AMENDMENT NO. 3

TO THE BIDDING DOCUMENTS FOR

GENERAL SERVICES ADMINISTRATION

OFFICE OF CUSTOMER SOLUTIONS

DAYTON USMS FIRST FLOOR SALLYPORT

ISSUE DATE: March 11, 2009

PART 1 - GENERAL

1.1 GENERAL

A. This Amendment covers changes to the Documents and in closing the Contract will become a part thereof. Each Bidder shall include these items to the extent they affect this Bid.

B. These items modify only the portion of the Documents specifically noted. All other wording and Drawings remain in effect.

1.2 BIDDER QUESTION RESPONSES

A. Are the ceilings in rooms 133, 134, and 116 to be replaced? General note 1 calls for the removal of all ceilings in rooms where partitions are to be removed, but there is nothing noting for them to be replaced in the finish schedule. Also note 18 calls for them to remain. In room

116 there is nothing indicated? (This was asked during the prebid) Yes, refer to amendment sheet A0401.

B. There is nothing specifying that the existing VCT flooring is to be removed. Is there going to be a note added via amendment since it calls for new flooring in these areas? Yes, refer to amendment sheet A0101. The floor tile and mastic located in the first floor work area has been tested for asbestos. Analytical results indicate that the floor tiles contain 3% chrysotile asbestos and the mastic contains 2% chrysotile asbestos. The black mastic located under carpeting also contains asbestos. The floor tiles and mastic will need to be abated by a licensed abatement contractor. Please see the amended Specification 02080, included herein, for further details.

C. Has all of the fireproofing been tested for asbestos? The fireproofing located on the first floor and basement has been tested for asbestos. Analytical results indicate that NO asbestos is present in the fireproofing.

D. There are doors shown to the plumbing chases at each of the (3) cells but there is no call number for the doors. Please refer to amendment specification section 08311, and amended specification section 08712 (for cylinder lock) included herein.

DAYTON, OHIO

Do not remove this Notice. Properly destroy

E. Do the bullet-proof panels in the Type 9 walls need to run all the way to the deck. The detail calls for the walls to, but do the underlying panels have to? Yes.

F. Can you clarify the extent of the chair rail and crown molding (all walls in a room etc…) and which rooms are to receive the wood trim(s)? Yes, refer to amendment sheet A1001.

G. Are there any drawings showing the construction of the existing postal lookout gallery that we could use when estimating the demolition? Yes, refer to original construction document sheet number 5-28, included herein.

H. Will we be allowed to use the existing toilet rooms (rooms 135 & 136) during construction?

The contractor must supply and maintain these rooms in order to use them. Their primary purpose is to serve building tenants. If at any time the Building Property Manager judges that these rooms are not being maintained, then the contractor’s privileges’ shall be revoked.

I. Drawing A401 has a note at the dock that reads “if no fireproofing then apply 2 hour rated assembly”. Since the area has an existing plaster ceiling and is not able to be viewed, should the contractor include or exclude fireproofing. It is permissible for the bidders to exclude items they cannot visibly verify at this time.

J. Specification 01310 Section 1.5 requires a “Full Time Project Coordinator, Full Time

Mechanical Coordinator and a Full Time Electrical Coordinator” in addition to the “Project

Superintendent”. Can the project coordinators and superintendent be the same person? Yes.

K. Specification 02080 Section 1.2 discusses the possibility of ACM pipe insulation inside air handling unit AHU-6. Will the A/E be responsible for identifying whether or not the pipe insulation is ACM? Who will test this material? If the material is found to be ACM, the contractor is required to give 10 days notification to the Ohio EPA. Will the 10 days be added onto the schedule duration? Please see the Amended Specification 02080 for details regarding all asbestos abatement activities. The Contractor will need to file notification to handle other ACM identified, so additional time for notification would not be necessary.

When access to the presumed asbestos containing materials (PACM) is available, the A/E shall work with the Contractor to obtain samples of the presumed materials. The

Contractor should provide a unit rate for the estimated quantity provided in the amended specification 02080.

L. How late can bidder questions be asked? Friday 3-6-09.

M. Is there space available in the building for the storage of materials? There is very limited storage space available inside the building. The building manager would have to approve any usage of existing space for storage other than the limits of the construction work area inside the building. GSA will vacate 13 parking spaces south of the dock that the contractor can use for staging materials or placing trailers. Contractor must keep the drive lanes open along with the three dock levelers.

