JUSTIFICATION FOR OTHER THAN FULL AND OPEN

COMPETITION

1. ldentification of Aqency and Contractinq Authority: General Services Administration / Public Buildings Service, Region 3.This document constitutes a justification and approval for other than full and open competition for the acquisition described herein.

2. Nature andlor description of the action being approved: This office proposes to procure through limited competition utilizing Request for Proposal (RFP) procedures a contract for an updated Feasibility Study of the Envelope Masonry and Complete Building Window Conditions at the U.S.

Customhouse, Philadelphia PA.

3. Description of the supplies or services required to meet the agency's needs: The work will include an update to the previous Building Feasibility Study completed in 2004 which was originally completed by Hillier Architecture. The focus of this requirement will be on the current condition of the envelope masonry condition and building windows condition. Optional work will include an updated cost estimate based on survey of the current conditions and consultation with the State Historic Preservation Officer (SHPO). This building includes many historical features and is included on the National Register of Historic Places.

4. ldentification of Statutory Authority permitting other than full and open competition: Contracting without providing for full and open competition under this acquisition may be accomplished pursuant to the authority 41 U.S.C. 253(c)(1), as implemented by paragraph 6.302-1 (a)(2) of the Federal Acquisition Regulations, where the agency's need for supplies or services is only available through one responsible source.

5. Demonstration of the proposed contractor's unique qualifications or the nature: Hillier Architecture is uniquely qualified for this requirement due to their work on the previous feasibility study in 2004. Since this is a follow-on contract for the continued provision of highly specified services, award to any other source would result in substantial duplication of cost to the Government.

6. A description of efforts made to ensure that offers are solicited from as many sources as is practicable: This acquisition will be synopsized in the Commerce Business Daily as required by FAR 5.2.

7. A determination by the Contracting Officer that the anticipated costs to the Government will be fair and reasonable: It is anticipated that the cost to the Government will be fair and reasonable based on previous estimates the contractor has given to the Government to perform this type of work.

8. A description of the market survey conducted and the results or a statement of the reasons a market survey was not conducted: N/A

9. Anv other facts supporting the use of other than full and open competition: N/A

10. List of the sources, if anv, that expressed, in writing, an interest in the acquisition: N/A

11. A statement of the actions, if anv, the anencv mav take to remove or overcome any barriers to competition before anv subsequent acquisition for the services required: The procurement addressed by this J&A is an exception to the use of full and open competition that has resulted from only one responsible source.

12. A statement of deliverv requirements: Performance of the contract will commence immediately following the Notice of Award. The contractor is required to complete the contract within 120 days of receiving the Notice ot Award.
