About this file
This document is a Limited Source Justification (LSJ) for a federal contract opportunity. The contractor, Waters Corporation, will provide preventive maintenance and repair services for three government-owned Waters Ultra Performance Liquid Chromatography (UPLC) Mass Spectrometry (MS) Systems and associated instrumentation. This is a firm-fixed-price follow-on contract with a total estimated value of $481,057.20. The contracting agency is the National Cancer Institute (NCI) of the National Institutes of Health (NIH). Market research indicated that Waters Corporation is the sole provider of certified service for these proprietary instruments, as the manufacturer does not sell parts or provide support to third-party vendors. The LSJ outlines the rationale for the limited source procurement and states that NCI will conduct additional market research if future services are required beyond the current contract's scope.

reasonableness. Based on this information, there is no reason to believe that the price will not be fair and reasonable to the Government. A final determination will be conducted prior to the award of this task order. The contract file will be documented to support the Contracting Officer’s fair and reasonable price determination.
6. Description of the market research conducted among schedule holders and the results, or a statement of the reasons market research was not conducted.
The instrumentation described here was designed and manufactured by the Waters Corporation and contains proprietary and many patented technologies. It is common practice for a corporation to restrict access to parts, service notes/procedures/schematics and knowledge to its own employees. It is not reasonable to expect a vendor, other than the manufacturer, to service these instruments. Waters was contacted and confirmed it will not sell parts or provide service support to any 2nd or 3rd party vendor. They are the sole provider of certified service.
Based on the NCI Project Officer’s and laboratory staff’s technical and scientific knowledge of the marketplace, there are no known additional sources for this service. The Project Officer conducted market research via internet, search engine, and professional journals, and was unable to identify other vendors that service this equipment.
7. Any other facts supporting the justification.
None
8. Statement of the actions, if any, the agency may take to remove or overcome any barriers that led to the restricted consideration before any subsequent acquisition for the supplies or services is made.
a. Removal of barriers to competition
It is not feasible to “break out” the services provided by this requirement into segments to facilitate competition. In the event NCI requires additional service not covered under this procurement, NCI/CCR and the NCI Contracting Officer will conduct market research to determine if the current commercial environment has changed. Market research will include search of GSA and open market, if applicable. This market research would be used to identify any other sources – specifically small businesses – available to provide the required services.
b. Listing of sources, if any, that expressed an interest, in writing, in the acquisition.
None
9. Program office certification.
This is to certify that the portions of this justification that have been developed by the undersigned program office personnel, including supporting information and/or data verifying the Government’s minimum needs or requirements, or other rationale for limited sources, are accurate and complete.
10. Contracting Officer certification.
This is to certify that the justification for the proposed acquisition has been reviewed and that to the best of my knowledge and belief the information and/or data provided to support the rationale and recommendation for approval is accurate and complete.
