Brand name specifications shall not be used unless the particular brand name, product, or feature is essential to the Government’s requirements, and market research indicates other companies’ similar products, or products lacking the particular feature, do not meet, or cannot be modified to meet, the agency’s needs.

(d). FINDINGS:

1. The proposed action involves purchasing a new fire alarm control panel and all software required for the fire alarm workstations in the Minneapolis Court House and Federal Building. This equipment controls the fire alarm system at the Minneapolis Court House and Federal Building at 300 S. 4th Street, Minneapolis. The proposed action will be accomplished due to repeated issues with the current system. The main contractor, designer, and distributor for the Siemens Building Systems has proprietary rights to the current system.

2. It is necessary to complete this procurement in order to procure equipment and software, to control the Fire Alarm system at the Minneapolis Court House and Federal Building.

Siemens Building Systems is the proprietary company and their knowledge of the system gives them a unique ability to perform these services in a minimal time frame and cost, when compared to installing an entirely new fire alarm system.

3. The estimated cost for the required work is $250,000.00.

4. The original manufacturer and installer Siemens Corporation as an agent of Siemens Building Systems is located within the Minneapolis and St. Paul metropolitan area. As the installer of the current 16 year old fire alarm system they are more than capable of installing the new control panel and software. No new fire alarm devices will be installed, and Siemens Building Systems has the only fire control panel that will seamlessly integrate with the current fire alarm devices and be able to monitor the devices.

5. GSA has previously utilized this company for services at this location. Due to previous market research and that this company currently being on GSA schedule, their schedule pricing was determined to be fair and reasonable and thus it is expected the pricing for this work will be fair and reasonable.

6. There is no other company that can perform these services due the proprietary nature of the equipment and software.
