PROJECT IDENTIFICATION

4th and 22nd Floor Space Alterations (RMI05017) Patrick V. McNamara Federal Building, 477 Michigan Avenue, Detroit, MI

SCOPE OF WORK

This project shall generally consist of the renovation of part of the 4th floor and the entire 22nd floor at the Patrick V. McNamara Federal Building. The scope of work includes modifying the existing fire alarm and sprinkler systems, and providing new building standard ceilings, lighting, and HVAC systems. No finishes will be included in the contract.

WORK RESTRICTIONS/CONTRACTOR USE OF PREMISES

During the entire construction period, the Contractor shall limit his use of the premises to the work indicated. The work area is unoccupied and the Contractor’s work hours shall generally be established to occur during normal business hours (8am – 5pm).

However, portions of the work which will create excessive noise shall be completed after hours. Noisy work includes, but is not limited to duct work installation, ceiling work and any other work which creates vibrations such as coring and drilling. Fire alarm testing can only be done after 6pm or prior to 7am, Monday through Friday, or on a weekend or holiday. Testing shall be coordinated through the GSA Property Management Office 48 hours in advance of proposed testing date. Please refer to the solicitation for additional restrictions regarding fire alarm and fire sprinkler work.

There are currently no specific staging areas available so any arrangements for staging areas must be coordinated and approved by the GSA Property Management Office.

On-site parking is not available. Public parking is available in numerous pay lots nearby this site. The building loading dock is available during normal business hours as well as after business hours and weekends; however the Contractor must submit a written request to the GSA Property Management Office 48 hours in advance for appropriate security arrangements. Parking at the loading dock is limited to loading and unloading only. Please refer to the solicitation for maximum trailer dimensions. Transportation of tools and equipment in the building is limited to use of two freight elevators which service the entire building and have other approved contractors onsite using them as well. If there is a need for dedicated use of the freight elevators, this also must be coordinated in advance with the GSA Property Management Office.

Contract employees will be required to have a Government security clearance prior to starting work. Applicable clearance documents for employee completion and submission will be provided after award. FULL & OPEN COMPETITION

This procurement is unrestricted in accordance with the Small Business Competitiveness Demonstration Program and open to all business concerns. NAICS is 236220 with a size standard of $33.5 million. Offerors shall register their firms in the Online Representations & Certifications (ORCA) system prior to submitting their offer. SUBCONTRACTING

It is the policy of the United States that small business concerns, veteran-owned small business concerns, service-disabled veteran-owned small business concerns, HUBZone small business concerns, small disadvantaged business concerns, and women-owned small business concerns shall have the maximum practicable opportunity to participate in performing contracts let by any Federal agency, including contracts and subcontracts. It is further the policy of the United States that its prime contractors establish procedures to ensure the timely payment of amounts due pursuant to the terms of their subcontracts. The Contractor hereby agrees to carry out this policy in the awarding of subcontracts to the fullest extent consistent with efficient contract performance. The Contractor further agrees to cooperate in any studies or surveys as may be conducted by the United States Small Business Administration or the awarding agency of the United States as may be necessary to determine the extent of the Contractor’s compliance with this clause.

The Contractor shall not enter into any subcontract in excess of $30,000 with a Contractor that is debarred, suspended, or proposed for debarment unless there is a compelling reason to do so. The Contractor shall notify the Contracting Officer, in writing, before entering into a subcontract with a party that is debarred, suspended, or proposed for debarment.

Nothing contained in the contract shall be construed as creating any contractual relationship between any subcontractor and the Government. The divisions or sections of the specifications are not intended to control the Contractor in dividing the work among

PREPROPOSAL CONFERENCE Page 3 of 5 subcontractors, or to limit the work performed by any trade. However, please note FAR 52.236-1 Performance of Work by the Contractor which states, “The Contractor shall perform on the site, and with its own organization, work equivalent to at least twelve (12%) percent of the total amount of work to be performed under the contract. This percentage may be reduced by a supplemental agreement to this contract if, during performing the work, the Contractor requests a reduction and the Contracting Officer determines that the reduction would be to the advantage of the Government.”

The Contractor shall be responsible to the Government for acts and omissions of his own employees and of subcontractors and their employees. He shall also be responsible for the coordination of the work of the trades, subcontractors and suppliers. The Government will not undertake to settle any differences between or among the Contractor, subcontractors, or suppliers.

Contractors classified as Other Than Small Businesses, who plan to submit a proposal in excess of $1,000,000, must adhere to the requirements for developing and submitting subcontracting plans with your initial offer, as outlined in FAR 52.219-9, Small Business Subcontracting Plan. Failure to submit an acceptable subcontracting plan and/or correct deficiencies in a plan within the time specified by the Contracting Officer shall make the offeror ineligible for award.

GSA believes that this contract provides significant opportunities for the use of small, HUBZone small, small disadvantaged, women-owned, veteran-owned, and service-disabled veteran owned small business concerns as subcontractors. Accordingly, it is anticipated that an acceptable subcontracting plan will contain at least the following goals:

Small Business: 23% HUBZone Small Business 3% Small Disadvantaged Business 5% Women-Owned Small Business 5% Veteran-Owned Small Business N/A Service-Disabled Veteran-Owned Small Business 3% (Figures report FY07 U.S. Small Business Administration Government-wide Procurement Preference Goaling Program)

NOTE: Target goals are expressed as a percentage of planned subcontracting dollars.

