Task/Delivery Order Number: GS-10F-0032J DJO2011F_11101

LIMITED-SOURCES JUSTIFICATION FOR FEDERAL SUPPLY SCHEDULE

PROGRAM

Upon the basis of the following justification, I, Nichele Robinson, as the Contracting Officer, hereby approve the use of sources limited to fewer than those required in FAR 8.405-1, FAR 8.405-2, and FAR 8.405-3 pursuant to the authority of 41 U.S.C. 251 as implemented by FAR 8.405-6(a)(1)(i)(A). This acquisition is conducted under the authority of the Multiple-Award Schedule Program (FAR 8.401).

1. Identification of the agency and the contracting activity.

The contracting activity is the Department of Justice (DOJ), Office of Justice Programs (OJP), Office of Administration (OA), Acquisition Management Division

(AMD).

2. Nature and/or description of the action being approved.

The National Institute of Justice (NIJ) is executing a six (6) month extension under task order DJO2011F_11101 for National Environmental Policy Act (NEPA) support services. This extension is necessary to prevent a lapse of NEPA support services while OJP completes the re-compete solicitation and its award. The type of contract contemplated is a Time and Materials (TM) task order (TO).

3. A complete description of the supplies and/or services required to meet the agency’s needs

The contractor will provide on-going NEPA support services in assisting the OJP, NIJ to ensure continuity of delivering OJP’s mission, proper transition of services, and the knowledge transfer to the new contractor. It would take a significant amount of time to re-solicit a new vendor, recruit the proper staff, and train a new vendor to acclimate itself to NIJ’s systems and business practices. Requesting the limited source is a cost savings to the NIJ and the Government. The extension will allow NIJ to comply with the NEPA and the Council on Environmental Quality (CEQ) regulations such as 40 CFR Parts 1500 1508. The period of performance for this six

(6) month extension will be September 30, 2016 through March 20, 2017. The value of this extension will be $86,173.88.

4. An identification of the LSJ rationale, and if applicable, a demonstration of the contractor’s unique qualifications to provide the required supply or service.

FAR 8.405-6(a(1)(i)(A) - An urgent or compelling need exists, and following the FSS ordering procedures would result in unacceptable delays.

It is in the best interest of the government that NEPA support services be continued for an additional 6 (six) months by SOLV, LLC. The current contractor is vital to the successful completion of NIJ’s current tasks to be compliant with OJP’s mission and NIJ’s required deadlines. The current vendors possesses intimate knowledge of OJP/NIJ business practices which is necessary to ensure an efficient transition to the new contractor. Extending this task order mitigates any risk (i.e. cost) or delays associated with a re-compete and is an efficient use of OJP’s resources. To re-solicit the task order and start with a new vendor at this stage will result in a substantial duplication of cost that the Government is not expected to recover; in effect, establishing a new effort with a new vendor would essentially negate the NIJ significant investment; services and studies completed and/or in the process of being completed would be compromised; and it would delay the final deliverable(s) submission.

5. A determination by the ordering activity Contracting Officer that the order represents the best value consistent with FAR 8.404(d).

The current task order in place utilizes the GSA Professional Services Schedule (PSS) contract, GS-10F-0032J, which has approved labor rates and labor categories. The government will utilize the same contract vehicle to acquire these required services, which have been pre-determined to be fair, reasonable, and represents the best value for the DOJ, OJP.

6. A description of the market research conducted among schedule holders, and the results of the research, or a statement why market research was not conducted. A statement must be made that the supplies and services are available from the FSS.

25 vendors were found that are able to perform NEPA support services. All 25 vendors, 24 are SB’s, ten (10) are WOSB, five (5) are EDWOSB, and two (2) are SDVOSB. Market research has determined that the FSS possesses technically capable vendors that can perform NEPA support services.

7. Any other facts supporting the limited source justification.

The rates for the extension will be the same rates being utilized under Option Year 4 (four) which have been deemed fair and reasonable prior to the options execution.

The level of effort was estimated utilizing the current workload and its projection and the transition activities.

8. A statement of the actions, if any, the agency will take to remove or overcome any barriers that led to restricted consideration before any subsequent acquisition for supplies and services is made.

OJP is in the process of re-competing this requirement within the next few months. This extension will prevent a lapse in service and account for the phase-out activities/tasks to the new contractor.

9. The ordering activity Contracting Officer’s certification that the justification is accurate and complete to the best of the Contracting Officer’s knowledge and belief and evidence that the supporting data that form a basis for the justification have been certified as complete and accurate by technical/program personnel.
