11. SUBCONTRACTING
It is the policy of the United States that small business concerns, veteran-owned small business concerns, service-disabled veteran-owned small business concerns, HUBZone small business concerns, small disadvantaged business concerns, and women-owned small business concerns shall have the maximum practicable opportunity to participate in performing contracts let by any Federal agency, including contracts and subcontracts. It is further the policy of the United States that its prime contractors establish procedures to ensure the timely payment of amounts due pursuant to the terms of their subcontracts. The Contractor hereby agrees to carry out this policy in the awarding of subcontracts to the fullest extent consistent with efficient contract performance. The Contractor further agrees to cooperate in any studies or surveys as may be conducted by the United States Small Business Administration or the awarding agency of the United States as may be necessary to determine the extent of the Contractor’s compliance with this clause.
The Contractor shall not enter into any subcontract in excess of $30,000 with a Contractor that is debarred, suspended, or proposed for debarment unless there is a compelling reason to do so. The Contractor shall notify the Contracting Officer, in writing, before entering into a subcontract with a party that is debarred, suspended, or proposed for debarment.
Nothing contained in the contract shall be construed as creating any contractual relationship between any subcontractor and the Government. The Contractor shall be responsible to the Government for acts and omissions of his own employees and of subcontractors and their employees. 13. BASIS OF AWARD
The Government will award a contract resulting from this solicitation to the responsible offeror whose proposal conforms to the solicitation and provides the best value to the Government, based on the evaluation factors. Two factors will be evaluated: (1) past performance and (2) total evaluated price. Past performance is significantly more important than total evaluated price. As proposals become more equal in terms of past performance, the total evaluated price becomes more important.
Note: The Government intends to evaluate proposals and award a contract without discussions with offerors. Therefore, the offeror's initial proposal should contain the offeror's best terms from a cost or price and technical standpoint. The Government reserves the right to conduct discussions if the Contracting Officer later determines them to be necessary. The Government reserves the right to make an award to other than the lowest priced offer if it is determined that to do so would result in the best value to the Government.
14. DESCRIPTION OF EVALUATION FACTORS
1. PAST PERFORMANCE
Past performance is relevant information regarding an offeror’s actions under previously awarded contracts. It includes the offeror’s overall quality of performance, record of conforming to contract requirements and to standards of good workmanship; the offeror’s adherence to contract schedules, including the administrative aspects of performance; the responsiveness of management; the offeror’s history of reasonable and cooperative behavior and commitment to customer satisfaction, including the offeror’s business-like concern for the interest of the customer; and the offeror’s overall performance on their contracts.
To be relevant, past performance information must be provided for contracts that are: (1) current (completed within the last 5 years of the closing date of this solicitation or if a project currently in progress, at least 90% complete) and (2) similar to the Government
PREPROPOSAL CONFERENCE Page 3 of 5 requirement (the contract was for exterior stone masonry repairs and comparable in size and complexity to the one detailed in the specifications and drawings).
The contracts submitted may have been governmental (federal, state, or local) or private sector contracts.
The offeror shall submit 3-10 references using Attachment A–Past Performance Reference Sheet provided in the solicitation. This form must be completed for each reference submitted that meets the relevancy criteria. The offeror cannot use the same reference/contact person more than once.
B. TOTAL EVALUATED PRICE
A lump sum offer is required for all work identified as “base bid” per the specifications and drawings. An offer for unit prices is required for any addition to those materials and services outlined in the specifications and drawings. Only the “base bid” will be considered in the total evaluated price.
Only proposals for a complete project will be accepted and not proposals for materials and/or separate labor disciplines.
Note: FAR 52.219-4 – Notice of Price Evaluation Preference for HUBZone Small Business Concerns is applicable to this procurement (see Representations and Certifications section or Contract Clauses). Therefore, a price adjustment to an offeror’s proposed price may be made, if applicable, for evaluation purposes only.