SITE VISIT

All other site visits will be based on the availability of the Property Management staff and may be arranged during normal duty hours by calling the Property Management Office at (313) 226-4910.

BASIS OF AWARD

The Government will award a contract resulting from this solicitation to the responsible offeror whose proposal conforms to the solicitation and provides the best value to the Government, based on the evaluation factors. The following factors shall be used to evaluate proposals: (1) Past Performance and (2) Total Evaluated Price. Past Performance is significantly more important than total evaluated price. As past performance becomes more equal, total evaluated price becomes more important.

Note: The Government intends to evaluate proposals and award a contract without discussions with offerors. Therefore, the offeror's initial proposal should contain the offeror's best terms from a cost or price and technical standpoint. The Government reserves the right to conduct discussions if the Contracting Officer later determines them to be necessary. The Government reserves the right to make an award to other than the lowest priced offer if it is determined that to do so would result in the best value to the Government.

DESCRIPTION OF EVALUATION FACTORS

A. Past Performance.

Past performance is relevant information regarding an offeror’s actions under previously awarded contracts. It includes the offeror’s overall quality of performance, record of conforming to contract requirements and to standards of good workmanship; the offeror’s

PREPROPOSAL CONFERENCE Page 4 of 5 adherence to contract schedules, including the administrative aspects of performance; the responsiveness of management; the offeror’s history of reasonable and cooperative behavior and commitment to customer satisfaction, including the offeror’s business-like concern for the interest of the customer; and the offeror’s overall performance on their contracts. This information will be obtained through feedback from the offeror’s customers. To be relevant, past performance information must be provided for contracts that are: (1) current (completed within the last 5 years of the closing date of this solicitation or if a project currently in progress, at least 90% complete) and (2) similar to the Government requirement (the construction project defined in these specifications and drawings). The contracts submitted may have been governmental (federal, state, or local) or private sector contracts.

The offeror shall submit 3-7 references using Attachment A–Past Performance Reference provided in the solicitation. This form must be completed for each reference submitted that meets the relevancy criteria. The offeror cannot use the same reference/contact person more than once. The Government will consider past performance information submitted by the offeror regarding predecessor companies, key personnel who have relevant experience or subcontractors that will perform major or critical aspects of the requirement.

B. Total Evaluated Price A lump sum offer is required for all work per the specifications and drawings. The lump sum offer will equal the total evaluated price. Only proposals for the complete project will be accepted and not proposals for materials and/or separate labor disciplines. The Government will use various price analysis techniques and procedures (e.g. comparison of proposed prices received in response to the solicitation, comparison of proposed prices with independent Government cost estimates) to ensure a fair and reasonable price.

Note: FAR 52.219-4 Notice of Price Evaluation Preference for HubZone Small Business Concerns is applicable to this procurement (see Volume III, Representations and Certifications). Therefore, a price adjustment to an offeror’s proposed price may be made, if applicable, for evaluation purposes only.

Questionnaire for Public Trust Positions

Follow instructions fully or we cannot process your form. Be sure to sign and date the certification statement on Page 7 and the release on Page 8. If you have any questions, call the office that gave you the form.

Purpose of this Form

The U.S. Government conducts background investigations and reinvestigations to establish that applicants or incumbents either employed by the Government or working for the Government under contract, are suitable for the job and/or eligible for a public trust or sensitive position. Information from this form is used primarily as the basis for this investigation. Complete this form only after a conditional offer of employment has been made.

Giving us the information we ask for is voluntary. However, we may not be able to complete your investigation, or complete it in a timely manner, if you don’t give us each item of information we request. This may affect your placement or employment prospects.

Authority to Request this Information

The U.S. Government is authorized to ask for this information under Executive Orders 10450 and 10577, sections 3301 and 3302 of title 5, U.S. Code; and parts 5, 731, 732, and 736 of Title 5, Code of Federal Regulations.

Your Social Security number is needed to keep records accurate, because other people may have the same name and birth date. Executive Order 9397 also asks Federal agencies to use this number to help identify individuals in agency records.

The Investigative Process

Background investigations are conducted using your responses on this form and on your Declaration for Federal Employment (OF 306) to develop information to show whether you are reliable, trustworthy, of good conduct and character, and loyal to the United States. The information that you provide on this form is confirmed during the investigation. Your current employer must be contacted as part of the investigation, even if you have previously indicated on applications or other forms that you do not want this.

In addition to the questions on this form, inquiry also is made about a person’s adherence to security requirements, honesty and integrity, vulnerability to exploitation or coercion, falsification, mis-representation, and any other behavior, activities, or associations that tend to show the person is not reliable, trustworthy, or loyal.

Your Personal Interview

Some investigations will include an interview with you as a normal part of the investigative process. This provides you the opportunity to update, clarify, and explain information on your form more completely, which often helps to complete your investigation faster. It is important that the interview be conducted as soon as possible after you are contacted. Postponements will delay the processing of your investigation, and declining to be interviewed may result in your investigation being delayed or canceled.

