I.A. Contract Summary

This is a Multiple Award, Indefinite Delivery/Indefinite Quantity (IDIQ), contract for Construction and Design-Build Construction Services to support the Region 7 (Arkansas, Louisiana, New Mexico, Oklahoma, and Texas) requirements for the General Services Administration (GSA). Construction and Design-Build services consist of interior and exterior building construction, and repair and alterations, including but not limited to electrical, carpentry, masonry, plumbing, mechanical, architectural, landscaping, storm drainage, exterior renovations, construction or demolition services, earthwork, pavement repair, and other miscellaneous civil work.

The term of the contracts will be for five (5) years, with no option years. The contracts will not include pre-negotiated line item pricing. Rather, each project will be competed among the awardees of the IDIQ contract using criteria established by the ordering office (price alone, or a combination of price and technical factors).

B. Minimum Guarantee (Agreement, I.C.)

(4) Minimum Guarantee. The Government makes no representation as to the number of Task Orders or actual amount of work to be ordered; however, there is a minimum of $1,000.00 guaranteed to each awardee over the duration of the Contract. Contractors are not guaranteed work in excess of the minimum guarantee.

C. Minimum and Maximum order limitations (Agreement, I.C.)

(3) Task Order Limitations. Task orders are anticipated to range in value between $2,000.00 and $5,000,000.00; however contractors are not obligated to accept task orders below $2,000.00 under the general terms of the Contract.

(5) Maximum Limitation. The aggregate value of $200,000,000.00 will be shared by all awardees and serve as the maximum value (not to exceed amount) for the entire multiple award contract group. If this is a multiple award, the aggregate value will be shared by all awardees.

(Ms. White encouraged offerors to carefully note the requirements of all three evaluation factors, and to use the following sections as “checklists”, to ensure that their proposals meet each of these requirements, especially when a numbered list is shown. GSA personnel will be evaluating proposals based upon these criteria as stated.)

(1) Experience and Past Performance

This factor considers each Offeror’s previous experience and past performance successfully delivering design-build and construction/repair/alteration projects within the last 8 years from the closing date of this solicitation.

Offerors must submit at least five (5) but no more than eight (8) project/program data sheets. Each project/program data sheet must be four (4) pages or less and must meet the requirements listed below.

A previous design-build project/program is only applicable for submittal and consideration if it meets all four criteria listed below:

1. The prime contractor had contractual obligations for both design and construction.

2. The project or program was completed or has reached “substantial completion”

(as defined in GSAR 552.207-4(l)) within the last 8 years.

and Excluded Parties List system (EPLS) that it considers current, accurate and relevant.

Failure of the Offeror to provide accurate contact information for the references given for any of the factors will negate the reference. GSA is not required to search for current/correct contact information including phone numbers or email addresses.

F. Method of Award (Solicitation, VI.)

VI.A. Evaluation of Offers

(1) The Government will award contracts resulting from this Solicitation to the responsible Offerors whose offer conforming to the Solicitation will be most advantageous to the Government, Price and other factors considered. In addition to the Price, the three non-price factors shall be used to evaluate offers. Factor 1: Experience and past performance is the most important factor. Factor 2:

Qualifications, experience, skills and abilities of key personnel is less important than factor 1. Factor 3:

The management plan is less important than factor 2.

(2) Non-Price Factors, when combined, are significantly more important than Price.

(Proposals will be evaluated heavily on technical factor, although we will be using trade-off evaluation.)

(3) Tradeoff Information: The approach to source selection for this procurement will be pursuant to the best value tradeoff concept as identified in FAR Part 15.101-1 and FAR Part 15.3. It is the Government’s intention to award a contract to the Offeror whose proposal conforms to the RFP requirements and is considered to be most advantageous to the Government, price and technical factors considered.

The Government intends to evaluate proposals and award contracts without discussions with Offerors (other than exchanges conducted for the purpose of minor clarifications). However, the Government reserves the right to conduct discussions if later determined by the Contracting Officer to be necessary. Therefore, each initial offer should contain the Offeror’s best terms from a price and technical standpoint.

VI.B. Determination of Responsibility In order to be considered responsible, an Offeror must demonstrate that it meets the requirements of FAR 9.104-1. The Contracting Officer's determination of an Offeror's responsibility or non-responsibility may be based upon any information obtained by the Contracting Officer, and is independent of the evaluation of offers set forth herein.

