic resistance, lower level exit, 1st Impressions, tenant space, finishes, HVAC replacement, and security system equipment. The goal was to achieve LEED Silver Certification. Work involves renovation of about 500,000 gsf of space. The project was put on hold when Congress did not appropriate the construction funding.

This project is now being funded under American Recovery and Reinvestment Act (ARRA).

The project is being re-scoped to align more closely with the High Efficiency Green Building requirements (Energy Independence and Security Act, EISA) as mandated by ARRA. The re-scoping effort will include a workshop hosted by GSA in EGWW.

SPECIAL EMPHASIS: This project is being used to advance GSA’s (R10) understanding of collaborative delivery (CMc delivery with GMP contract type) and to test changes needed to move from collaborative delivery to integrated. Both delivery models assume placement of contracts for the AE and Constructor TEAMS (subconsultants and subcontractors) before the technical requirements packages are fully developed. By having the AE team work with the Builder team, cost constraints, schedule constraints, constructability issues, material substitution, design clarifications, and change order resolution activity can be performed “on paper” as opposed to during actual construction.

Integrated/Collaborative delivery assumes all parties take an active ownership stake in the project and use “what’s in the best interest of the project” as the principal criteria in decision making. Integrated/Collaborative delivery is relationship based (not transactional/paper based). Integrated/Collaborative delivery is dynamic, with fluid scope (added, deleted and moved within the project team). Integrated/Collaborative delivery requires all parties to the contracted effort be willing and able to redefine and reinvent the way work is done from the project beginning to project end, including, but not limited to the use of guiding principals, scoping by task list, joint scoping, and “just-in-time” decision making. Integrated/Collaborate delivery assumes a 3-legged stool of (active/decisive) Owner, AE (team), Builder (team).

GENERAL REQUIREMENTS

This part outlines general contract requirements that regulate the scope of work for this project.

GSA may contract with an independent cost consultant or a construction manager to independently verify cost during the design process. In the case of a differing opinion regarding cost, the A/E will conduct a reconciliation effort to understand and document differences of opinions if requested by GSA.

Procurement Method for Construction: This project will be procured in the following order of preference:

CMc (Construction Manager as (General) Contractor) CMc Design Build (option)

A/E Project Manager: The A/E shall designate one person as the A/E Project Manager. The A/E Project Manager shall be the single point of contact between GSA and the A/E Team.

Technical Deliverables: The A/E will develop and maintain an index of all required deliverables.

Project Schedule: The A/E will develop and maintain a schedule for production of all technical deliverables.

Project Progress Meetings: Attend and actively participate in project progress meetings.

Assume principal meeting weekly, half team at least monthly.

Meeting Minutes: Assume some responsibility for documenting meeting activity. Meeting documentation limited to agreements reached, open issues, issues assigned and due dates.

Documentation will be generated using “native applications/systems” to the greatest extent possible.

Data Management: A detailed data management process will be developed identifying information to be developed and maintained, applications or systems used, frequency of publication, extent of distribution/coordination.

Correspondence: A detailed correspondence/communication process will be developed.

Preference will be for face-to-face discussions, telephone conversations, phone messages, and EMAIL. Project management will be accomplished, to the greatest extent practicable, in meetings.

Authorities: The GSA Contracting Officer is the sole entity with the authority to award and modify the scope of this contract. The A/E is prohibited from initiating any changes that may result in an increase in the contract amount, or would result in any delay to the work without expressed written documentation from the GSA Contracting Officer.

Coordination of Audio Visual, Telecommunication and Technology Designer(s): Extent of effort to be determined later.

Coordination with Tenant Furniture Layout and Designer: Extent of effort to be determined later.

Coordination of existing and new security equipment in order to provide the necessary conduits, cable trays etc. for all of the security equipment to ensure they are operable after being installed or reinstalled.

Coordination with ESPC Contractor: Not anticipated on this contract.

PDRI Workshops: Will be scoped and added to the contract by modification, if needed.

DESIGN PROCESS SUMMARY

This project is organized into two primary packages, (package 1) the Base Building package consisting of the building core and shell and addition of the secure underground facility, site work, building services, utilities, mechanical, electrical, main telecommunication, lobbies and common public areas and (package 2) the Tenant Improvement package (see exhibit 1).

The design for this project is composed of two separate parts, Core/Shell including Site work, Secure Underground Facility Addition, Building-Out Services & Common Spaces and the Tenant Improvement part of building-out. These parts are in turn comprised of incremental programming/planning and design phases.

The Preliminary Design Concepts: COMPLETED UNDER SEPARATE CONTRACT

Peer Review: Assume some design and construction peer activity will be required. Effort will be limited, principally to participation in peer meetings.

Commissioner’s Approval: Assume some additional approval or coordination (scope change since initial approval) will be required. Actual requirement will be added by modification at a later date if needed.

Regulating Documents (Standards & Guidelines): All design work and related submittals will fully comply with the latest version of the following documents at the time of contract award.

This list will be updated before the option is ordered.

GSA P100, Facilities Standards for the Public Buildings Service GSA CAD Standards GSA New Pricing Guidelines DOJ Vulnerability Assessment of Federal Facilities ISC Security Design Criteria
