14. DESCRIPTION OF AMENDMENT/MODIFICATION

Amendment #001 is issued to make the following changes:

1. The attached section II.C Technical Proposal shall replace section II.C. in the Solicitation Agreement. The attached section updates the paragraph discussing FAR 15.305(a)(2)(iv) to reflect the minimum number of reference forms required, and corrects the chart describing the rating of the millwork fabricator:

2. Attachment C to the Solicitation Agreement- “Past Performance Questionnaire, Survey, and Sample Letter (Similar Work)” has been revised to reflect the length of time for consideration of completed projects and correct the due date of the survey. See attached revised questionnaire and sample letter.

3. The below is included in The Agreement:

APPROVED KEY PERSONNEL AND SUBCONTRACTORS

The Contractor must exclusively utilize the key personnel and/or subcontractors identified in the Contractors proposal to perform the corresponding services. In the event that any of the key personnel or subcontractors identified in the proposal, as accepted by the Government at contract award, are unable to perform their duties, the Contractor shall promptly (within 2 days) submit to the CO a detailed written explanation of the circumstances, and shall submit the name and qualifications of a proposed replacement with equal or superior qualifications. Upon request, the Contractor shall also submit any other information the CO deems pertinent to evaluate the substitution.

The Government reserves the right to approve or disapprove any changes in key personnel and/or subcontractors proposed by the Contractor after award. No substitution shall be made without prior approval of the CO. Any approved substitutions shall be made at no increase in contract price, delay in contract performance and/or decrease in capabilities.

All other solicitation terms and conditions remain unchanged.

II.C. Technical Proposal

II.C.1 Past Performance of the Offeror

i. Similar Work

Description:

This factor considers the quality of the offeror’s past performance and the relevance and complexity of the offeror’s past experience in successfully completing similar projects. References must be submitted for at least two (2), but no more than five (5) projects that meet the criteria stated below.

Standard for Evaluation:

Past Performance is defined as follows: Past performance is relevant information regarding an offeror’s actions under previously awarded contracts. The criteria which relevant past performance will be rated on includes the offeror’s compliance with the terms and conditions of the contract; overall quality of performance, record of conforming to contract requirements and to standards of good workmanship; the offeror’s adherence to contract schedules, including the administrative aspects of performance; the responsiveness and communication of managerial staff; over all contract performance; and a previous/current customer’s desire to contract with the firm again. The contracts submitted may have been Governmental (Federal, State, or Local) or private sector contracts.

Offerors are responsible for obtaining past performance information prior to submission of offers. The Past Performance Questionnaire and Survey Form (Attachment C) shall be completed by the references and submitted directly to the GSA Contract Specialist , Selena Haavig, via email to: selena.haavig@gsa.gov. Questionnaire and Survey forms received directly from the offeror will not be considered. The subject line of the email shall be “Past Performance Questionnaire – RFP GS05P11FBC0043. A “Past Performance Questionnaire/Survey” is included as Attachment C to the solicitation package and must be utilized for this purpose. An optional sample letter is also included to assist in requesting this information. Past Performance Questionnaire/Survey Forms must be received by the Contract Specialist by the time set for receipt of proposals.

Please note GSA prohibits the release of name of the persons providing the responses. Complete confidentially will be maintained. Reference is made to FAR 15.306(e)(4). The full text of this regulation may be found at http://www.arnet.gov/far/.

Past performance (Similar Work) will be considered relevant if it meets all of the following criteria:

1). The contract was for renovation in a commercial or government owned building with construction costs over $500,000 and a scope of work that included demolition, electrical work, HVAC, flooring, millwork installed pursuant to Architectural Woodwork Institute (AWI) standards, and selective demolition that included reconfiguration of existing structural elements (beams. Columns, etc.) to create a more flexible floor plan.

2). The offeror was the GC on the project and performed at least 12% of the work with its own organization under the contract.

3). If current, the contract is at least 90% complete.

4). If expired, the contract was completed within ten years of the closing date of this solicitation.

Past performance will be evaluated by analysis of information provided in the forms. The past performance references may be interviewed. The offeror cannot use the same reference/contact person or project more than once for this factor.

A minimum of two (but no more than five) references must be provided. The Government is not required to review more than two references, although it may choose to do so. Additionally, if more than two references are provided, the Government reserves the right to choose which references to include in its evaluation.

In addition to those references provided directly by the offeror, the Contracting Officer may identify and analyze the past performance of the offeror on any other contract that the offeror currently has or had, of which the Contracting Officer has knowledge or obtains knowledge, including but not limited to projects listed in the Past Performance Information Retrieval System (PPIRS). Because of the wide variety of past performance history of individual offerors, the Government is not required to ensure that an equal number of references be obtained for each offeror.

The relevant past performance references will be evaluated using an adjectival rating which corresponds to a numerical score as indicated in the chart below. For each form provided, the ratings will be totaled.

The totals from each form will then be averaged to provide an average score for this factor.

FAR 15.305(a)(2)(iv) states, “In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available, the offeror may not be evaluated favorably or unfavorably on past performance.” Therefore, failure of the offeror to provide a minimum of two relevant references that meet the criteria listed above, and/or the inability of the Government to complete a minimum of two reference checks, after making a reasonable effort to do so, will result in the offeror being rated as “neutral” on the past performance factor.

The Government will not consider past performance information submitted by the offeror regarding predecessor companies, key personnel who have relevant experience, or subcontractors that will perform major or critical aspects of the requirement.

Failure to comply with the requirements above may render the offeror ineligible for award.

The Government will only consider past performance information submitted for work performed by the joint venture (including joint ventures established through the 8(a) Business Development Mentor- Protégé Program). For each project, provide contact information for a reference who can provide thorough knowledge of the details of the firm’s experience (such as a General Contractor, Client, Project Manager, Building Owner, or Contracting Official associated with a project).