VI.C. Price Reasonableness The proposed prices will be evaluated for reasonableness. Price reasonableness determines whether an Offeror’s price is too high. Analysis of price proposals will be performed using one or more of the techniques defined in FAR 15.404 in order to determine price reasonableness. Normally, price reasonableness is established through adequate price competition, but may also be determined through price analysis techniques as described in FAR 15.404-1. Notwithstanding anything to the contrary in this solicitation and for the avoidance of doubt, the Government will not perform a price realism analysis of the Offeror’s proposal.

VI.D. Unbalanced Prices Offers must include balanced prices. Unbalanced pricing may increase performance risk and could result in payment of unreasonably high prices. Unbalanced pricing exists when, despite an acceptable total evaluated price, the price of one or more contract line items is significantly over or understated as indicated by the application of price analysis techniques. All offers with separately priced line items or subline items shall be analyzed to determine if the prices are unbalanced. If price analysis techniques indicate that an offer is unbalanced, the contracting officer shall: (i) Consider the risks to the Government associated with the unbalanced pricing in determining the competitive range and in making the source selection decision; and (ii) Consider whether award of the contract will result in paying unreasonably high prices for contract performance. An offer may be rejected if the contracting officer determines that the lack of balance poses an unacceptable risk to the Government.

VI.E. Total Evaluated Price The Government will evaluate the prices indicated in the Price Proposal, using price analysis to determine whether it is reasonable. The price proposals will not be assigned a numerical weight, point score, or adjectival rating. Each of the hourly rates provided in Table 1 (in the Agreement) will be weighted equally and evaluated individually. For purposes of price evaluation, the price for an extension of services accomplished through bilateral modification will be evaluated as part of the contract price. The rates for the extended period will be the same as the contract period immediately preceding the extension (i.e. the Fifth 12-month period as shown in Table 1 of the Agreement).

VI.F. Non-Price Factors See section II.D of the Solicitation for information on non-price factors.

VI.G. Evaluation of Joint Venture Offerors In the evaluation of responsibility and non-price factors, information submitted for a party to the joint venture will only be evaluated to the extent that the terms of the joint venture agreement do not limit such party's performance or financial obligations as a party to the Contract contemplated by this Solicitation.

G. Proposal Contents (Solicitation, II.A., II.E., and II.F.)

II.A. Proposal Contents Proposals shall consist of the following documents, completed and executed in accordance with this Solicitation:

(2) Task Order Participation. Awardees may elect not to compete on projects for which they have been afforded the opportunity. If a contractor does not respond with a competitive proposal on a reasonable number of Task Order requests, then (a) the Contractor waives its right to the minimum guarantee (b) the Contractor acknowledges that it may contribute negatively to the contract performance evaluation and (c) the Task Order Contracting Officer may determine that it is in the best interest of the Government to terminate the Contractor for convenience.

(Please be responsive to RFPs, even if you are unable to submit a proposal for a particular project at the time.)

(5) …

The Contractor shall be presumed to have established all prices for Task Orders with knowledge of general and local conditions that may affect the cost of Contract performance at the site where the Work is to be performed, to the extent that such information is reasonably obtainable.

Contractors are urged and expected to inspect the site where the work will be performed, and Tasks Orders will provide instructions on how and when visits can be conducted.

No oral statement made by a Government representative during any site visit or preproposal conference, nor any written record of such oral statements as may be made and subsequently furnished to the offeror, will be deemed to have the effect of adding to, modifying, or otherwise varying from the written provisions of the request for proposals (including, but not limited to specifications, drawings and written amendments to the solicitation). In the event the discussion or questions raised during the site visit or preproposal conference indicate a need to modify the request for proposals, an amendment to the solicitation will be issued in writing.

The proposal should not simply rephrase or restate the government's requirements, but rather provide convincing, factually-based explanation on how the offeror intends to meet these requirements. Offerors shall assume that the government has no prior knowledge of their facilities and experience. The government will base its evaluation on the information presented in the offeror’s proposal, and the government reserves the right to use any past performance information available to it. The offeror is reminded that the government reserves the right to award this effort based on the initial proposal, as received, without discussions. Changes to the solicitation prior to the deadline for receipt of proposals will be executed via issuance of SF30.

The SF30 will be posted and available on http://www.fbo.gov under the announcement number of the solicitation. Offerors are encouraged to check the solicitation announcement regularly to verify issuance of amendments. Offerors shall acknowledge receipt of any amendment and provide confirmation upon submission of the offeror’s proposal on the SF1442. Any unacknowledged amendments in the offeror’s proposal will be considered a deficiency in the evaluation of the proposal.