You will be asked to bring identification with your picture on it, such as a valid State driver’s license, to the interview. There are other documents you may be asked to bring to verify your identity as well.

These include documentation of any legal name change, Social Security card, and/or birth certificate.

You may also be asked to bring documents about information you provided on the form or other matters requiring specific attention.

These matters include alien registration, delinquent loans or taxes, bankruptcy, judgments, liens, or other financial obligations, agreements involving child custody or support, alimony or property settlements, arrests, convictions, probation, and/or parole.

Instructions for Completing this Form

1. Follow the instructions given to you by the person who gave you the form and any other clarifying instructions furnished by that person to assist you in completion of the form. Find out how many copies of the form you are to turn in. You must sign and date, in black ink, the original and each copy you submit.

2. Type or legibly print your answers in black ink (if your form is not legible, it will not be accepted). You may also be asked to submit your form in an approved electronic format.

3. All questions on this form must be answered. If no response is necessary or applicable, indicate this on the form (for example, enter "None" or "N/A"). If you find that you cannot report an exact date, approximate or estimate the date to the best of your ability and indicate this by marking "APPROX." or "EST."

4. Any changes that you make to this form after you sign it must be initialed and dated by you. Under certain limited circumstances, agencies may modify the form consistent with your intent.

5. You must use the State codes (abbreviations) listed on the back of this page when you fill out this form. Do not abbreviate the names of cities or foreign countries.

6. The 5-digit postal ZIP codes are needed to speed the processing of your investigation. The office that provided the form will assist you in completing the ZIP codes.

7. All telephone numbers must include area codes.

8. All dates provided on this form must be in Month/Day/Year or Month/Year format. Use numbers (1-12) to indicate months. For example, June 10, 1978, should be shown as 6/10/78.

9. Whenever "City (Country)" is shown in an address block, also provide in that block the name of the country when the address is outside the United States.

10. If you need additional space to list your residences or employments/self-employments/unemployments or education, you should use a continuation sheet, SF 86A. If additional space is needed to answer other items, use a blank piece of paper. Each blank piece of paper you use must contain your name and Social Security Number at the top of the page.

Final Determination on Your Eligibility

Final determination on your eligibility for a public trust or sensitive position and your being granted a security clearance is the responsibility of the Office of Personnel Management or the Federal agency that requested your investigation. You may be provided the opportunity personally to explain, refute, or clarify any information before a final decision is made.

Penalties for Inaccurate or False Statements

The U.S. Criminal Code (title 18, section 1001) provides that knowingly falsifying or concealing a material fact is a felony which may result in fines of up to $10,000, and/or 5 years imprisonment, or both. In addition, Federal agencies generally fire, do not grant a security clearance, or disqualify individuals who have materially and deliberately falsified these forms, and this remains a part of the permanent record for future placements. Because the position for which you are being considered is one of public trust or is sensitive, your trustworthiness is a very important consideration in deciding your suitability for placement or retention in the position.

Your prospects of placement are better if you answer all questions truthfully and completely. You will have adequate opportunity to explain any information you give us on the form and to make your comments part of the record.

Disclosure of Information

The information you give us is for the purpose of investigating you for a position; we will protect it from unauthorized disclosure. The collection, maintenance, and disclosure of background investigative information is governed by the Privacy Act. The agency which requested the investigation and the agency which conducted the investigation have published notices in the Federal Register describing the system of records in which your records will be maintained. You may obtain copies of the relevant notices from the person who gave you this form. The information on this form, and information we collect during an investigation may be disclosed without your consent as permitted by the Privacy Act (5 USC 552a(b)) and as follows:

If all of your education occurred more than 7 years ago, list your most recent education beyond high school, no matter when that education occurred.

Use one of the following codes in the "Code" block:

1 - High School 2 - College/University/Military College 3 - Vocational/Technical/Trade School

For schools you attended in the past 3 years, list a person who knew you at school (an instructor, student, etc.). Do not list people for education completely outside this 3-year period.

For correspondence schools and extension classes, provide the address where the records are maintained.

WHERE YOU HAVE LIVED

List the places where you have lived, beginning with the most recent (#1) and working back 7 years. All periods must be accounted for in your list. Be sure to indicate the actual physical location of your residence: do not use a post office box as an address, do not list a permanent address when you were actually living at a school address, etc. Be sure to specify your location as closely as possible: for example, do not list only your base or ship, list your barracks number or home port. You may omit temporary military duty locations under 90 days (list your permanent address instead), and you should use your APO/FPO address if you lived overseas.

For any address in the last 5 years, list a person who knew you at that address, and who preferably still lives in that area (do not list people for residences completely outside this 5-year period, and do not list your spouse, former spouses, or other relatives). Also for addresses in the last 5 years, if the address is "General Delivery," a Rural or Star Route, or may be difficult to locate, provide directions for locating the residence on an attached continuation sheet.

Previous Periods of Activity. Complete these lines if you worked for an employer on more than one occasion at the same location.
