SOLICITATION GS-07P-13-HH-D-0012, IDIQ GENERAL CONSTRUCTION, REPAIR AND
ALTERATION SERVICES FOR OKLAHOMA WEST.
QUESTIONS SUBMITTED VIA E-MAIL AS OF June 4, 2013:
1. Is “Similar” as used in reference to projects in Section II.D(2) Experience, (3) Past Performance, and (5) Qualifications and Experience of Key Personnel mean the same as defined in II.D(2)?
ANSWER: The definition given for “similar” project in Section II.D(2), in paragraph “Submittal Requirement” should be used in the same manner for (3) Past Performance and (5) Qualifications and Experience of Key Personnel.
2. How do you want Davis-Bacon wages priced in the response? Do you want 1 wage for each trade for the zone, or separate wages for the different Davis-Bacon regions in the zone?
ANSWER: The line item prices submitted under this solicitation shall be fully loaded prices, which should include labor, materials, overhead and profit. This zone includes multiple Davis- Bacon wage determinations; however, the map included in the solicitation contained historical spending in the state (darker green areas represent areas where most of the dollars were spent).
Use the map as an informational tool to figure out which wage determination would be the most appropriate to based your prices on.
3. May an offeror submit subcontractor past performance to satisfy the requirements of Experience & Past Performance? If so, is a teaming agreement necessary between the two firms and must this teaming agreement be included in the proposal?
ANSWER: Yes, an Offeror may submit subcontractor past performance to satisfy the requirements of Experience & Past Performance. However, the Offeror must submit a teaming agreement as required in Section II.C(1) Price Proposal & Other Requirements.
4. We respectfully request that GSA increase the requirement for a bona fide place of business from 50 miles to 200 miles from the GSA OK West Zone. We believe there are several qualified firms who could successfully perform work on this contract outside of the 50 mile radius.
ANSWER: Any interested small business concern may propose for this solicitation. The requirement of a local office within the zone (or within a 50-miles radius of the zone) is not a pass/fail requirement. It is, however, a non-price evaluation factor; to obtain a satisfactory or higher rating you are required to have a bona fide place of business in the zone. Moreover, there will be request for proposals for these similar requirements in the rest of the Region (Texas, Oklahoma, Arkansas, Louisiana and New Mexico) in the near future and we encourage you to propose for those zones if closer to your locality.

C. MINUTES OF MEETING

2. GSA CONTRACTING COMMENTS
This procurement is for General Construction, Repair and Alteration Services for the Western part of the state of Oklahoma (from now on referred to as Oklahoma West Zone). This Zone is 100% set aside for Small Business. For a complete listing of Counties in this Zone, please refer to the solicitation.
A. HSPD-12 REQUIREMENTS
Offerors awarded contracts resulting from this solicitation will be expected to obtain and retain security clearances as per Homeland Security Presidential Directive 12 (HSPD-
12) for all key personnel assigned to the contract, and for the duration of the contract.
B.OVERVIEW OF IDIQS
1) PERIOD OF PERFORMANCE
The resulting contracts will be for a period of one (1) year, with provisions to exercise options for four (4) one-year periods.
2) ESTIMATED AMOUNT PER YEAR & MOL:
The estimated total per year for this Zone is $1,500,000.
The yearly maximum ordering limitation (MOL) per contract was based on the historical spending. For this zone, the MOL is $1,500,000 per contract per year.
Minimum order. When the Government requires services covered by this contract in an amount less than $2,000.00, the Government is not obligated to purchase, nor is the Contractor obligated to furnish, those services under the contract.
Maximum order. The Contractor is not obligated to honor –
(1) Any order for a single item in excess of $500,000;
(2) Any order for a combination of items in excess of $500,000; or
(3) A series of orders from the same ordering office within five (5) days that together call for quantities exceeding the limitation in paragraph (1) or (2) of this section.
The Contractor shall honor any order exceeding the maximum order limitations in, unless that order (or orders) is returned to the ordering office within three (3) days after issuance, with written notice stating the Contractor’s intent not to ship the item (or items) called for and the reasons. Upon receiving this notice, the Government may acquire the services from another source.
3) MINIMUM GUARANTEED:
The guaranteed minimum will be $2,000 for the base period only.
4) TASK ORDERS PLACEMENT UNDER MULTIPLE-AWARD CONTRACTS:
Task Orders below the Simplified Acquisition Threshold ($150,000) and that are at least 85% line item work may be issued to the contractor with the lowest priced line items.
Determination of the lowest priced line item contractor will be based on the aggregate total of the prices for the specific line items required on the TO. If the lowest priced line item contractor has reached its MOL for the year (or will exceed their MOL if awarded this TO); the TO will be issued to the next lowest priced line item contractor.
Task Orders for requirements at SAT or above, will be competed among all eligible IDIQ contractors for the zone. The ordering contracting officer shall issue a lump sum Request for Proposal (RFP) to all eligible IDIQ contractors for that zone, who have not reached their MOL (or will not exceed their MOL if awarded this TO) for the year. After receipt of proposals, and consideration of the factors stated in the RFP, the ordering contracting officer shall issue a TO to the responsible contractor whose proposal offers the best value to the government.
5) SPECIAL ORDERING FOR CARPET-ONLY TASK ORDERS:
Task Orders for installation of carpet only (above $2,500) will be competed among the eligible contractors of the zone as a lump sum RFP (regardless of dollar value).
Eligible contractors are those who have not reached or exceeded their MOL, or who the award of the subject TO would not force them to exceed their MOL.
TOs for carpet only will be subject to the wage determination for the county where work is to be performed under the Service Contract Act of 1965. The ordering Contracting Officer shall include the appropriate wage determination with the RFP.
6) LINE ITEM PRICING:
The labor rates on the Pricing Form are fully loaded rates. Davis Bacon Wage Determinations are to be used for the labor portion of the line items pricing.
Also note the factors to be applied to line item prices for work done during other than normal working hours at the bottom of the pricing form.
Please note the Special Instructions for Line Item Pricing Submittal (include spreadsheet on CD).

