U.S. GENERAL SERVICES ADMINISTRATION

GSA REGION 10

PUBLIC BUILDINGS SERVICE

REALTY SERVICES BRANCH

JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION

LEASE NUMBER: GS-10B-06134

PROJECT NUMBER: 9OR2026

AGENCY: Social Security Administration

1. IDENTIFICATION AND DESCRIPTION OF ACTION BEING APPROVED.

The General Services Administration currently leases 8990 rentable square feet of office space at 221 NE Schuyler St. in Portland, Oregon. The current lease expired November 18, 2008. Approval is requested to negotiate an extension with the incumbent landlord without full and open competition for continued occupancy at this leased location.

2. DESCRIPTION OF THE SUPPLIES OR SERVICES REQUIRED.

SSA submitted a continuing need letter on May 18, 2007 for 8990 rentable square feet of office and related space. SSA requested that this lease be extended to co-terminate with another lease in 2011 so that the offices could be combined into one location.

The estimated annual cost of this lease is $36.26/BOMA rentable square feet per year. This equates to an annual cost of $326,052.28 per year.

3. IDENTIFICATION OF STATUTORY AUTHORITY

41 U.S.C. 253 (c)(1): Only one responsible source and no other supplies or services will satisfy agency requirements.

4. DEMONSTRATION THAT THE ACQUISITION REQUIRES THE USE OF THE AUTHORITY CITED.

GSAM 570.402-5 allows for negotiation with the incumbent Lessor when a cost-benefit analysis shows that the Government cannot expect to recover relocation and duplication costs through competition.

Award to other than the current Lessor would require relocation of the entire requirement and would cause SSA to incur move and replication costs that would not be recovered through competition.

Cost-benefit Analysis

Acquisition of 8990 Rentable Square Feet (RSF)

Three-Year Analysis:

Present Location
Alternate Location
8990 RSF
8990 RSF
$36.26/RSF
$32.50/RSF
Lease Rental Rate for 8990 RSF for 3 years
$977,932.20
$876,525.00
Amortized Tenant Improvements ($42.50/RSF) for new/remodeled space
$0
$382,075.00
Estimated voice and data move costs - $2.00/RSF
$0
$17,980.00
Physical Move Cost - $4.00/USF
$0
$35,960.00

TOTAL COST:

$977,932.20
$1,312,540.00

Cost for physical move and Voice and Data are based on local charges.

The cost of relocating SSA using the low cost quote exceeds the cost of remaining at Schuyler. The savings to the Government is $334,607.80. Based on this cost-benefit analysis, the Government cannot expect to recover relocation and duplication costs through competition. Therefore, the Government intends to negotiate an extension and remain at its current location.

5. DESCRIPTION OF EFFORTS TO SOLICIT AS MANY OFFERS AS IS PRACTICABLE.

Simplified Lease Acquisition Procedures (GSAM 570.2) do not require advertising the requirement.

6. DEMONSTRATION THAT THE ANTICIPATED COST WILL BE FAIR AND REASONABLE.

In accordance with Federal Acquisition Regulation (FAR) 6.303-2(a) (7), the Contracting Officer determines by certifying this document that the anticipated cost to the Government of $36.26/BOMA rentable square feet per year is fair and reasonable.

7. DESCRIPTION OF MARKET SURVEY CONDUCTED.

Market research in November 2008 determined that there was only one available property with sufficient square footage to accommodate this requirement (9300 SE 91st St.). The offered rate at that location was $32.50/RSF. The rate offered at 221 Schuyler, in which SSA has its space, is $36.26/RSF per year. This rate is higher than the rate in offered at 9300 SE 91st St; however the Government will enjoy considerable savings by remaining in its current location for the proposed short lease period when compared to the costs for relocation. Therefore $36.26/RSF per year is a fair and reasonable cost for the Government.