N. Can contractors work during normal working hours (i.e. straight time)? Can contractors perform exterior work during normal business hours? All noisy and disruptive work must be performed during non-business hours. Business hours are defined as 7 AM to 5 PM.

DAYTON, OHIO

Do not remove this Notice. Properly destroy

Work can be performed during normal business hours provided it is not disruptive to the building tenants.

O. Is the existing 4,000 gallon underground water tank filled with water? Is a permit required to remove this tank? The tank is filled with potable (drinking) water. Contractor is responsible for draining and removing the tank.

P. Contractor asked how they can transport AHU-6 into the basement. Contractors are permitted to use the freight elevator.

Q. Sheet a1001 – Door Schedule – Hardware set 18 is scheduled for cell doors 120, 121, & 122.

Which is the same as scheduled for Door 105C. Is this correct? The specs only lists 105C for

Hardware set 18. Cell Doors 120, 121, 122 and 123 shall be Hardware set 19, add via this amendment. Refer to amended specification section 08712.

R. No hardware is scheduled for the cell door in Room 117 – Isolation cell. The Cell door has been amended to be Door 123. Cell Doors 120, 121, 122 and 123 shall be Hardware set 19, add via this amendment. Refer to amended specification section 08712.

S. Drawing A0202 – coded sheet note #1 calls out to “provide 6” cmu partition from top of existing wall to underside of deck…” Is there an existing partition above 15’ elevation that needs to be demolished and if so what is the material? No partition above 15’ elevation.

T. Drawing A0202 – The 4 detention cells show a shaded area that we are assuming to be the benches (detail 3 on A0801). Since the void under the benches is to be filled with insulation (3

A0801) do you want the bench ends at the wire mesh partitions to be open and let the insulation show? No, provide 12 Ga. stainless steel end closure panels at all exposed end conditions.

U. Drawing A0501 – elevations 1 & 2 and Drawing A0802 – On the public side of the bullet proof windows drawing A0501 elevations show stainless steel countertop while drawing A0802 calls out polymer resin. Also if a polymer resin is required will there be any supports or attachments to the bullet proof window frame? The countertop is polymer resin; the document pass-through (deal tray) shall be stainless steel. Disregard the notes on sheet A0501 –

Elevations 1 & 2. Final detailing per cabinet maker. Refer to amendment sheet A0501.

V. My problem is that the specs for the security ceilings (09549) and the Reflected Ceiling Plan

(A0401) do not match up in data. The specs call for 14 gauge 2’x4’ Lockdown panels. The drawings do not show Lockdown. They show 24” wide Cel-Line planks 84” to 144” long. I need to know what is actually being bid here. If it is Lockdown, I will either need the square footage or corrected drawings to show me what to quote. If it is Cel-Line the drawings I have are fine but I will need the specs corrected. Thank you for your help on this. Please let me know if there is any other information that I can provide. Please bid 2’ wide security plank (refer to amended sheet A0401) and refer to amended specification 09549, included herein.

W. In reviewing the drawings we unable to locate the details for the “security ceiling”? Please provide manufacturers standard details. Refer to Spec 09549.

X. On the wall details there is a symbol 1’ – 4” c/c, please explain. URS does not understand this question.

DAYTON, OHIO

Y. On drawing S0101 you have a floor drain shown but no connection point or oil interceptor. This is the only place I find the floor drain. It does not show up on the plumbing plans or the plumbing schedule. Please advise. Refer to sheets P0200 and P0201 in the Bid Set. He new floor drain is indicated between columns L and J, and approximately 25 ft south of column

17.

Z. Good mourning Fred, I have a question on the VAV box piping hook up. On the drawings there are no details on the piping and pipe specialties. So the question is does the piping just hook up to the units with no specialties or valves or anything or a typical installation with valves and control valves, straines, pt, thermometers, return loop, etc. please clarify and specify which you prefer, thanks, Kris Williams @ Precision Piping, Inc. Refer to revised sheet M0500, a detail has been added to indicate the requirements for the reheat coils at VAV boxes.

AA. Concerning carpet spec --- atlas cpt 1 26 oz. (integral pad) ----cpt 2 Tandus 38 oz (integral pad).