5. FINAL GSA COMMENTS
6. QUESTIONS AND ANSWERS
QUESTION: Regarding the issue of Task Orders, does that mean we will be bidding against each other on this?
ANSWER: If a Task Order requirement is below $150,000, and consists of more than 85% line item work; the aggregate total for those particular line items will be compared among the eligible contractors in the zone and the contractor with the lowest aggregate total will get the award.
If the Task Order requirement is below $150,000 and consists of fewer than 85% line items, or is over $150,000; then a request for quotes will go to all eligible contractors in the zone for competition.
Also, the Task Order Contracting Officer (CO) reserves the right to compete any requirement regardless of dollar value if the CO determines that is in GSA’s best interest.
QUESTION: So, the line items are on the spreadsheet? You are not using R.S. Means?
ANSWER: Correct, this contract will not reference or “use” RS Means. GSA’s PM’s often times use it as a tool when we do our estimating.
QUESTION: What are the bond threshold requirements? Is a task order for say, $20,000 bondable?
ANSWER: There are no bonding requirements for the base contract. As per FAR Part 28.102, Performance and Payment Bonds and Alternative Payment Protections for Construction
Contracts, task orders for more than $150,000 will require performance bonds and a form of payment protection (usually a payment bond or an irrevocable letter of credit). For task orders between $30,000 and $150,000, one form of payment protection will be required (either a payment bond or an irrevocable letter of credit). So, a task order for $20,000 (for example) will not require a bond.
QUESTION: How many facilities are there in the West Zone?
ANSWER: In the West Zone of Oklahoma the majority of the work is done in the Oklahoma
City area (there are 2 courthouses and a Federal campus in Oklahoma City); there is some property in Lawton also.
QUESTION: Is there allowance for mobilization?
ANSWER: No, there is no allowance for mobilization, within the zone, when doing a line item
Task Order. We gave you a map showing where the majority of the work in this zone will take place (based on historical data) so this should help you in coming up with your pricing.
QUESTION: How many awards for this zone?
ANSWER: We “anticipate” awarding around 3 contracts for this zone, but we reserve the right to make fewer or additional awards.
QUESTION: Spreadsheet items 2-50. Should the prices include supervision, overhead and bondage? Is that correct?
ANSWER: Your line item prices are to be fully loaded prices including labor, supervision, materials, profit and overhead. You will be allowed a separate bonding charge, if required.
QUESTION: In Section 1 of the spreadsheet, how does that factor into the bid? How will these be used?
ANSWER: The man hours in this section will be used in the rare instances when the contractor is asked to install Government furnished items or materials.
QUESTION: For example, Item 50, it requires a price for lineal feet. This price is for material only, right?
ANSWER: No, your line item price should be fully loaded price that includes labor, supervision, material, profit and overhead.
QUESTION: On the wage determinations, are the labor rates subject to change within the 5 year contract?
ANSWER: Yes, the Davis Bacon rates can change. They are usually in a 2 year cycle.
QUESTION: How are you planning to handle the change when wages change during the course of the contract?
ANSWER: If a wage rate changes in the middle of the base or an option year the procedures in FAR 22.404-12(b) will be followed. When we exercise an option under this contract we will follow the procedures in FAR 22.404-12(c)(1) and clause 52.222-30 when it comes to your line item prices only (in competitive orders you will quote based on the applicable wage rates in your base contract at that time). Per FAR 22.404-12(c)(1), we will not adjust the line item prices as a result of the incorporation of a new or revised wage determination at the exercise of each option to extend the term of the contract.
QUESTION: What about task orders over $500,000?
ANSWER: These IDIQ contracts will not be used for orders over $500,000.
QUESTION: For orders over $150,000, will there be a Statement of Work? Will we do a walk through and provide a quote?
ANSWER: For task orders over $150,000, we will issue a Request for Quote (RFQ) to all contractors within the zone and include a statement of work. You will have the opportunity for a walk through (if necessary) and then provide a quote.
QUESTION: What is the average size of a task order?
ANSWER: Based in historical data, the average size of the task orders were $40,000 to
$50,000. We also found that more than 90% of the task orders were under $500,000.
QUESTION: On the 15% of the work that is non-line item work that is considered non-schedule, right?
ANSWER: Yes, for the 15% of the work that is not line item, the low line item contractor for that order will be requested to submit a quote for the non-line item work.