NOTE: The following materials were also sampled and tested for asbestos: ceiling tiles, Ceiling tiled glue, drywall, join compound, mortar, plaster (inside work area), burlap, tar paper, and fireproofing. Analytical results indicated that these materials did not contain asbestos.

C. The Scope of Work includes the removal and disposal of confirmed and presumed ACM and asbestos-contaminated fiberglass insulation in areas of the US Courthouse and Federal Office Building affected by the USMS First Floor Sallyport project (See Drawings). If any other materials are found, which are suspected of containing asbestos, notify the Environmental Consultant immediately.

1. First Floor, USMS Center:

a. White tape on existing duct insulation joints and duct sealant (between metal joint) are known to be ACM and are to be removed. Areas above hard ceilings or acoustical ceiling tiles were not observed; therefore, materials may be located above these surfaces. If materials are encountered during demolition, these materials must be abated.

b. Plaster soffit was observed above Rooms 112 and 113. Due to the height of this soffit (15 feet above finished floor) a sample could not be collected. This material is presumed to be ACM (PACM). The plaster soffit shall be removed in accordance with all federal, state, and local regulations unless the Contractor can identify that this material is NOT ACM.

c. Approximately 18 Fire Doors require removal per specifications. These doors are PACM. The fire doors shall be removed in accordance with all federal, state, and local regulations unless the Contractor can identify that this material is NOT

ACM.

d. Vibratory bands were observed on duct work located in the project area. Sample of this material could not be collect while the unit was in operation; therefore, these materials are presumed to be ACM (PACM). The vibratory bands shall be

ASBESTOS ABATEMENT 02080 - 5

removed in accordance with all federal, state, and local regulations unless the Contractor can identify that this material is NOT ACM.

e. Floor tiles and floor tile mastics located throughout the first floor work area are ACM. These materials are classified as Category I non-friable ACM and must be removed in accordance with all federal, state, and local regulations.

f. The Contractor will clean all asbestos debris accumulated on the all surfaces and debris collected on the all components (mechanical, electrical, etc.) to be demolished.

2. Basement Mechanical Room, AHU 6:

a. White tape on existing duct insulation joints and duct sealant (between metal joint) are known to be ACM and are to be removed. If materials are encountered during demolition, these materials must be abated.

b. Three vibratory bands were observed on AHU 6. Sample of this material could not be collect while the unit was in operation; therefore, these materials are presumed to be ACM (PACM). The vibratory bands shall be removed in accordance with all federal, state, and local regulations unless the Contractor can identify that this material is NOT ACM.

c. Due to the operation of this unit, a complete inspection of the interior was not possible. ACM pipe insulation has been identified in other AHUs at this facility.

It is possible that the Contractor may encounter ACM pipe insulation. If suspect insulation is encountered, the Owner’s Representative shall be notified immediately.

d. The Contractor will clean all asbestos debris accumulated on the floor surface and debris collected on the valves and mechanical components to be demolished.

C. Coordination and Scheduling

1. The Contractor must begin and complete all Work within the time established in the Contract and the Notice to Proceed issued by Government Services Administration (GSA) to the Contractor. The Contractor shall provide preconstruction submittals as specified in Subparagraph 1.5.B through 1.5.I of this Section for review and approval at least 24 hours prior to onsite asbestos hazard abatement work.

2. The Contractor shall coordinate with GSA, Environmental Consultant, and other contractors for the successful completion of the Work.

3. All work within asbestos regulated area(s) not related to asbestos abatement shall cease and shall not commence until asbestos hazard abatement operations are complete to the satisfaction of the Environmental Consultant.

D. This specification is based on an Asbestos and Lead-Based Paint Survey of the site conducted by Versar in February, 2006. URS conducted inspections of the work areas within the building on May 15 and 22, 2008 and March 6, 2009.

Contract completion requirements stipulated.

2. The GSA will provide access upon written request to electrical distribution, which shall not be metered.

3. The GSA will provide a non-metered connection point for potable water as close to the Work as presently exists.

4. The Owner will allow access to the site daily for the duration of Work unless otherwise indicated.

5. The Owner may have an on-site representative to verify compliance with governing regulations and Contract Documents. The furnishing of this representative shall not make the Owner responsible for Contractor's failure to perform work in accordance with regulations and/or the Contract Documents.

F. The Owner's Representative shall provide all items and services in accordance with this
